These Rules streamline governance, ensure transparency, and enable financial and legal accountability through a centralized portal and database. The provisions of these Rules came into effect from <span style=\"font-weight: bold;\">3-7-2025<\/span>.<\/p>\n<h3>Key Points on the Unified Waqf Rules 2025:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>These Rules were notified by the Government under its authority granted by Section <span style=\"font-weight: bold;\">108-B<\/span> of the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/ucys9wE5\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995<\/span><\/a>, newly incorporated through the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/iBfy3Bt2\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">Waqf (Amendment) Act, 2025<\/span><\/a>. Their central aim is to ensure all Waqf properties are digitally registered, monitored, and verified.<\/li>\n<li>A single nationwide <span style=\"font-weight: bold;\">digital platform<\/span> will be developed to carry out essential functions such as:\n<ul style=\"list-style-type: disc;\">\n<li>Filing Waqf details<\/li>\n<li>Registering new Waqfs<\/li>\n<li>Maintaining accounts and audit reports<\/li>\n<li>Publishing Board proceedings<\/li>\n<\/ul>\n<\/li>\n<li>The <span style=\"font-weight: bold;\">portal and database<\/span> will enable the Waqf Board and the mutawalli to prepare and maintain their respective books of account and other records on the <span style=\"font-weight: bold;\">portal and database<\/span> and State Government will appoint an officer at least of <span style=\"font-weight: bold;\">Joint Secretary<\/span> rank who will assist in the streamlining of details on <span style=\"font-weight: bold;\">portal<\/span>.<\/li>\n<li>Every Waqf and its associated property will be assigned a <span style=\"font-weight: bold;\">unique identification number<\/span>, ensuring consistent tracking and preventing duplication.<\/li>\n<li><span style=\"font-weight: bold;\">Rule 4<\/span> of the Rules lay down a real-time digital monitoring structure to oversee property registration, financial management, dispute resolution, and progress on development initiatives.<\/li>\n<li><span style=\"font-weight: bold;\">Every mutawalli<\/span> is required to register using their mobile and email through one-time password authentication. They are responsible for entering accurate details of each Waqf under their charge, all of which will be accessible to the <span style=\"font-weight: bold;\">Central Waqf Council<\/span>.<\/li>\n<li>The portal will be designed a way that it supports <span style=\"font-weight: bold;\">live tracking<\/span> of:\n<ul style=\"list-style-type: disc;\">\n<li>New Waqf registrations<\/li>\n<li>Property filings<\/li>\n<li>Institutional governance<\/li>\n<li>Legal disputes and resolutions<\/li>\n<li>Financial audits and resource management<\/li>\n<li>Surveys and development activities<\/li>\n<\/ul>\n<\/li>\n<li>A <span style=\"font-weight: bold;\">grievance redressal mechanism<\/span> will be built into the portal, to resolve complaints based on duplication or reviewing, which will be finally decided by the Joint Secretary.<\/li>\n<li>Each financial year, an independent body will assess the portal\u2019s functionality and submit a report within three months. The Central Government will publish both the review and <span style=\"font-weight: bold;\">Action Taken Report<\/span> in response on the <span style=\"font-weight: bold;\">portal<\/span> within an additional three-month window.<\/li>\n<li>If a property is wrongly declared as Waqf, the <span style=\"font-weight: bold;\">designated officer<\/span> will take up inquiry against it and submit a report within <span style=\"font-weight: bold;\">1 year<\/span> of reference by the <span style=\"font-weight: bold;\">Collector<\/span>.<\/li>\n<li>When the succession in a <span style=\"font-weight: bold;\">waqf-alal-aulad<\/span> fails, its income can be used for the maintenance of widows, divorced women, and orphans. All steps including applications and fund transfers are processed through the <span style=\"font-weight: bold;\">digital portal<\/span>.<\/li>\n<li>State Government as per the provisions of <span style=\"font-weight: bold;\">Rule 9<\/span>, will publish a list of auqaf in official gazette, and upload these on the <span style=\"font-weight: bold;\">portal and database<\/span> within <span style=\"font-weight: bold;\">90 days, which contains<\/span>:\n<ul style=\"list-style-type: disc;\">\n<li>Identification and boundaries of Waqf properties<\/li>\n<li>Usage and current occupier<\/li>\n<li>Creator details, creation mode and date<\/li>\n<li>Purpose of the Waqf<\/li>\n<li>Present mutawalli and management<\/li>\n<\/ul>\n<\/li>\n<li>A waqf created after the commencement of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002611532\" target=\"_blank\" rel=\"noopener\">Waqf (Amendment) Act, 2025<\/a> will be required to make an application to the <span style=\"font-weight: bold;\">Waqf Board<\/span> for its registration under Sec. 36 of the Act within three months of its creation and a mutawalli will upload the copies of land records of each immovable property of the waqf on the portal and database while registering.<\/li>\n<li>If someone other than the mutawalli initiates a registration request, the <span style=\"font-weight: bold;\">Waqf Board<\/span> will notify the mutawalli and offer an opportunity to respond before proceeding.<\/li>\n<li>These Rules set a maximum limit of <span style=\"font-weight: bold;\">\u20b91 crore<\/span> as the <span style=\"font-weight: bold;\">annual financial contribution<\/span> that can be collected by the Waqf Board under <span style=\"font-weight: bold;\">Sec. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001560288\" target=\"_blank\" rel=\"noopener\">72(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002835345\" target=\"_blank\" rel=\"noopener\">Waqf Act
