{"id":352413,"date":"2025-07-04T16:30:59","date_gmt":"2025-07-04T11:00:59","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=352413"},"modified":"2025-07-04T17:31:11","modified_gmt":"2025-07-04T12:01:11","slug":"hazardous-waste-management-rules-epr-amendment-2025","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/07\/04\/hazardous-waste-management-rules-epr-amendment-2025\/","title":{"rendered":"Digital portal to drive Extended Producer Responsibility in Hazardous Waste Rules 2025"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 1-7-2025, the <span style=\"font-weight: bold;\">Ministry of Environment, Forest and Climate Change<\/span> notified <span style=\"font-weight: bold;\">Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2025<\/span> to ensure safe handling, generation, processing, treatment, package, storage, transportation, use reprocessing, collection, conversion, and offering for sale, destruction and disposal of Hazardous Waste. This will come into effect from 1-4-2026.<\/p>\n<h3>Key Points:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>To introduce provisions related to <span style=\"font-weight: bold;\">Extended Producer Responsibility (EPR) for Scrap of Non-Ferrous Metals<\/span>, Ministry has amended <span style=\"font-weight: bold;\">Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.<\/span><\/li>\n<li>For interpretation of the new rules, the scope and definition of <span style=\"font-weight: bold;\">extended producer responsibility<\/span> is introduced along with several other terms, such as-\n<ul style=\"list-style-type: disc;\">\n<li>environmentally sound management of scrap<\/li>\n<li>non-ferrous metals<\/li>\n<li>orphaned products<\/li>\n<li>standard operating procedure<\/li>\n<\/ul>\n<\/li>\n<li>The <span style=\"font-weight: bold;\">Central Pollution Control Board<\/span> (\u2018<span style=\"font-weight: bold;\">CPCB<\/span>\u2019) will manage the implementations of these rules though an <span style=\"font-weight: bold;\">\u2018online portal\u2019<\/span> registering the following-\n<ul style=\"list-style-type: disc;\">\n<li>manufacturer<\/li>\n<li>producer<\/li>\n<li>collection agent<\/li>\n<li>refurbisher<\/li>\n<li>recycler<\/li>\n<\/ul>\n<\/li>\n<li>Through these portals CPCB the registration and filing of half yearly and annual returns, fulfilling and transaction of EPR certificate and sharing of other relevant information.<\/li>\n<li>These entities will have to register on this portal and based on the capacity of scrap of non-ferrous metals generated, recycled refurbished or handled by these members, annual charges\/fees will be imposed on them by CPCB.<\/li>\n<li>The producers are mandated to meet annual recycling targets defined in <span style=\"font-weight: bold;\">Schedule-XI (EPR obligation of Producer)<\/span>. These targets can be fulfilled either by direct recycling or by purchasing EPR certificates from registered recyclers through the portal.<\/li>\n<li>Manufacturers are also required to incorporate minimum percentages of domestically recycled non-ferrous metals into their new products as specified in Schedule-XIII. Exemptions may be granted by CPCB in cases of statutory or technical limitations.<\/li>\n<li>Refurbishing of listed products made of non-ferrous metals is permitted and refurbishers will produce EPR certificate on portal which producers can use to defer their EPR obligations temporarily.<\/li>\n<li>As per <span style=\"font-weight: bold;\">Rule 60, CPCB<\/span> will be empowered to impose <span style=\"font-weight: bold;\">environmental compensation<\/span> on entities that fail to meet their EPR obligations or furnish false information. This penalty ensures accountability and reinforces compliance with the rules.<\/li>\n<li>A <span style=\"font-weight: bold;\">Steering Committee<\/span> has been constituted by the Government to oversee implementation, resolve disputes, update recycling targets, and recommend measures for improving compliance under these rules.<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Responsibilities have been assigned to State Governments, Municipalities, and Pollution Control Boards to support infrastructure development, worker welfare, public awareness, and enforce compliance with the rules at
