The FIR stemmed from a protest by farmers concerning the shifting of a traditional water distribution meeting related to Jawai Dam.<\/p>\n<p style=\"margin-bottom: 3%;\">Historically, the meeting was held at Dam Inspection Bhawan, Sumerpur, a place accessible and symbolically significant to farmers. However, in deviation from practice, the meeting was shifted to a different venue in 2022, which provoked apprehensions among the farming community of being sidelined.<\/p>\n<p style=\"margin-bottom: 3%;\">On 09-10-2022, approximately 700\u2014800 farmers gathered near NH-62 to protest peacefully. The police, acting on administrative instructions, allegedly attempted to disperse the protesters.<\/p>\n<h3>Moot Points<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>Whether a peaceful protest by farmers on a public highway constitutes unlawful assembly or abetment under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>?<\/li>\n<li>Whether such a gathering, in the absence of violence or damage, attracts Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001563992\" target=\"_blank\" rel=\"noopener\">8B<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002948253\" target=\"_blank\" rel=\"noopener\">NH Act<\/a>?<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Whether the FIR and proceedings arising therefrom are liable to be quashed under the Court\u2019s inherent powers under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> (CrPC)?<\/p>\n<\/li>\n<\/ol>\n<h3>Court\u2019s Observations<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court observed that there was no evidence of violence, chaos, or public disorder at the protest. The Court noted that the FIR did not allege specific acts of mischief or injury to public property.<\/p>\n<p style=\"margin-bottom: 3%;\">On Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561369\" target=\"_blank\" rel=\"noopener\">117<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, the Court held that <span style=\"font-weight: bold;\">\u201c&#8230;the very nature of abetment vests in an act preceding the offence&#8230; Here in this case, the farmers were already perturbed&#8230; and nobody called them there&#8230;\u201d<\/span> Regarding unlawful assembly under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561403\" target=\"_blank\" rel=\"noopener\">143<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, the Court stressed that there exists constitutional right to assemble peacefully under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574926\" target=\"_blank\" rel=\"noopener\">19(1)(b)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution of India<\/a>.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201c&#8230;not every assembly can be deemed an unlawful assembly&#8230; mere expression of anguish&#8230; cannot be taken to mean that they share a common objective or have formed an unlawful assembly\u2026 Each individual faces their own hardship\u2026 mere expression of anguish in such circumstances cannot be taken to mean that they share a common objective or have formed an unlawful assembly.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">On obstruction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561582\" target=\"_blank\" rel=\"noopener\">283<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, the Court asserted that <span style=\"font-weight: bold;\">\u201c&#8230;if people gather somewhere to assert their rights, the way will be blocked automatically&#8230; this does not mean they caused harm to anyone.\u201d<\/span> Further, for Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001563992\" target=\"_blank\" rel=\"noopener\">8-B<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002948253\" target=\"_blank\" rel=\"noopener\">NH Act<\/a>, the Court stated that <span style=\"font-weight: bold;\">\u201c&#8230;there is no allegation or indication of any mishap or damage caused to the highway&#8230; their wrath and resentment&#8230; is natural.\u201d<\/span> The Court held that the ingredients for Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561667\" target=\"_blank\" rel=\"noopener\">353<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> and Section 8B NH Act are not fulfilled as there was no use of force or criminal act committed by the farmers during the protest.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the farmers\u2019 protest against Jawai Dam water distribution arose from genuine resentment and constituted an expression of democratic dissent. The Court reaffirmed the principle that peaceful dissent and constitutional right to peaceful protest is a cornerstone of democracy <span style=\"font-weight: bold;\">\u201cof the people, by the people, and for the people,\u201d<\/span> and held that mere participation in such a protest does not amount to committing offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561369\" target=\"_blank\" rel=\"noopener\">117<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561403\" target=\"_blank\" rel=\"noopener\">143<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561582\" target=\"_blank\" rel=\"noopener\">283<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561667\" target=\"_blank\" rel=\"noopener\">353<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, or Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001563992\" target=\"_blank\" rel=\"noopener\">8B<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002948253\" target=\"_blank\" rel=\"noopener\">NH Act<\/a>.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cPreventing citizens from holding a peaceful protest through force or coercion cannot be justified&#8230; If simply opposing an officer\u2019s decision results in the registration of a criminal case, it would reflect a mindset reminiscent of British colonial rule but surely not the spirit of a free, democratic nation governed by the rule of law\u201d<\/p>\n<h3>Court\u2019s Decision on Farmers\u2019 protest against Jawai Dam water distribution<\/h3>\n<p style=\"margin-bottom: 3%;\">Invoking its inherent powers under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, and relying on <span style=\"font-style: italic;\">State of Haryana<\/span> v. <span style=\"font-style: italic;\">Bhajan Lal<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/PrBF91ZF\" target=\"_blank\" rel=\"noopener\">1992 Supp (1) SCC 335<\/a>, the Court quashed the FIR and all consequential proceedings and stated that<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cIn a democracy, of the people, by the people, and for the people, peaceful protest is a constitutional right.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">The Court directed the concerned SHO to submit a negative final report before the trial court.
