The Act has come into operation <span style=\"font-weight: bold;\">with retrospective effect from 1-6-2025<\/span>, introducing a modernized legal framework for the <span style=\"font-weight: bold;\">protection of new plant varieties<\/span>, granting breeders exclusive intellectual property rights over their innovations.<\/p>\n<h3>Background:<\/h3>\n<p style=\"margin-bottom: 3%;\">The <span style=\"font-weight: bold;\">Plant Breeders\u2019 Rights Act, 2018<\/span>, was enacted to replace South Africa\u2019s outdated 1976 law, which no longer met the needs of modern farming and plant science. It establishes a clear and modern legal system for recognizing and protecting the work of plant breeders.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Plant Breeders<\/span> are those individuals or organizations who develop new and improved varieties of plants through research, crossbreeding, and innovation. This Act aims to encourage <span style=\"font-weight: bold;\">agricultural advancement<\/span> by granting breeders <span style=\"font-weight: bold;\">exclusive rights<\/span> over plant varieties that are new, distinct, uniform, and stable. These rights help breeders gain recognition and economic return for their efforts, fostering investment in crop development and food security.<\/p>\n<p style=\"margin-bottom: 3%;\">In addition, the Act also aligns with the <span style=\"font-weight: bold; font-style: italic;\">UPOV Convention (1991)<\/span>, an international treaty that standardizes the protection of plant breeders\u2019 rights. This alignment strengthens the South Africa\u2019s legal framework and position in global agricultural innovation while safeguarding the interests of both breeders and farmers.<\/p>\n<h3>Key Points of Plant Breeders\u2019 Rights Act:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>This Act is designed to protect the <span style=\"font-weight: bold;\">intellectual property rights of plant breeders<\/span> by granting them exclusive rights to produce, reproduce, sell, export, import, and license the propagation material of their protected plant varieties.<\/li>\n<li>Plant Breeders can pursue <span style=\"font-weight: bold;\">prevention of unauthorized use<\/span> of those varieties by others. These rights apply for up to <span style=\"font-weight: bold;\">25 or 30 years<\/span>, depending on the type of plant, and which can be enforced through civil remedies in cases of infringement.<\/li>\n<li>The provisions apply to <span style=\"font-weight: bold;\">all plant genera and species<\/span>, offering legal protection for new, distinct, uniform, and stable plant varieties. It also outlines <span style=\"font-weight: bold;\">exceptions<\/span> and establishes the <span style=\"font-weight: bold;\">institutional mechanisms<\/span> for administration and dispute resolution.<\/li>\n<li>The regulations also clarify categories of farmers and crops and streamline administrative processes to reduce delays ensuring effective balancing of breeders\u2019 rights with public and agricultural interests.<\/li>\n<li>Plant breeders will now be able to give permission to others to use their protected plant varieties, like renting them out. In return, they can earn through <span style=\"font-weight: bold;\">royalty<\/span>, whenever those plants are sold or used for profit.<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">This Act amends the <span style=\"font-style: italic;\">Abolition of Restrictions on the Jurisdiction of Courts Act, 1996<\/span>, and repeals the <span style=\"font-style: italic;\">Plant Breeders\u2019 Rights Act, 1976<\/span>.<\/p>\n<\/li>\n<\/ol>\n<h3>Editor\u2019s Note:<\/h3>\n<p style=\"margin-bottom: 3%;\">While short title of the legislation <span style=\"font-style: italic;\">Plant Breeders\u2019 Rights Act, 2018<\/span>, refers to year 2016, this appears to reflect because of drafting or initial proposal date. Although, all the official government records, including the Government Gazette, refer to the legislation as the Act <span style=\"font-style: italic;\">2018<\/span>, which was notified in 2019.
