Union of India"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">A court premise is a space that serves as the physical setting for the administration of justice. The basic and vital part of court infrastructure is a well-furnished courtroom, which includes chambers, restrooms, drinking water, waiting areas, judicial lockups, record rooms, Bar spaces, staff offices and facilities geared towards the needs of the public.<a id=\"fnref1\" title=\"1. Centre for Research and Planning, State of the Judiciary: A Report on Infrastructure, Budgeting, Human Resources, and ICT, 17-19 (Supreme Court of India, 2023).\" href=\"#fn1\"><sup>1<\/sup><\/a> Yet, for the people accessing court premises-litigants, lawyers, court staff and even Judges \u2014 the experience of traversing the justice delivery system in India is often marred by an unspoken indignity: the lack of access to adequate toilet facilities \u2014 sometimes non-availability, sometimes non-functional sometimes unhygienic, sometimes non-inclusive.<\/p>\n<p style=\"margin-bottom: 3%;\">The infrastructural neglect in the justice delivery system is more than a logistical fiasco; it is an alarming concern that contradicts with the constitutional mandate of upholding life and dignity. In the landmark case of <span style=\"font-style: italic;\">Rajeeb Kalita<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span><a id=\"fnref2\" title=\"2. 2025 SCC OnLine SC 81.\" href=\"#fn2\"><sup>2<\/sup><\/a>, the Supreme Court of India (SC) addressed this long-neglected issue. The SC uphold that the inadequate sanitation facilities in court premises violate the fundamental right to life and dignity protected under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\" rel=\"noopener\">21<\/a><a id=\"fnref3\" title=\"3. Constitution of India, Art. 21.\" href=\"#fn3\"><sup>3<\/sup><\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution of India<\/a><a id=\"fnref4\" title=\"4. Constitution of India.\" href=\"#fn4\"><sup>4<\/sup><\/a> (COI). This judicial narrative, progressive in tone and firm in its directives, unmasks the persistent neglect towards the basic requirements that underpin the administration of justice in India.<\/p>\n<h2>Court premises without toilets: A deep-rooted problem<\/h2>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-style: italic;\">Rajeeb Kalita case<\/span><a id=\"fnref5\" title=\"5. 2025 SCC OnLine SC 81.\" href=\"#fn5\"><sup>5<\/sup><\/a> originated from a public interest litigation, in which the poor sanitary condition across the Court premises in the State of Assam was highlighted by a practising Advocate Rajeeb Kalita. In response, the SC took suo motu cognizance and directed High Courts across India to submit tabular statements on affidavit demonstrating the status of availability, accessibility and maintenance of separate toilet facilities for different genders.<a id=\"fnref6\" title=\"6. 2025 SCC OnLine SC 81.\" href=\"#fn6\"><sup>6<\/sup><\/a><\/p>\n<p>A detailed report prepared by the \u201cCentre for Research &amp; Planning\u201d of the SC depicted a bleak picture. For instance:<a id=\"fnref7\" title=\"7. 2025 SCC OnLine SC 81.\" href=\"#fn7\"><sup>7<\/sup><\/a><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">a<\/span>) The Andhra Pradesh High Court needs a threefold increase in toilet facilities.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">b<\/span>) Twelve High Courts reported non-availability of toilets in District Court premises for Judges, staff, lawyers and litigants.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">c<\/span>) Nearly 20% of District Court premises lack separate toilets for women.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">d<\/span>) Only 6.7% of toilets are equipped with sanitary napkin vending machines.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(<span style=\"font-style: italic;\">e<\/span>) Several existing toilets are dysfunctional, with broken doors and inadequate water supply.<\/p>\n<p style=\"margin-bottom: 3%;\">The judgment emphasised that Court infrastructure must not just serve administrative needs but mirror constitutional mandates and public dignity.<\/p>\n<h2>Sanitation as a component of environmental and gender justice<\/h2>\n<p style=\"margin-bottom: 3%;\">Sanitation is not just a public health issue \u2014 it is a matter of human dignity, privacy, gender equity, environmental justice and overall well-being of the people. The recognition of the right to sanitation (RTS) is woven into the fabric of both Parts III and IV of the COI.<a id=\"fnref8\" title=\"8. Amlanika Bora, A Study of Right to Sanitation with Special Reference to Kamrup Metropolitan District of Assam (Ph.D. thesis, W. Bengal Nat\u2019l Univ. of Juridical Scis., 2025).\" href=\"#fn8\"><sup>8<\/sup><\/a> Judiciary through its liberal interpretation expanded the ambit of Article 21<a id=\"fnref9\" title=\"9. Constitution of India, Art. 21.\" href=\"#fn9\"><sup>9<\/sup><\/a> which ensures the right to life to include the RTS within it. Furthermore, the RTS is interlinked to Article 17 (abolition of untouchability)<a id=\"fnref10\" title=\"10. Constitution of India, Art. 17.\" href=\"#fn10\"><sup>10<\/sup><\/a>, Article 21-A (right to education)<a id=\"fnref11\" title=\"11. Constitution of India, Art. 21-A.\" href=\"#fn11\"><sup>11<\/sup><\/a> and several directive principles of State policy, being an element of socio-economic justice. More specifically, Articles 39(<span style=\"font-style: italic;\">e<\/span>)<a id=\"fnref12\" title=\"12. Constitution of India, Art. 39(e).\" href=\"#fn12\"><sup>12<\/sup><\/a>, 39(<span style=\"font-style: italic;\">f<\/span>)<a id=\"fnref13\" title=\"13. Constitution of India, Art. 39(f).\" href=\"#fn13\"><sup>13<\/sup><\/a>, 42<a id=\"fnref14\" title=\"14. Constitution of India, Art. 42.\" href=\"#fn14\"><sup>14<\/sup><\/a>, 47<a id=\"fnref15\" title=\"15. Constitution of India, Art. 47.\" href=\"#fn15\"><sup>15<\/sup><\/a> and 48-A<a id=\"fnref16\" title=\"16. Constitution of India, Art. 48-A.\" href=\"#fn16\"><sup>16<\/sup><\/a>, which direct the State to ensure health, humane work conditions, public health, and protection of environment-make sanitation a key element of social justice and constitutional governance.<a id=\"fnref17\" title=\"17. Amlanika Bora and Sanjay Kumar, \u201cRight to Sanitation in India through the Lens of Judiciary\u201d, (2022) 4(1) CMR University Journal for Contemporary Legal Affairs 125.\" href=\"#fn17\"><sup>17<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">The SC in <span style=\"font-style: italic;\">Rajeeb Kalita case<\/span><a id=\"fnref18\" title=\"18. 2025 SCC OnLine SC 81.\" href=\"#fn18\"><sup>18<\/sup><\/a> underscored the heavy toll of the sanitation related infrastructural neglect on women, transgender persons, persons with disabilities (PwDs) and socio-economically disadvantaged groups. Despite the existence of the \u201cHarmonised Guidelines and Standards for Universal Accessibility in India, 2021\u201d<a id=\"fnref19\" title=\"19. Ministry of Housing and Urban Affairs, Government of India, Harmonised Guidelines and Standards for Universal Accessibility in India (2021).\" href=\"#fn19\"><sup>19<\/sup><\/a>, court premises have consistently failed to incorporate universal design standards. Additionally, this institutional overlook goes against the \u201c<a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000343771\" target=\"_blank\" rel=\"noopener\">Transgender Persons (Protection of Rights) Act, 2019<\/a>\u201d<a id=\"fnref20\" title=\"20. Transgender Persons (Protection of Rights) Act, 2019.\" href=\"#fn20\"><sup>20<\/sup><\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, <span style=\"font-style: italic;\">Rajeeb Kalita case<\/span><a id=\"fnref21\" title=\"21. 2025 SCC OnLine SC 81.\" href=\"#fn21\"><sup>21<\/sup><\/a>, bridging the gaps between institutional justice and individual bodily dignity, makes it clear that the rights must be actualised in real, physical spaces \u2014 not just in legal texts.<\/p>\n<h2>Global commitments, local failures<\/h2>\n<p style=\"margin-bottom: 3%;\">India&#8217;s international commitments indicates that it has an obligation to fulfil RTS. India is a signatory to the International Covenant on Economic, Social and Cultural Rights (ICESCR) which under Article 11(1) implicitly encompasses RTS within the ambit of adequate standard of living.<a id=\"fnref22\" title=\"22. International Covenant on Economic, Social and Cultural Rights (adopted 16-12-1966, entered into force 3-1-1976) 993 UNTS 3 (ICESCR), Art. 11(1).\" href=\"#fn22\"><sup>22<\/sup><\/a> Additionally, India supported the United Nation General Assembly Resolutions (UNGA Resolution) 64\/292 which explicitly recognised the RTS in 2010<a id=\"fnref23\" title=\"23. UN General Assembly, The Human Right to Water and Sanitation, UN Doc. A\/RES\/64\/292 (28-7-2010).\" href=\"#fn23\"><sup>23<\/sup><\/a> and UNGA Resolution 70\/169 which recognised water and sanitation as distinct rights in 2015.<a id=\"fnref24\" title=\"24. UN General Assembly, The Human Rights to Safe Drinking Water and Sanitation, UN Doc. A\/RES\/70\/169 (17-12-2015).\" href=\"#fn24\"><sup>24<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Thus, failure to provide basic amenities pertaining to sanitation within the country&#8217;s justice delivery institution directly contravenes its international commitments. Note that the disparities between the global obligations and the lived reality within the judicial premises reflect a blind spot in infrastructure, accountability and governance.<\/p>\n<h2>Precedents that paved the way<\/h2>\n<p style=\"margin-bottom: 3%;\">Notably, <span style=\"font-style: italic;\">Rajeeb Kalita case<\/span><a id=\"fnref25\" title=\"25. 2025 SCC OnLine SC 81.\" href=\"#fn25\"><sup>25<\/sup><\/a> does not emerge in a legal vacuum. The judgment stands on the shoulders of various landmark judicial pronouncements that have progressively interpreted the right to life and dignity on various occasions and carved out a space for RTS. For instance, the SC in <span style=\"font-style: italic;\">Francis Coralie Mullin<\/span> v. <span style=\"font-style: italic;\">State (UT of Delhi)<\/span><a id=\"fnref26\" title=\"26. (1981) 1 SCC 608.\" href=\"#fn26\"><sup>26<\/sup><\/a> held that the right to life under Article 21 includes the right to live with human dignity. Similarly, in <span style=\"font-style: italic;\">Bandhua Mukti Morcha<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span><a id=\"fnref27\" title=\"27. (1984) 3 SCC 161.\" href=\"#fn27\"><sup>27<\/sup><\/a>, the SC linked degrading work conditions to violations of fundamental rights. Notably, in <span style=\"font-style: italic;\">Municipal Council, Ratlam<\/span> v. <span style=\"font-style: italic;\">Vardichan<\/span><a id=\"fnref28\" title=\"28. (1980) 4 SCC 162.\" href=\"#fn28\"><sup>28<\/sup><\/a> the SC compelled the municipality to provide sanitation facilities, recognising public sanitation as a component of environmental and public health rights. In <span style=\"font-style: italic;\">Virender Gaur<\/span> v. <span style=\"font-style: italic;\">State of Haryana<\/span><a id=\"fnref29\" title=\"29. (1995) 2 SCC 577.\" href=\"#fn29\"><sup>29<\/sup><\/a>, the SC acknowledged that a hygienic environment, inclusive of sanitation, is basic requirement to enjoy life and dignity.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, these judicial pronouncements laid the jurisprudential framework that allowed <span style=\"font-style: italic;\">Rajeeb Kalita case<\/span><a id=\"fnref30\" title=\"30. 2025 SCC OnLine SC 81.\" href=\"#fn30\"><sup>30<\/sup><\/a> to connect the dots between sanitation, dignity, environment and access to justice.<\/p>\n<h2>The judiciary&#8217;s directive: A blueprint for action<\/h2>\n<p>The SC in <span style=\"font-style: italic;\">Rajeeb Kalita case<\/span> underscored the nexus between the Court infrastructure and sanitation in the following words:<a id=\"fnref31\" title=\"31. 2025 SCC OnLine SC 81.\" href=\"#fn31\"><sup>31<\/sup><\/a><\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%;\"><span style=\"font-style: italic;\">10.2.<\/span> Courts should not be places, where basic needs, such as sanitation, are overlooked and neglected. The absence of adequate washroom facilities undermines equality and poses a barrier to the fair administration of justice.<\/p>\n<p>Accordingly, the Court issued concrete and actionable directions, which include:<a id=\"fnref32\" title=\"32. 2025 SCC OnLine SC 81.\" href=\"#fn32\"><sup>32<\/sup><\/a><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">a<\/span>) Ensuring separate and inclusive toilets for women, transgender persons, and PwDs by all the High Courts (HCs) and State Governments\/Union Territories (UTs) in India.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">b<\/span>) Monitoring the availability and accessibility of these facilities to everyone within the Court premises by the HCs in India.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">c<\/span>) Forming of a monitoring committee in all the HCs under the chairmanship of a Judge nominated by the Chief Justice and other members.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">d<\/span>) Formulation of a comprehensive plan of action to implement various tasks pertaining to sanitation, which includes ensuring regular maintenance of the toilets, ensuring functioning and stocked sanitary pad dispensers in women, PwD and transgender toilets.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">e<\/span>) Framing a complaint\/redressal mechanism for expeditious reporting of dysfunctional toilets and immediate renovation of the same, etc.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(<span style=\"font-style: italic;\">f<\/span>) Allocation of dedicated funds for toilet construction and maintenance by the State Governments\/UTs.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court redefined the significance of court premises not as an administrative afterthought, but as a core component of the justice delivery system.<\/p>\n<h2>Conclusion: Let space mirror the spirit of justice<\/h2>\n<p style=\"margin-bottom: 3%;\">The sanitation crisis in India&#8217;s court premises paints a stark picture of the structural indifference to the very people the system is meant to serve and ensure guarantee to their basic rights. It makes us question about our visibility and voice, makes us rethink: whose needs are legitimised in our public institutions!<\/p>\n<p style=\"margin-bottom: 3%;\">Let us not forget what <span style=\"font-style: italic;\">Rajeeb Kalita case<\/span><a id=\"fnref33\" title=\"33. 2025 SCC OnLine SC 81.\" href=\"#fn33\"><sup>33<\/sup><\/a> has crystallised: The path to equitable justice starts not just in legal arguments and verdicts, but in physical spaces that affirm the dignity of every individual who walks through the door of justice.<\/p>\n<\/div>\n<hr \/>\n<p style=\"margin-left: 18pt; text-indent: -18pt;\"><strong><span style=\"color: #000080;\">*Assistant Professor, School of Legal Studies and Governance, Vidyashilp University, Bengaluru.
