After 2 decades of legal practice, Justice Mithal entered the next stage of his legal journey when he was appointed as a Judge in the Allahabad High Court, and then as Chief Justice of the High Courts of Jammu &amp; Kashmir and Rajasthan.<\/p>\n<p class=\"ai-optimize-7\" style=\"margin-bottom: 2%; text-align: center; font-weight: bold; font-size: 16.0pt;\">Early Life and Education of Justice Pankaj Mithal<\/p>\n<p class=\"ai-optimize-8\" style=\"margin-bottom: 2%;\">Justice Pankaj Mithal was born on 17-06-1961, in Meerut, in a family of lawyers. He received his early education at St. Mary&#8217;s Academy, Meerut and graduated in B. Com (Honours) in 1982 from the University of Allahabad. Later joined Meerut College Meerut and obtained his law degree from Chaudhary Charan Singh University, Meerut in 1985<a id=\"fnref1\" title=\"1. Therefore, the refusal by the accused to marry her, under these circumstances, did not amount to criminal liability for abetment of suicide.<\/p>\n<p class=\"ai-optimize-35\" style=\"font-weight: bold;\">Accuracy of averment made in written statement must be decided by Trial Court on conclusion of evidence at time of suit\u2019s final determination: SC<\/p>\n<p class=\"ai-optimize-36\" style=\"margin-bottom: 3%;\">In <span style=\"font-style: italic;\">Ramchandra v. CBI, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Ngcrz50M\" target=\"_blank\" rel=\"noopener\">(2018) 16 SCC 299<\/a> had held that interim orders passed by High Courts for stay on trials in civil and criminal matters would expire automatically after 6 months, unless the same was expressly extended by the High Court. The same was reversed in the instant decision. Justice Abhay S. Oka wrote the majority judgment, which was concurred by Justice Pankaj Mithal through a separate judgment.<\/p>\n<p class=\"ai-optimize-42\" style=\"font-weight: bold;\">Inside Supreme Court verdict on easementary rights and powers of Appellate Court<\/p>\n<p class=\"ai-optimize-43\" style=\"margin-bottom: 3%;\">In <span style=\"font-style: italic;\">Manisha Mahendra Gala v. Shalini Bhagwan Avatramani<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/1K2o69XI\" target=\"_blank\" rel=\"noopener\">2024 SCC OnLine SC 530<\/a>, concerning <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/04\/17\/inside-supreme-court-verdict-on-easementary-rights-and-powers-of-appellate-court\/\" target=\"_blank\" rel=\"noopener\">easementary rights over a road situated over land<\/a>, which is presently owned by the respondents, the division bench of <span style=\"font-weight: bold;\">Pankaj Mithal*<\/span> and Prashant Kumar Mishra, JJ. held that the appellants have not acquired easementary right over the disputed \u2018rasta\u2019 in any manner much less by prescription, necessity or under an agreement. Sheil Properties (P) Ltd.<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/F6VHPcoO\" target=\"_blank\" rel=\"noopener\">2024 SCC OnLine SC 970<\/a>, concerning the issue about the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/06\/11\/can-termination-arbitration-proceedings-occur-failure-claimant-request-arbitral-tribunal-fix-date-for-hearing-sc-answers\/\" target=\"_blank\" rel=\"noopener\">legality and validity of the order of termination of the arbitral proceedings<\/a> under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544937\" target=\"_blank\" rel=\"noopener\">32(2)(c)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Arbitration and Conciliation Act, 1996<\/a> (\u2018the Arbitration Act\u2019) passed by the Arbitral Tribunal, the division bench of <span style=\"font-weight: bold;\">Abhay S. Oka*<\/span> and Pankaj Mithal, JJ. held the following:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li class=\"ai-optimize-52\">\n<p class=\"ai-optimize-53\">The power under Section 32 (2)(c) of the Arbitration Act can be exercised only if, for some reason, the continuation of proceedings has become unnecessary or impossible. Unless the Arbitral Tribunal records its satisfaction based on the material on record that proceedings have become unnecessary or impossible, the power under Section 32(2)(c) cannot be exercised.<\/p>\n<\/li>\n<li class=\"ai-optimize-54\">\n<p class=\"ai-optimize-55\">If the said power is exercised casually, it will defeat the very object of enacting the Arbitration Act. It is the Arbitral Tribunal\u2019s duty to fix a meeting for a hearing even if parties to the proceedings do not make such a request. It is the duty of the Arbitral Tribunal to adjudicate upon the dispute referred to it. If, on a date fixed for a meeting\/hearing, the parties remain absent without any reasonable cause, the Arbitral Tribunal can always take recourse to the relevant provisions of the Arbitration Act, such as Section 25.<\/p>\n<\/li>\n<li class=\"ai-optimize-56\">\n<p class=\"ai-optimize-57\">The failure of the claimant to request the Arbitral Tribunal to fix a date for hearing, per se, is no ground to conclude that the proceedings have become unnecessary. The abandonment of the claim by a claimant can be a ground to invoke Section 32(2)(c).<\/p>\n<\/li>\n<li class=\"ai-optimize-58\">\n<p class=\"ai-optimize-59\" style=\"margin-bottom: 3%;\">The abandonment of the claim can be either express or implied. The abandonment cannot be readily inferred. There is an implied abandonment when admitted or proved facts are so clinching that the only inference which can be drawn is of the abandonment. Only if the established conduct of a claimant is such that it leads only to one conclusion that the claimant has given up his\/her claim can an inference of abandonment be drawn. Even if it is to be implied, there must be convincing circumstances on record which lead to an inevitable inference about the abandonment. Only because a claimant, after filing his statement of claim, does not move the Arbitral Tribunal to fix a date for the hearing, the failure of the claimant, per se, will not amount to the abandonment of the claim.<\/p>\n<\/li>\n<\/ul>\n<p class=\"ai-optimize-60\" style=\"font-weight: bold;\">[Financial Debt v. Operational Debt] SC clarifies when a \u2018debt\u2019 is considered as financial debt and operational debt under IBC<\/p>\n<p class=\"ai-optimize-61\" style=\"margin-bottom: 3%;\">In the civil appeal titled <span style=\"font-style: italic;\">Global Credit Capital Ltd. v. Sach Marketing (P) Ltd.<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/wXUP1WpZ\" target=\"_blank\" rel=\"noopener\">2024 SCC OnLine SC 649<\/a>, against separate judgments and orders of the National Company Law Appellate Tribunal (\u2018the NCLAT\u2019), the Division Bench of Abhay S.
