{"id":352460,"date":"2025-07-05T11:00:30","date_gmt":"2025-07-05T05:30:30","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=352460"},"modified":"2025-07-29T12:40:37","modified_gmt":"2025-07-29T07:10:37","slug":"draft-policy-guidelines-for-television-rating-agencies","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/07\/05\/draft-policy-guidelines-for-television-rating-agencies\/","title":{"rendered":"I&amp;B Ministry proposes amendments to Policy Guidelines for Television Rating Agencies; Seeks Public feedback"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 2-7-2025, the <span style=\"font-weight: bold;\">Ministry of Information and Broadcasting<\/span> issued draft amendments to amend the <span style=\"font-weight: bold;\">\u2018Policy Guidelines for Television Rating Agencies in India\u2019<\/span> which were notified in the year 2014.<\/p>\n<h3>Key Points of the draft amendment:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li><span style=\"font-weight: bold;\">Earlier<\/span>, the clause said that the company\u2019s Memorandum of Association should not include any activity like consultancy or any such advisory role, which will lead to a potential conflict of interest with its main objective of rating.The <span style=\"font-weight: bold;\">draft Amendment proposes<\/span> that the company, whatsoever, cannot undertake any activity like consultancy or any advisory role which can lead to potential conflict of interest with its main objective of rating.<\/li>\n<li>The clause that prevented any Board of Directors of the television rating company from being in any business of broadcasting\/ advertising\/ advertising agency has been deleted.<\/li>\n<li>The clause relating to the compliance with the following <span style=\"font-weight: bold;\">cross holdings requirement<\/span> has been omitted:\n<ul style=\"list-style-type: disc;\">\n<li>No single company\/ legal entity, through its associates or inter-connected undertakings, can have substantial equity holding in rating agencies and broadcasters\/ advertisers\/ advertising agencies;<\/li>\n<li>No single company\/ legal entity, through its associates or inter-connected undertakings, can have substantial equity holding in more than 1 rating agency operating in the same area;<\/li>\n<li>The restrictions will also apply to individual promoters;<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">A promoter company\/ member of the board of directors of the rating agency cannot have stakes in any broadcaster\/ advertiser\/advertising agency, directly or through its associates or interconnected undertakings.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h3>Need for a Modern system for Television Rating Agencies:<\/h3>\n<p style=\"margin-bottom: 3%;\">Television viewing habits in India have undergone a significant transformation in recent years. Audiences now consume content not only through cable and DTH platforms but also via smart TVs, mobile applications, and other online streaming platforms.
