{"id":350801,"date":"2025-06-17T15:00:47","date_gmt":"2025-06-17T09:30:47","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=350801"},"modified":"2025-06-24T09:35:49","modified_gmt":"2025-06-24T04:05:49","slug":"mp-high-court-directs-ngt-to-decide-culpability-before-fastening-liability-in-fire-incident-scc-times","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/06\/17\/mp-high-court-directs-ngt-to-decide-culpability-before-fastening-liability-in-fire-incident-scc-times\/","title":{"rendered":"\u201cIf guilty, basis must be disclosed; if not, litigation is futile\u201d; MP High Court directs NGT to decide culpability before fastening liability in fire incident"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Madhya Pradesh High Court:<\/span> In a writ petition challenging the National Green Tribunal\u2019s order (NGT) dated 29-05-2025, vide which NGT observed to consider the petitioner\u2019s plea for deletion of his name from the array of respondents at the final hearing and fastened liability upon him to pay interim compensation to the victims of the fire incident that occurred at the premises of Rajesh Fireworks, a Division Bench of <span style=\"font-weight: bold;\">Vivek Agarwal*<\/span> and Avanindra Kumar Singh, JJ., set aside the NGT\u2019s order and directed the NGT to hear and decide the plea regarding the petitioner\u2019s culpability and involvement in liability in fire incident on its own merits.<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, the NGT had taken suo motu cognizance of a fire incident that occurred at the premises of Rajesh Fireworks. Though the petitioner had no connection with the said establishment, the NGT fastened liability upon him to pay interim compensation to the victims of the incident, without affording him an opportunity of being heard.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner contended that he runs a separate and distinct business under the name \u2018Pradeep Fireworks\u2019 and had no relation with \u2018Rajesh Fireworks\u2019. The petitioner had filed an application before the NGT for deletion of his name from the array of respondents, but the NGT vide its impugned order deferred the decision on this issue to the time of final hearing.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that if the petitioner is indeed guilty, <span style=\"font-weight: bold;\">\u201cthen he should know that on what basis and material prima facie opinion is being formed about his guilt\u201d<\/span> and on the other hand, if he is not involved, <span style=\"font-weight: bold;\">\u201cthen unnecessarily dragging him in the litigation will not be of any use.\u201d<\/span> The Court acknowledged the prejudice that might be caused to the petitioner by delaying the decision on whether he should remain a party in the proceedings.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court set aside the NGT\u2019s order dated 29-05-2025 and directed the NGT to hear and decide the petitioner\u2019s plea for deletion of his name from the array of respondents, on its own merits and then decide liability in fire incident that occurred at the premises of Rajesh Fireworks. The Court further directed the entire exercise to be completed within 30 days from the date of receipt of the certified copy of this order.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court clarified that no observations made by the High Court would prejudice the NGT in deciding the application independently.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold;
