{"id":355272,"date":"2025-08-01T14:00:24","date_gmt":"2025-08-01T08:30:24","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=355272"},"modified":"2025-08-05T09:49:11","modified_gmt":"2025-08-05T04:19:11","slug":"delhi-hc-declares-nutella-as-well-known-trade-mark","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/08\/01\/delhi-hc-declares-nutella-as-well-known-trade-mark\/","title":{"rendered":"Delhi High Court declares \u2018NUTELLA\u2019 as a well-known trade mark"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> In the present case, the plaintiffs sought a decree of permanent injunction for infringement of its trade mark, passing off, delivery up and damages against the defendant in respect of its trade mark \u2018NUTELLA\u2019 and <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-1.png\" alt=\"\" width=\"200\" height=\"50\" \/>, and even sought their mark \u2018NUTELLA\u2019 to be declared as a well-known trade mark under Section 2(zg) of the Trade Marks Act, 1999 (\u2018the 1999 Act\u2019). A Single Judge Bench of <span style=\"font-weight: bold;\">Saurabh Banerjee<\/span>, J., <span style=\"font-weight: bold;\">declared \u2018NUTELLA\u2019<\/span>\/<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-2.png\" alt=\"\" width=\"200\" height=\"50\" \/> <span style=\"font-weight: bold;\">as a \u2018well-known trade mark\u2019 and<\/span> granted permanent injunction to the plaintiffs, thereby restraining the defendant and all persons acting on its behalf from manufacturing, packaging, supplying, distributing, selling, advertising, or dealing in any counterfeit \u2018NUTELLA\u2019 products. Further, the Court stated that the plaintiff was entitled to Rs 30,00,000 towards damages of the present proceedings and directed the defendant to pay Rs 2,00,000 as costs to Delhi High Court Bar Association Lawyers Social Security and Welfare Fund.<\/p>\n<h3>Background:<\/h3>\n<p style=\"margin-bottom: 3%;\">The plaintiffs were part of the globally recognized Ferrero Group, established in 1946, and were one of the leading chocolate producers and confectionery companies in the world. The plaintiffs products were sold under its popular brands\/trade marks, namely, FERRERO ROCHER, NUTELLA, TIC TAC, KINDER, KINDER JOY, KINDER BUENO, KINDER SCHOKO-BONS, CONFETTERIA RAFFAELLO, FERRERO RONDNOIR, and a host of other brands\/trade marks.<\/p>\n<p style=\"margin-bottom: 3%;\">The plaintiffs coined and adopted the mark \u2018NUTELLA\u2019 in 1964 for their hazelnut cocoa spread and have since then used a distinctive packaging design for its \u2018NUTELLA\u2019 jar <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-3.png\" alt=\"\" width=\"100\" height=\"150\" \/>, including a white plastic cap, black-and-red color-coded word mark <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-4.png\" alt=\"\" width=\"200\" height=\"50\" \/>, and illustration of a slice of bread with the hazelnut cocoa spread, a knife dipped in hazelnut cocoa spread, a jar of milk, two hazelnuts, the unique yellow flowers and leaves. The plaintiffs\u2019 were granted registration for the trade mark \u2018NUTELLA\u2019 and its variations under Classes 3, 5, 7, 8 to 12, 14 to 16, 18, 20, 21, 24, 25 to 28, 30, 31, 34, 38, 39 and 43, and its earliest registration for \u2019NUTELLA\u2019 dated back to 1975.<\/p>\n<p style=\"margin-bottom: 3%;\">The plaintiffs received a letter from the Food Safety Officer under the Food and Drug Administration (\u2018FDA\u2019) to appear before him as the FDA Department, during a raid, found the defendant to be manufacturing hazelnut cocoa spread under the brand \u2018NUTELLA FERRERO\u2019 under unhygienic conditions. Thus, the plaintiffs discovered that the defendant was manufacturing and distributing counterfeit \u2018NUTELLA\u2019 products under unhygienic conditions in Maharashtra.<\/p>\n<p style=\"margin-bottom: 3%;\">The plaintiffs submitted that they were the prior adopters and registered proprietors of the \u2018NUTELLA\u2019 trade mark and were thus entitled to exclusive use of the same. They asserted that the defendant&#8217;s use of identical trade mark, packaging, and trade dress was aimed at deceiving consumers into purchasing counterfeit goods under the false belief that they were genuine. The plaintiffs contended that \u2018NUTELLA\u2019 being an edible item, the defendant\u2019s actions, posed a major health risk to the consumers.<\/p>\n<h3>Case Analysis and Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court observed that it was so shocking that the defendant was using identical name, packaging, labels, trade dress without any authorization of the plaintiffs. This clearly showed its mala fide intent as it was guilty of using the registered trade marks of the plaintiff and clandestinely carrying on manufacturing\/offering\/selling\/marketing the impugned products with an intent to reflect that it was the plaintiffs and\/or connected with them in some manner as also to ride upon the well-established goodwill and reputation of the plaintiffs. The Court held that the plaintiff\u2019s being registered proprietors of the trade marks \u2018NUTELLA\/<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-5.png\" alt=\"\" width=\"200\" height=\"50\" \/>\u2019 and its variants, were well and truly entitled for the reliefs under Section 28 of the 1999 Act.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court emphasized that since the plaintiffs&#8217; products were edible consumer goods, the defendant\u2019s actions posed serious public health risks and potential harm to the plaintiffs\u2019 goodwill and reputation. The Court further observed that the defendant\u2019s continued absence from proceedings further raised suspicion over its conduct. The Court stated that permitting the defendant\u2019s operations would cause confusion, deception, and damage to both consumers and the plaintiffs.<\/p>\n<p style=\"margin-bottom: 3%;\">Therefore, the Court granted a permanent injunction, restraining the defendant and all persons acting on its behalf from manufacturing, packaging, supplying, distributing, selling, offering for sale, advertising, or dealing in any counterfeit \u2018NUTELLA\u2019 products, or any product not emanating from the plaintiffs or their authorieed distributors and bearing the trade mark \u2018NUTELLA\u2019, <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-6.png\" alt=\"\" width=\"200\" height=\"50\" \/>, <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-7.png\" alt=\"\" width=\"150\" height=\"100\" \/>, <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-8.png\" alt=\"\" width=\"100\" height=\"150\" \/>, or any other mark, trade dress identical or similar to the plaintiffs \u2018NUTELLA\u2019 trade marks thereby amounting to infringement of the plaintiffs\u2019 trade marks and passing off.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court stated that the plaintiff was entitled to Rs 30,00,000 towards damages of the present proceedings and directed the defendant to pay Rs 2,00,000 as costs to Delhi High Court Bar Association Lawyers Social Security and Welfare Fund within six weeks from the date of the present order.<\/p>\n<p style=\"margin-bottom: 3%;\">As regards the plaintiff\u2019s prayer for <span style=\"font-weight: bold;\">declaration of their trade mark \u2018NUTELLA\u2019 as a \u2018well-known trade mark\u2019<\/span>, the Court referred to Section 11(6) of the 1999 Act, and considered the <span style=\"font-weight: bold;\">extent of public recognition<\/span>, <span style=\"font-weight: bold;\">duration, extent and geographical use of the mark<\/span>. The Court noted that the plaintiffs had been using the \u2018NUTELLA\u2019 mark <span style=\"font-weight: bold;\">continuously since 1946<\/span>, with registrations dating back to <span style=\"font-weight: bold;\"><span style=\"font-weight: normal;\">1975;<\/span> <\/span>hey were <span style=\"font-weight: bold;\">globally established<\/span>, and their mark was widely recognised, not limited to India. Further, the Court noted that the mark \u2018NUTELLA\u2019 was already declared as a <span style=\"font-weight: bold;\"><span style=\"font-weight: normal;\">well-known trade mark<\/span><\/span> by the <span style=\"font-weight: bold;\">World Intellectual Property Organization<\/span> and the <span style=\"font-weight: bold;\"><span style=\"font-weight: normal;\">International Trade ark Association, and<\/span> <\/span>thus, <span style=\"font-weight: bold;\"><span style=\"font-weight: normal;\"> declared \u2018NUTELLA\u2019\/<\/span><\/span><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/08\/14_Ferrero-Spa-v.-M.B.-Enterprises-9.png\" alt=\"\" width=\"200\" height=\"50\" \/><span style=\"font-weight: bold;\"><span style=\"font-weight: normal;\"> as a \u2018well-known trade mark\u2019 under Section 2(zg)<\/span><\/span> of the 1999 Act.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Ferrero Spa v.
