{"id":351667,"date":"2025-06-30T09:00:30","date_gmt":"2025-06-30T03:30:30","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=351667"},"modified":"2025-07-03T10:05:44","modified_gmt":"2025-07-03T04:35:44","slug":"rajasthan-high-court-temporary-bail-on-humanitarian-grounds-to-ndps-accused","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/06\/30\/rajasthan-high-court-temporary-bail-on-humanitarian-grounds-to-ndps-accused\/","title":{"rendered":"\u2018Object of criminal justice not merely punitive but reformative and humane\u2019; Rajasthan High Court grants bail to NDPS accused"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Rajasthan High Court:<\/span> In a bail application filed by the accused charged under the Narcotic Drugs and Psychotropic Substances (\u2018NDPS\u2019) Act, the Single Judge Bench of <span style=\"font-weight: bold;\">Farjand Ali, J<\/span>., noting that his wife was pregnant and was expected to deliver a child within a few days in absence of family to assist, granted temporary bail on humanitarian grounds for 60 days.<\/p>\n<p style=\"margin-bottom: 3%;\">Noting the seriousness of the allegations against the accused and the gravity of the offence under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002802179\" target=\"_blank\" rel=\"noopener\">NDPS Act<\/a> and the fact that there was sufficient prima facie material supporting the prosecution\u2019s case, the Court was not inclined to grant regular bail to the accused.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court, however, noted that the power to grant bail, whether regular or temporary, forms an integral part of the Court\u2019s discretionary jurisdiction, guided by the overarching considerations of justice, equity, and necessity. The Court was also mindful of the humanitarian dimensions of criminal jurisprudence.<\/p>\n<p style=\"margin-bottom: 3%;\">Referring to <span style=\"font-style: italic;\">Rakesh Kumar v. State of NCT of Delhi<\/span>, (2022) 5 SCC 533, and <span style=\"font-style: italic;\">Dadu v. State of Maharashtra<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/M4nz1YCP\" target=\"_blank\" rel=\"noopener\">(2000) 8 SCC 437<\/a>, the Court noted that <span style=\"font-style: italic;\"><span style=\"font-weight: bold;\">the courts while denying regular bail can grant temporary Bail for a limited period<\/span> <span style=\"font-weight: bold;\">where compelling personal, familial, or humanitarian grounds are established<\/span>.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Coming to the facts of the case, the Court noted that the pregnancy of the wife and the lack of availability of family assistance, by themselves, were not sufficient to warrant regular bail. However, they did constitute a reasonable basis to invoke the Court\u2019s discretion and permit the accused\u2019s temporary release to discharge familial obligations or attend personal exigencies. The Court further noted that <span style=\"font-weight: bold; font-style: italic;\">a balanced approach, one which upholds the legal sanctity of the custodial process while also accommodating legitimate personal concerns, was warranted. The objective of criminal justice was not merely punitive but reformative and humane<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court directed the accused to be released on temporary bail for 60 days. This release was conditioned upon furnishing a personal bond of Rs. 50,000 and two sound and solvent sureties of Rs. 25,000 each to the satisfaction of the Trial Court concerned.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Bhawani Pratap Singh v.
