{"id":350380,"date":"2025-06-11T16:00:55","date_gmt":"2025-06-11T10:30:55","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=350380"},"modified":"2025-06-17T12:14:42","modified_gmt":"2025-06-17T06:44:42","slug":"gauhati-hc-partly-allows-anticipatory-bail-pleas-4-accused-minor-girls-rape-abduction-case","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/06\/11\/gauhati-hc-partly-allows-anticipatory-bail-pleas-4-accused-minor-girls-rape-abduction-case\/","title":{"rendered":"\u201cS. 482 of BNSS is pari materia with S. 438 of CrPC\u201d; Gauhati HC partly allows anticipatory bail pleas of four accused in minor girl\u2019s rape &amp; abduction case"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p class=\"ai-optimize-6 ai-optimize-introduction\" style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Guwahati High Court:<\/span> In a batch of anticipatory bail applications filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">Bharatiya Nagarik Suraksha Sanhita, 2023<\/a>(\u2018BNSS\u2019), for an FIR registered under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803749\" target=\"_blank\" rel=\"noopener\">61(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803475\" target=\"_blank\" rel=\"noopener\">137(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803660\" target=\"_blank\" rel=\"noopener\">303(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65(1)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803665\" target=\"_blank\" rel=\"noopener\">308(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">Bharatiya Nyaya Sanhita (\u2018BNS\u2019), 2023<\/a>, the Bench of Mridul Kumar Kalita, J., allowed three out of four applications, holding that though the custodial interrogation of the accused persons was not required, there was prima facie material against petitioner 1\/ main accused under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>. Further, the Court discussed the interpretation of the word \u201cand\u201d appearing in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a> rather than \u201cor\u201d appearing in the same place in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519739\" target=\"_blank\" rel=\"noopener\">438(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Code of Criminal Procedure, 1973<\/a> (\u2018CrPC\u2019).<\/p>\n<h3 class=\"ai-optimize-7\">Background<\/h3>\n<p class=\"ai-optimize-8\" style=\"margin-bottom: 3%;\">An FIR was lodged under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803749\" target=\"_blank\" rel=\"noopener\">61(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803475\" target=\"_blank\" rel=\"noopener\">137(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803660\" target=\"_blank\" rel=\"noopener\">303(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65(1)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803665\" target=\"_blank\" rel=\"noopener\">308(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a> alleging that on 26-11-2024, the accused persons herein had kidnapped the minor daughter of the informant. However, upon filing an FIR, the police recovered the informant\u2019s daughter and handed over her custody to the informant. The FIR also stated that accused 1 again kidnapped the daughter of the informant with the help of other accused persons. It was alleged that petitioner 1 also took an amount of Rs.1.5 Lakhs from the almirah. Further, he allegedly also committed sexual intercourse with the informant\u2019s daughter on the pretext of marrying her.<\/p>\n<p class=\"ai-optimize-9\" style=\"margin-bottom: 3%;\">Aggrieved, an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a> was filed by four accused apprehending their arrest.<\/p>\n<p class=\"ai-optimize-10\" style=\"margin-bottom: 3%;\">The Amicus Curiae contended that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a> was similar to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519739\" target=\"_blank\" rel=\"noopener\">438<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, with a notable difference in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482(4)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS, 2023<\/a>, where the conjunction \u201cand\u201d is used. Instead of \u201cor\u201d. He contended that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a> was <span style=\"font-style: italic;\">pari materia<\/span> with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519739\" target=\"_blank\" rel=\"noopener\">438<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> except of the use of the conjunction \u201cand\u201d in the new provision instead of \u201cor\u201d used in the old provision. Hence, if a literal interpretation was given to the conjunction \u201cand\u201d in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a>, it would mean that only if a person has committed both the offences under Section 65 and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803759\" target=\"_blank\" rel=\"noopener\">70(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>, he may not be entitled to anticipatory bail. This could lead to unnecessary complications, particularly regarding offenses under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803759\" target=\"_blank\" rel=\"noopener\">70(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>, which encompasses offenses previously mentioned under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002906159\" target=\"_blank\" rel=\"noopener\">376-DA<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002906160\" target=\"_blank\" rel=\"noopener\">376-DB<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (\u2018IPC\u2019); whereas, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a> covers both the offences under Sections 376(3) and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002906158\" target=\"_blank\" rel=\"noopener\">376-AB<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. Thus, he contended that a purposive interpretation had to be given instead of a literal interpretation to the word \u201cand\u201d used in Section 482(4) of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>.<\/p>\n<h3 class=\"ai-optimize-11\">Analysis and Decision<\/h3>\n<p class=\"ai-optimize-12\" style=\"font-weight: bold;\">1. Maintainability of anticipatory bail application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a><\/p>\n<p class=\"ai-optimize-13\" style=\"margin-bottom: 3%;\">The Court found the contentions of the amicus curie regarding the interpretation of Section 482(4) were acceptable and plausible considering his logic and reasonableness and noted that the provision contained in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS, 2023<\/a> was <span style=\"font-style: italic;\">pari materia<\/span> with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519739\" target=\"_blank\" rel=\"noopener\">438<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>. <span style=\"font-style: italic; font-weight: bold;\">There is nothing in the statement of objects and reasons of enacting BNSS to suggest that the legislature intended to give a restricted operation in respect of the exclusion clause contained in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a> then that of the clause which was there in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519739\" target=\"_blank\" rel=\"noopener\">438(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>.<\/span><\/p>\n<p class=\"ai-optimize-14\" style=\"margin-bottom: 3%;\">The Court stated that the word \u201cand\u201d in Section 482(4) should be read as \u201cor\u201d to give effect to the legislature\u2019s intention regarding anticipatory bail provisions as literal meaning would frustrate the legislative intent.<\/p>\n<p class=\"ai-optimize-15\" style=\"margin-bottom: 3%;\">Upon perusal of Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803759\" target=\"_blank\" rel=\"noopener\">70(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>, the Court observed that it was unlikely that a person would be charged both under Section 65 as well as under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803759\" target=\"_blank\" rel=\"noopener\">70(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>. If there is a single offender and the victim is less than 16 years of age, he would be charged under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a> whereas if there are one or more women who are raped by one or more men in a group who are acting in furtherance of their common intention of raping the minor girl, they would be charged under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803759\" target=\"_blank\" rel=\"noopener\">70(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>. Thus, the Court held that giving a literal meaning to the word \u201cand\u201d and insisting that the bar of Section 482(4) would be applicable only if the accused was being charged with both the sections, would make the bar redundant.<\/p>\n<p class=\"ai-optimize-16\" style=\"margin-bottom: 3%;\">Thus, the Court held that the embargo of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a> would apply to any case involving the arrest of any person on an accusation of having committed an offense under Section 65 or Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803759\" target=\"_blank\" rel=\"noopener\">70(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>.<\/p>\n<p class=\"ai-optimize-17\" style=\"font-weight: bold;\">2. Discrepancy in birth dates mentioned in two different documents<\/p>\n<p class=\"ai-optimize-18\" style=\"margin-bottom: 3%;\">The Court noted that in the present case, the informant stated that his daughter was a minor as her date of birth was 07-11-2010 and this was supported by the victim\u2019s birth certificate. Whereas, according to the transfer\/school leaving certificate mentions the date of birth as 07-11-2006.<\/p>\n<p class=\"ai-optimize-19\" style=\"margin-bottom: 3%;\">The Court held in the cases when two documents are shown with different dates of birth namely, the birth certificate issued by the Registrar of Birth and Death and the one issued by the Warden-cum-teacher\/Head Teacher of the school, the certificate issued by Registrar of Birth and Death would be more acceptable and reliable compared to the birth certificate issued by the school authority as it has a statutory recognition under the provisions of the Registration of Birth and Death Act, 1969.<\/p>\n<p class=\"ai-optimize-20\" style=\"margin-bottom: 3%;\">Despite noting that the victim stated that she willingly went to the petitioner 1, stayed as his wife and maintained a physical relationship, the Court held that since the girl was a minor at the time of the offence, the said act would be considered rape under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803751\" target=\"_blank\" rel=\"noopener\">63(vi)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>, read with Exception 2 of proviso to the Explanation 2 of Section 63.<\/p>\n<p class=\"ai-optimize-21\" style=\"margin-bottom: 3%;\">Considering the date of birth mentioned in the birth certificate, the Court noted that the victim was less than 16 years old at the time of the offence. Hence, the Court held that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a> would be, prima facie, applicable in this case and the bar provided under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804219\" target=\"_blank\" rel=\"noopener\">482(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a> would also be applicable.<\/p>\n<p class=\"ai-optimize-22\" style=\"margin-bottom: 3%;\">Furthermore, considering the progress made in the investigation and the statement recorded by the victim under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803887\" target=\"_blank\" rel=\"noopener\">183<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">BNSS<\/a>, the Court found that custodial interrogation of petitioners 2, 3, and 4 was not necessary for the completion of the investigation. Accordingly, anticipatory bail was granted to them subject to certain conditions.<\/p>\n<p class=\"ai-optimize-23\" style=\"margin-bottom: 3%;\">However, the Court stated that it appeared that though custodial interrogation of petitioner 1 was not necessary, there were prima facie materials against him under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803753\" target=\"_blank\" rel=\"noopener\">65(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">BNS<\/a>. Hence, the Court rejected his anticipatory bail application.<\/p>\n<p class=\"ai-optimize-24\" style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Nazir Hussain v. State of Assam, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/FKwr27Dm\" target=\"_blank\" rel=\"noopener\">2025 SCC OnLine Gau 2971<\/a>, decided on 02-06-2025<\/span>]<\/p>\n<hr \/>\n<p class=\"ai-optimize-25\">Advocates who appeared in this case :<\/p>\n<p class=\"ai-optimize-26\" style=\"margin-left: 18pt;\"><span style=\"font-weight: bold;\">For the applicants:<\/span> AFNU Mollah, R Amin, and K Zaman<\/p>\n<p class=\"ai-optimize-27\" style=\"margin-left: 18pt;\"><span style=\"font-weight: bold;\">For the respondent:<\/span> Public Prosecutor of Assam R. R.
