{"id":354412,"date":"2025-07-24T13:30:43","date_gmt":"2025-07-24T08:00:43","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=354412"},"modified":"2025-07-28T11:41:21","modified_gmt":"2025-07-28T06:11:21","slug":"chhattisgarh-hc-denies-bail-3-accused-in-2023-ied-blast-case","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/07\/24\/chhattisgarh-hc-denies-bail-3-accused-in-2023-ied-blast-case\/","title":{"rendered":"Chhattisgarh HC denies bail to three accused allegedly involved in 2023 IED Blast Case"},"content":{"rendered":"<style>\n.animate-charcter{background-image: linear-gradient(-225deg, #231557 0%, #44107a 29%, #ff1361 67%, #fff800 100%); background-size: 200% auto; -webkit-background-clip: text; -webkit-text-fill-color: transparent; animation: textclip 0s linear infinite;}<br \/>@keyframes textclip {to {background-position: 200% center;}}<br \/><\/style>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Chhattisgarh High Court:<\/span> In a criminal appeal filed against Trial Court\u2019s order rejecting the bail application filed by an accused in the 2023 IED Blast Case, the Division Bench of <span style=\"font-weight: bold;\">Ramesh Sinha<\/span>*, CJ., and Bibhu Datta Guru, J., dismissed the appeal, holding that the Trial Court\u2019s decision reflected a correct appreciation of facts, materials on record, and the law applicable to such cases.<\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">According to the prosecution, on 17-11-2023, at about 3:40 PM, after the conclusion of vote casting, an Indo Tibetan Border Police Constable (\u2018the deceased\u2019) was returning along with the security force. When they reached near Badegobra, there was an intentional bomb blast. As a result of the said bomb blast, the Constable sustained grievous injuries and subsequently died.<\/p>\n<p style=\"margin-bottom: 3%;\">Based on the said incident and complaint, a criminal case was registered against the accused persons, including the present accused persons, under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561407\" target=\"_blank\" rel=\"noopener\">147<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561408\" target=\"_blank\" rel=\"noopener\">148<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561409\" target=\"_blank\" rel=\"noopener\">149<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561607\" target=\"_blank\" rel=\"noopener\">302<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561614\" target=\"_blank\" rel=\"noopener\">307<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561375\" target=\"_blank\" rel=\"noopener\">120-B<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561376\" target=\"_blank\" rel=\"noopener\">121<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561377\" target=\"_blank\" rel=\"noopener\">121-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a>, Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001524689\" target=\"_blank\" rel=\"noopener\">4<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001524690\" target=\"_blank\" rel=\"noopener\">5<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001524691\" target=\"_blank\" rel=\"noopener\">6<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002927389\" target=\"_blank\" rel=\"noopener\">Explosive Substances Act, 1908<\/a>, Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001567304\" target=\"_blank\" rel=\"noopener\">25<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001567306\" target=\"_blank\" rel=\"noopener\">27<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002775593\" target=\"_blank\" rel=\"noopener\">Arms Act, 1959<\/a>, and Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554028\" target=\"_blank\" rel=\"noopener\">16<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554030\" target=\"_blank\" rel=\"noopener\">17<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554031\" target=\"_blank\" rel=\"noopener\">18<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554036\" target=\"_blank\" rel=\"noopener\">20<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554042\" target=\"_blank\" rel=\"noopener\">23<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554060\" target=\"_blank\" rel=\"noopener\">38<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554061\" target=\"_blank\" rel=\"noopener\">39<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554063\" target=\"_blank\" rel=\"noopener\">40<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002808781\" target=\"_blank\" rel=\"noopener\">Unlawful Activities (Prevention) Act, 1967<\/a> (\u2018UAPA\u2019).<\/p>\n<p style=\"margin-bottom: 3%;\">The appellant filed a bail application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804220\" target=\"_blank\" rel=\"noopener\">483<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">Bhartiya Nagarik Suraksha Sanhita, 2023<\/a> (\u2018BNSS\u2019) before the Trial Court, which was rejected by the impugned order due to no merit.<\/p>\n<h3>Analysis and Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">At the outset, the Court stated that a bare perusal of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554070\" target=\"_blank\" rel=\"noopener\">43D(5)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002808781\" target=\"_blank\" rel=\"noopener\">UAPA<\/a> revealed a specific statutory embargo on the grant of bail to an accused person charged under Chapters IV and VI, which relate to terrorist activities and terrorist organizations. The section mandates that unless the Court, upon perusal of the case diary or charge-sheet, is satisfied that there are no reasonable grounds to believe that the accusations are, <span style=\"font-style: italic;\">prima facie<\/span>, true, bail cannot be granted. Conversely, where there exist reasonable grounds to believe that the allegations are, <span style=\"font-style: italic;\">prima facie<\/span>, true, the bar under Section 43D(5) squarely applies, and the Court is prohibited from enlarging such accused on bail.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court stated that the legislative intent was clear, i.e., in cases involving terrorism-related offences, the threshold for bail was significantly higher than ordinary criminal cases. The safeguard to prevent misuse of this provision is built into the requirement that the Public Prosecutor must be given an opportunity to be heard. However, the Court stated that the Section does not create an absolute bar against bail in every circumstance.<\/p>\n<p style=\"margin-bottom: 3%;\">Upon a careful consideration of the contentions, charge-sheet and material collected during investigation, as well as the nature and gravity of the offences alleged against the accused persons, the Court held that the prosecution had placed sufficient material on record to prima facie establish their involvement in the larger conspiracy to carry out terrorist activities, including the IED blast which resulted in the death of a security personnel. The Court added that their association with the proscribed terrorist organization CPI (Maoist), their alleged role in providing logistics, materials, and other support essential for the execution of the offence, and participation in conspiracy meetings, was substantiated through statements of protected witnesses, recoveries made pursuant to their disclosures, and other documentary evidence.<\/p>\n<p style=\"margin-bottom: 3%;\">Given the statutory bar under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554070\" target=\"_blank\" rel=\"noopener\">43-D(5)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002808781\" target=\"_blank\" rel=\"noopener\">UAPA<\/a>, the Court stated that it could not lightly disregard the materials placed on record which, at this stage, established a prima facie case against the accused persons. The Court added that the Supreme Court had consistently held that when there is reasonable ground to believe that the accusation against the accused is prima facie true under UAPA, the Court shall not grant bail.<\/p>\n<p class=\"animate-charcter\" style=\"margin-left: 36pt; margin-bottom: 3%; text-align: center; font-weight: bold; font-style: italic;\">\u201cMere prolonged detention or socio-economic hardship cannot outweigh the serious and grave nature of allegations involving offences against national security.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court held that the impugned order reflected a correct appreciation of facts, materials on record, and the law applicable to such cases. The Court found no infirmity, perversity, or illegality in the said order warranting interference in appellate jurisdiction.<\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, the appeal was dismissed. However, the Court hoped and trusted that the Trial Court would make an earnest endeavour to conclude the trial expeditiously, preferably within 6 months.
