Further, if any summons needs to be issued under the exceptions carved out in the proviso to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001801054\" target=\"_blank\">132<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001801166\" target=\"_blank\">BSA, 2023<\/a>, the same shall be issued only with the prior approval of the Director, ED.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">The mandate formalizes safeguards for the legal profession and prevents field offices from unilaterally summoning advocates, thereby shielding privileged communications and ensuring compliance with statutory protections.<\/p>\n<p style=\"margin-bottom: 3%;\">Section 132 of the Bharatiya Sakshya Adhiniyam (which replaced the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726934\" target=\"_blank\">Indian Evidence Act, 1872<\/a>) codifies the principle of advocate&#8212;client privilege.
