{"id":353858,"date":"2025-07-19T10:00:58","date_gmt":"2025-07-19T04:30:58","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=353858"},"modified":"2025-07-19T09:59:16","modified_gmt":"2025-07-19T04:29:16","slug":"cara-directs-all-states-implementation-of-counselling-in-adoption","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/07\/19\/cara-directs-all-states-implementation-of-counselling-in-adoption\/","title":{"rendered":"CARA directs States to implement counselling provisions at all stages of adoption"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 7-7-2025, the <span style=\"font-weight: bold;\">Central Adoption Resource Authority (\u2018CARA\u2019)<\/span> issued a memorandum for \u201cimplementation of Counselling Provisions under Adoption Regulation 2022\u201d directing all the <span style=\"font-weight: bold;\">State Adoption Resource Agencies (\u2018SARAs\u2019)<\/span> for effective implementation of counselling provisions at the pre- adoption, during adoption, and post adoption stages.<\/p>\n<p style=\"margin-bottom: 3%;\">CARA has stressed that <span style=\"font-weight: bold;\">counselling is not merely a regulatory formality, but a vital support mechanism that upholds the best interest of the child and contributes to the overall success and sustainability of adoptions<\/span>. The directions <span style=\"font-weight: bold;\">aim<\/span> at strengthening the psychological support framework for <span style=\"font-weight: bold;\">Prospective Adoptive Parents (\u2018PAPs\u2019)<\/span>, adopted children, and surrendering biological parents across all the States and Union Territories.<\/p>\n<p style=\"font-weight: bold;\">Key Directions given by Central Adoption Resource Authority to State Adoption Resource Agencies:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>Designate or empanel qualified counsellors at the district and state levels, preferably professionals with specialization in child psychology, social work, or mental health.<\/li>\n<li>Ensure delivery of mandatory pre-adoption counselling to prospective adoptive parents as an integral component of the Home Study Report process in accordance with <span style=\"font-weight: bold;\">Regulation 10(7)<\/span> of the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/F9Fy9m15\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">Adoption Regulations, 2022<\/span><\/a> which says:\n<p style=\"margin-left: 18pt; font-style: italic;\">\u201cThe Home Study Report of the prospective adoptive parents shall be prepared through the social worker of the selected Specialized Adoption Agency or the empaneled social worker of the District Child Protection Unit or the State Adoption Resource Agency who shall also be responsible for providing pre-adoption counselling to the prospective adoptive parents.\u201d.<\/p>\n<\/li>\n<li>Facilitate counselling for older children at the pre- adoption and during adoption stages, in alignment with <span style=\"font-weight: bold;\">Regulation 30(4)(c)<\/span> of the <span style=\"font-weight: bold;\">Adoption Regulations, 2022<\/span> which talks about the functions of <span style=\"font-weight: bold;\">Specialized Adoption Agencies<\/span>, relating to counselling of older children before and during adoption<\/li>\n<li>Provide post- adoption counselling in the following scenarios:\n<ol style=\"list-style-type: lower-alpha;\">\n<li>When adoptees initiate a root search- Regulation 30(4)(e);<\/li>\n<li>In cases of non- adjustment between the adoptee and adoptive family or any indication of potential disruption\/ dissolution- Regulations 14(4), 14(6)(b), and 21(6);<\/li>\n<li>Any other circumstance warranting psychosocial intervention, as determined by <span style=\"font-weight: bold;\">Specialized Adoption Agencies<\/span> or <span style=\"font-weight: bold;\">District Child Protection Unit.<\/span><\/li>\n<\/ol>\n<\/li>\n<li>Counsel surrendering biological parents on the implications of their decisions, including the legal finality of surrender after 60 days and the possibility of future root search by the child.<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Maintain detailed records of all counselling sessions and interventions and ensure timely documentation at the Specialized Adoption Agencies or District Child Protection Unit levels.<\/p>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p style=\"font-style: italic;\">The measures aim to safeguard the rights of children and ensure that every adoption
