{"id":353618,"date":"2025-07-17T09:00:29","date_gmt":"2025-07-17T03:30:29","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=353618"},"modified":"2025-07-21T10:05:32","modified_gmt":"2025-07-21T04:35:32","slug":"bom-hc-directs-amazon-delist-victorinox-products-sold-by-gute-reise","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/07\/17\/bom-hc-directs-amazon-delist-victorinox-products-sold-by-gute-reise\/","title":{"rendered":"Know why Bombay HC directed Amazon to delist Victorinox products sold by former dealer Gute Reise"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Bombay High Court:<\/span> The petitioner-Victorinox India (P) Ltd., filed a commercial arbitration petition seeking urgent relief against its former dealer Respondent 1-Gute Reise India (P) Ltd. for continuing to display and sell Victorinox branded products as being sold by Gute Reise, through Respondent 2-Amazon Seller Services (P) Ltd., despite an interim arbitral order dated 9-7-2025 restraining such sales. A Single Judge Bench of <span style=\"font-weight: bold;\">Somasekhar Sundaresan<\/span>, J., directed Amazon to immediately take down and delist all listings of Victorinox branded products being offered for sale by Gute Reise India (P) Ltd.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner highlighted that the said listings would remain active even during the Amazon Prime Day Sale, which was scheduled to open on 12-7-2025. The petitioner, thus, sought immediate delisting of the infringing items and suspension of the seller\u2019s account.<\/p>\n<p style=\"margin-bottom: 3%;\">Gute Reise submitted that it had informed Amazon of the arbitral order passed by the Arbitral Tribunal under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544917\" target=\"_blank\" rel=\"noopener\">17<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Arbitration and Conciliation Act, 1996<\/a> and had further asked it to refrain from selling any products from Gute Reise\u2019s account, including inventory lying at the fulfilment centres and the inventories already in the possession of Amazon.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that while Gute Reise had made efforts to comply with the interim order passed by informing Amazon, the listings continued to appear publicly. Given the urgency of the Prime Day sale and ongoing violation of the Arbitral Tribunal\u2019s order, the Court directed Amazon to immediately take down and delist all Victorinox branded products being offered by Gute Reise.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further clarified that Gute Reise was free to continue selling any products other than Victorinox\u2019s branded products through Amazon, and Amazon should not pose a hindrance to Gute Reise selling other products.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Victorinox India (P) Ltd. v.
