He warmly welcomes everyone and sets the tone for the proceedings.<\/p>\n<p style=\"margin-bottom: 3%;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-349994 \" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/06\/photo_6203885693214771805_y-e1749209394315.jpg\" alt=\"\" width=\"284\" height=\"459\" srcset=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/06\/photo_6203885693214771805_y-e1749209394315.jpg 630w, https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/06\/photo_6203885693214771805_y-e1749209394315-186x300.jpg 186w, https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/06\/photo_6203885693214771805_y-e1749209394315-37x60.jpg 37w\" sizes=\"auto, (max-width: 284px) 100vw, 284px\" \/><\/p>\n<p style=\"margin-bottom: 3%;\">Justice Nath highlights India\u2019s evolving arbitration model as a source of global relevance.<\/p>\n<p style=\"margin-bottom: 3%;\">He notes that, <span style=\"font-style: italic;\">\u201cAs judiciaries across the globe recalibrate their engagement with international arbitration, discussion on such multifaceted topic gives us scope to discuss viewpoints of all the stakeholders in arbitration\u2014parties, the arbitrators, the institutions and the courts.\u201d<\/span><\/p>\n<p style=\"margin-bottom: 2%;\">Justice Nath goes on to offer a uniquely Indian perspective, while underlining its increasing global resonance:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cAs we reflect on the evolving standards across jurisdiction, I would like to offer perspective that is uniquely Indian but increasingly global in its relevance.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 2%;\">He traces India\u2019s arbitration trajectory as both evolutionary and revolutionary\u2014driven not just by legislation, but by judicial will:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cIndia\u2019s arbitration landscape\u2014whether evolution or revolution\u2014is shaped not only by legislation but by outreach to emulate, particularly in regions where courts continue to fail. Revolution shaped not only by the legislation, but by the judiciary\u2019s conscious effort to transform India into credible, effective and respected arbitration jurisdiction.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 3%;\">He asserts that, <i><span style=\"font-weight: bold;\">\u201cWhat is emerging in India today is a model of judicial discipline, institutional empowerment, and doctrinal clarity that I believe other jurisdictions, especially those in transition or reform, may draw upon.\u201d<\/span><\/i><\/p>\n<p style=\"margin-bottom: 3%;\"><i><span style=\"font-weight: bold;\">\u201cIndia is directed by the reformed, peopleistic and international arbitration deviation from glance at all Model Law. By this unified approach and forced interpretive challenges also provides evidently for developing poor individual schools across jurisdictional boundaries, as countries consider domesticating arbitration law, creative hybrid models.\u201d<\/span><\/i>, He notes<\/p>\n<p style=\"margin-bottom: 3%;\">\u201c<em><strong>India&#8217;s courts have historically been viewed with scepticism when it came to arbitration, known for frequent interference and expansive readings of \u2018public policy.\u2019 However, the last decade has seen a marked departure from this trend<\/strong><\/em>,\u201d states Justice Nath.<\/p>\n<p style=\"margin-bottom: 3%;\">He references transformative Supreme Court decisions \u2014 <em data-start=\"829\" data-end=\"836\">Bharat Aluminium Co. v. Kaiser Aluminium Technical Services Inc., (2016) 4 SCC 126<\/em>, <em>Perkins Eastman Architects DPC<\/em> v. <em>HSCC (India) Ltd<\/em>., (2020) 20 SCC 760, and <em>Yograj Infrastructure Ltd.<\/em> v. <em>Ssangyong Engg. &amp; Construction Co. Ltd<\/em>., (2012) 12 SCC 359,\u00a0\u2014 as key indicators of this judicial evolution, emphasising the growing commitment to finality and minimal intervention.<\/p>\n<p style=\"margin-bottom: 1%;\">Justice Nath remarks:<\/p>\n<blockquote data-start=\"1067\" data-end=\"1198\">\n<p style=\"margin-bottom: 3%; text-align: center;\" data-start=\"1069\" data-end=\"1198\"><strong><em>\u201cOne of India&#8217;s most significant contributions to global arbitration jurisprudence lies in its robust defence of party autonomy.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 1%;\">He cites the Supreme Court\u2019s ruling in <em>Amazon.Com NV Investment Holdings LLC<\/em> v. <em>Future Retail Ltd<\/em>., (2022) 1 SCC 209\u00a0as a defining moment:<\/p>\n<blockquote data-start=\"1295\" data-end=\"1542\">\n<p style=\"text-align: center; margin-bottom: 3%;\" data-start=\"1297\" data-end=\"1542\">\u201cDespite the absence of express statutory recognition of emergency arbitrators in Indian law, the Supreme Court held that once parties had agreed to the SIAC Rules which permit emergency arbitration the court was bound to honour that framework.\u201d<\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 3%;\">Underlining the broader global implications of this approach, he remarks:<\/p>\n<blockquote data-start=\"1610\" data-end=\"1833\">\n<p style=\"margin-bottom: 3%; text-align: center;\" data-start=\"1612\" data-end=\"1833\">\u201cThis judgment should resonate globally. It affirms that party choice is not just procedural it is binding, and institutions or jurisdictions that sidestep that choice risk undermining the very foundation of arbitration.\u201d<\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 1%;\">He also added that:<\/p>\n<blockquote data-start=\"1928\" data-end=\"2137\">\n<p style=\"margin-bottom: 3%; text-align: center;\" data-start=\"1930\" data-end=\"2137\">\u201cCountries seeking to strengthen trust in their arbitration regimes may take note: judicial fidelity to contractual intent can foster certainty and investor confidence more effectively than rigid formalism.\u201d<\/p>\n<\/blockquote>\n<p><span data-contrast=\"auto\">On the question as to where India has now landed and whether it&#8217;s in the right place about balancing arbitral autonomy and judicial oversight, <\/span><b><span data-contrast=\"auto\">Prashanto <\/span><\/b><span data-contrast=\"auto\">responds:<\/span><\/p>\n<p><span data-contrast=\"auto\"> \u201cNo, I think it&#8217;s always a work in progress. There has to be fine-tuning always going on.\u201d<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\">He draws a comparative lens with the UK:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span data-contrast=\"auto\"> \u201cAs far as&#8230; and it was in comparison with UK, which we were looking at also, which has a very hands-off, strict hands-off approach. But if you look at it, both are rooted in a tradition where the judiciary or the courts which are going to look at it \u2014 look at it from the point of view as agents of the state to enforce fence in arbitral proceedings at some level while maintaining party autonomy.\u201d<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-350095\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2025\/06\/prash.jpg\" alt=\"\" width=\"316\" height=\"421\" \/><\/p>\n<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\">Commenting on <strong>India\u2019s evolving jurisprudence<\/strong>, he notes:<\/span><br \/>\n<span data-contrast=\"auto\">If you look at the Indian scenario, it has been a substitutist group. We started with what is called the <\/span><i><span data-contrast=\"auto\">Renusagar Power Co. Ltd.<\/span><\/i><span data-contrast=\"auto\"> v. <\/span><i><span data-contrast=\"auto\">General Electric Co.<\/span><\/i><span data-contrast=\"auto\">, 1994 Supp (1) SCC 644<\/span><i><span data-contrast=\"auto\">\u00a0judgment in 1940, which was dealing with enforcement of awards.<\/span><\/i>\u00a0<span data-contrast=\"auto\">Which took a very narrow view of public policy, much narrower than any other. Saying that it&#8217;s only on those grounds like if there is a shocking of judicial conscience or something against the interests of India \u2014 that kind of a ground.<\/span><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p><span data-contrast=\"auto\">He explains the arc of judicial interpretation over the years:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\"> Then we had the widening of challenge under public policy, which was <\/span><i><span data-contrast=\"auto\">ONGC Ltd.<\/span><\/i><span data-contrast=\"auto\"> v. <\/span><i><span data-contrast=\"auto\">Saw Pipes Ltd<\/span><\/i><span data-contrast=\"auto\">., (2003) 5 SCC 705<\/span><i><span data-contrast=\"auto\">\u00a0and other judgments like that. Now<\/span><\/i><span data-contrast=\"auto\">, there is a legislative amendment which has taken place which has clarified the scope of interference of courts \u2014 and it has come back to the <\/span><i><span data-contrast=\"auto\">Renu Sagar<\/span><\/i><span data-contrast=\"auto\"> test, both for international and domestic awards.<\/span><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p><span data-contrast=\"auto\">Highlighting a critical legislative shift, he adds:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\"> They have pointed out in <\/span><i><span data-contrast=\"auto\">Renu Sagar<\/span><\/i><span data-contrast=\"auto\"> that the &#8216;interests of India&#8217; has been taken out and therefore, public policy\u00a0cannot mean re-looking at the award. Judiciary has supported that interpretation and has taken it forward.<\/span><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p><span data-contrast=\"auto\">Drawing parallels with developments in England, he remarks:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\"> Interestingly, it\u2019s work in progress in England too. There is of course the <\/span><i><span data-contrast=\"auto\">Federal Republic of Nigeria<\/span><\/i><span data-contrast=\"auto\"> v. <\/span><i><span data-contrast=\"auto\">Process &amp; Industrial Developments Ltd<\/span><\/i><span data-contrast=\"auto\">., [2023] EWHC 2638\u00a0judgment, which was a very egregious case of fraud. I think Justice Nath spoke about it in another session \u2014 six billion award and then eleven billion coming down to it.\u201d<\/span><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p><span data-contrast=\"auto\">He concludes with a note of comparative balance, that both in UK and India are on the same page as far as the philosophy of interference is concerned. But I think there are scopes for changes which take place depending on the cases coming up.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"margin-bottom: 3%;\"><b><span data-contrast=\"auto\">Kevin Nash<\/span><\/b>, <span data-contrast=\"auto\">opens on a warm note, saying<\/span>, &#8220;<span data-contrast=\"auto\">I think what is always<\/span> <i><span data-contrast=\"auto\">appropriate to do is to welcome everyone to London&#8221;<\/span><\/i>.<\/p>\n<p style=\"margin-bottom: 1%;\">He uses the occasion to announce a significant development:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i><span data-contrast=\"auto\">\u201cAnd maybe also a very good time to announce LCIA\u2019s return to India. Of course, we have Sharina on our board of directors, so we\u2019re very much talking about what LCIA can do in India.\u201d<\/span><\/i><\/strong><\/p>\n<p style=\"margin-bottom: 3%;\">He adds, <i><span data-contrast=\"auto\">\u201cOne of our counsel, also from India. And I\u2019ve been going to India for a long time.\u201d<\/span><\/i><\/p>\n<p style=\"margin-bottom: 1%;\">Nash then reflects on a series of high-profile emergency arbitration cases that have brought global attention to the process:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cIn terms of war stories, I\u2019m very proud of the quartet, or quintet\u2014depending on how you look at it\u2014of emergency arbitration decisions that have really captured the attention of the globe. So we started in HSBC, then we had Raffles Design, and then finally, Amazon\u2013Future Retail, where, of course, we were charged with appointing the arbitrator.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 1%;\">Noting its broader impact, he says:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i><span data-contrast=\"auto\">\u201cIt was one of the only times that my parents have ever seen something to do with what my job is, because it was covered by CNN North America, and I think has really helped popularise emergency arbitration in North America.\u201d<\/span><\/i><\/strong><\/p>\n<p style=\"margin-bottom: 3%;\">He adds, <i>\u201cIn Singapore, London, emergency arbitration is very well known. So that was a huge seminal decision. We talked about it in the central working group too, and I think it looked really good for India.\u201d<\/i><\/p>\n<p style=\"margin-bottom: 1%;\">On India\u2019s evolving legislative landscape, Nash remarks:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cI\u2019m so happy to see giving statutory footing to emergency arbitrators and the proposed amendments to the Arbitration and Conciliation Act, 1996 because I\u2019ve seen how that can work. We saw it in Singapore.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 3%;\">Elaborating further, he recalls, <span data-contrast=\"auto\">in Singapore, SIAC introduced the emergency arbitrator provisions in 2010<\/span>.<\/p>\n<p style=\"margin-bottom: 1%;\">He reflects on personal sacrifices made in the line of duty:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cI spent 14 Chinese New Years in Singapore. I don\u2019t think I ever was properly able to celebrate, because on the eve of Chinese New Years, always an application for the appointment of an emergency arbitrator.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 1%;\">On the strategic value of emergency arbitration, Nash observes:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cIt really pushes the other side and all of a sudden they\u2019re very much involved in an arbitration.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 1%;\">He adds a practical insight:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cOne interesting component that we don\u2019t talk about enough in relation to emergency arbitration is the increased settlements after an emergency arbitration. I think this is fundamentally important.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 1%;\">Having transitioned to LCIA after a long tenure at SIAC, Nash reflects on the perceived distinction between institutional styles:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cYou have institutions like SIAC and ICC that are more structured administration\u2026 it\u2019s thought that LCIA and HKIAC are more light touch.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 1%;\">But Nash is quick to qualify that description:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cI went around the LCIA offices banning the use of the word \u2018light touch\u2019 because it\u2019s more\u2014it\u2019s flexible administration.\u201d<\/i><\/strong><\/p>\n<p style=\"margin-bottom: 1%;\">He explains that the flexibility <span data-contrast=\"none\">doesn&#8217;t compromise scrutiny:<\/span><\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cWe\u2019re reading the awards just like they\u2019re being read at SIAC or LCIA\u2026 and there\u2019s a lot that goes into deciding whether or not an arbitrator is up to the task.\u201d<\/i><\/strong><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">Crucially, he questions how newer institutions can meaningfully assess arbitrator competence without deep institutional exposure:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cIf you were not reading the award, I don\u2019t know if you would really decide. I wonder how institutions that are just looking from a distance can decide whether or not this was run properly.\u201d<\/i><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span class=\"TextRun SCXW148568069 BCX0\" lang=\"EN-IN\" xml:lang=\"EN-IN\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW148568069 BCX0\">Nash also offers a cultural perspective on arbitrator appointments, emphasising how critical it is to account for local business customs. He explains, I always use the example of the business culture in Singapore and Malaysia of oral variations in a contract and if you appointed someone that was not fluent or au <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW148568069 BCX0\">fait<\/span><span class=\"NormalTextRun SCXW148568069 BCX0\"> in that culture of doing business\u2014if you appointed an English, say that had never been down to the peninsula\u2014that arbitrator may think that the witness is <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW148568069 BCX0\">dishonest<\/span><span class=\"NormalTextRun SCXW148568069 BCX0\"> and this could <\/span><span class=\"NormalTextRun AdvancedProofingIssueV2Themed SCXW148568069 BCX0\">actually turn<\/span><span class=\"NormalTextRun SCXW148568069 BCX0\"> the case.<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p>&nbsp;<\/p>\n<p style=\"margin-bottom: 1%;\">For Nash, ideal arbitrators are those who are:<\/p>\n<ul>\n<li><b>Efficient<\/b><\/li>\n<li><b>Fair<\/b><\/li>\n<li><b>Procedurally sound<\/b><\/li>\n<li><b>Able to interface effectively with the institution<\/b><\/li>\n<\/ul>\n<p style=\"margin-bottom: 1%;\">He emphasizes the subtle power of institutional scrutiny:<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cThe best form of scrutiny is when you&#8217;re in a conversation with the arbitrator\u2026 all of the rules on scrutiny use that very important language\u2014they draw the tribunal\u2019s attention to points of substance.\u201d<\/i><\/strong><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 1%;\"><span style=\"font-weight: bold;\">Vivekanananda Neelakantan<\/span> addresses the increasing trend of awards being challenged and how this has influenced legislative and procedural thinking in arbitration:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cAnd again, the number of cases where awards have been challenged for us has increased over the years.\u201d<\/i><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"margin-bottom: 1%;\">He points to recent developments aimed at curbing unmeritorious challenges and incentivising procedural fairness:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i>\u201cAnd in recent particular, there are instances where there\u2019s possibilities\u2014and one of the other amendments that is now is\u2014when there\u2019s a successful challenge, so you don\u2019t just walk away with what\u2019s been set aside, but you could also potentially recover costs that you would spend in the arbitration.\u201d<\/i><\/strong><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 1%;\">Turning to practice before the courts, he refers to Section 68 and notes:<\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><strong><i><span data-contrast=\"auto\">\u201cWhen it\u2019s to the court, I presume you have Section 68. Do you have to get\u2014 as of right, if you\u2019re alleging or processing\u2014you can file a challenge, right?\u201d<\/span><\/i><\/strong><\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p data-start=\"216\" data-end=\"892\">Responding to the question on <strong>how Singapore\u2019s judiciary ensures arbitration remains independent whilst maintaining oversight<\/strong>, <span style=\"font-weight: bold;\">Vivekanananda <\/span>remarks, <em data-start=\"379\" data-end=\"680\">\u201cI think one point that should be said is that while the Singapore courts have long had this track record of imposing arbitration agreements and arbitration awards rather seriously, they have not hesitated to step in and set aside awards when necessary \u2014 and where that being clear causes failures.\u201d<\/em><\/p>\n<\/div>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p data-start=\"216\" data-end=\"892\">He further notes, <em data-start=\"691\" data-end=\"891\">\u201cThe number of cases where awards were challenged to Singapore courts have only increased over the years and that is presumably because there is a larger number of cases that are being arbitrated.\u201d<\/em><\/p>\n<\/div>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p data-start=\"894\" data-end=\"1486\">He adds, in recent years particularly, there are instances where the Singapore courts have set aside awards where there is process failures.<\/p>\n<p data-start=\"894\" data-end=\"1486\">Highlighting legislative developments, he states, &#8220;One of the other amendments that is now being considered in the Singapore Arbitration Act is \u2014 when there is a successful challenge to an award \u2014 then the court should have the power to reapportion the costs among the parties.\u201d He explains, so you do not just walk away with the award being set aside, but you can also potentially recover costs that you would have spent in the arbitration.<\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\">Responding to the moderator\u2019s prompt for a \u201cwar story,&#8221; <span style=\"font-weight: bold;\">Vivekanananda <\/span><\/span><span data-contrast=\"auto\">shares a compelling account that connected directly to the ongoing conversation on <strong>emergency arbitrator<\/strong> orders and their enforceability. He began, <\/span><i><span data-contrast=\"auto\">\u201cI have one which actually connects to what Justice Nath just said in terms of the proposal for the enforcement of emergency arbitrate orders. This really begins from a very sad episode which is one of the biggest terror attacks that happened in India in November 2008 in Bombay.\u201d<\/span><\/i><span data-contrast=\"auto\"> He continued, <\/span><i><span data-contrast=\"auto\">\u201cTen years later there was an Australian production house that set out to make a movie on it.\u201d<\/span><\/i><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span data-contrast=\"auto\">Describing the setup, he says, <\/span><i><span data-contrast=\"auto\">\u201cThere was an agreement between a party in the UAE and this Australian company to distribute the movie in all of the SAARC region, India and the rest of South Asia.\u201d<\/span><\/i><span data-contrast=\"auto\"> The dispute emerged just before the film\u2019s release: <\/span>The party from the UAE found out that they had struck a kind of secret deal with Netflix to release the movie on the Netflix platform.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>He explains, The distribution agreement between the parties provided for SIAC arbitration and the UAE party which was the intended and supposed distributor then applied for emergency interim relief and asked for the appointment of an emergency arbitrator at SIAC. The emergency arbitrator, after due consideration, \u201cgranted relief injuncting the production house from breaching the distribution agreement because he found that there was, on a primal facing basis, exclusivity of distribution and said he would not then hand over rights to the film to any other third party.\u201d<\/p>\n<p>However, Netflix couldn&#8217;t have been made party to the arbitration because it was not party to the arbitration agreement. As a result, the UAE distributor went to the Bombay High Court and requested the High Court to exercise its power under Section 9 to then grant interim relief in the same terms as the emergency arbitrator&#8217;s orders. Notably, this allowed Netflix to be arraigned in as a party to that litigation,\u201d and the court \u201cgranted orders in the same terms as the UAE order.<\/p>\n<p>Calling it a \u201c<em><strong>classic example of how the emergency arbitrator processes work at SIAC in terms of its speed and the level of detail to which the decisions are made by emergency arbitrators,\u201d\u00a0 <\/strong><\/em>he emphasises how the Indian courts have really been amongst the most progressive in allowing this manner of quote unquote enforcement through the Section 9 rule. He concludes by noting that this was possible only because courts were persuaded by the logic and the analysis and the reasoning of the emergency arbitrator in making orders of a similar kind under the Section 9 rule restriction.\u00a0He added, \u201cIndia is quite unique in this respect in terms of its experience with emergency arbitrator orders \u2014 and of course there have been many other such examples.<\/p>\n<p><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 1%;\">\n<\/div>\n<p data-start=\"147\" data-end=\"731\">In response to the question on <strong>how SIAC approaches arbitrator appointments and whether it maintains a \u201clittle black book,<\/strong>\u201d he notes that,<\/p>\n<p style=\"text-align: center;\" data-start=\"147\" data-end=\"731\">\u201c<em><strong>appointing arbitrators is perhaps the most important step in the process one may say because that&#8217;s really the person or persons who are deciding your dispute<\/strong><\/em>.\u201d<\/p>\n<p data-start=\"147\" data-end=\"731\">He stresses the importance of getting both procedural and substantive issues right, adding, \u201cwhether it&#8217;s procedural issues or substantive issues they&#8217;ve got to get it right. And more so on the former because process failures are what can lead to a challenge from the world.\u201d<\/p>\n<p data-start=\"733\" data-end=\"1439\">He explains that SIAC seeks individuals who are obviously familiar with international arbitration and the procedures and the rules of the institution. He also acknowledges that \u201cwe do have an internal list as well of rising arbitrators who are people who are younger in their journey on being an arbitrator. The selection process is also driven by the complexity and value of the case: \u201cThe complexity of the case and the value of the case is obviously a determining factor. You pick people of relative seniority to the complexity and value.\u201d<\/p>\n<p data-start=\"1441\" data-end=\"2226\" data-is-last-node=\"\" data-is-only-node=\"\">Highlighting the importance of subject matter expertise:<\/p>\n<p style=\"text-align: center;\" data-start=\"1441\" data-end=\"2226\" data-is-last-node=\"\" data-is-only-node=\"\">\u201cIs it a construction dispute? Is it a cryptocurrency dispute? Is it a shipping dispute? You pick people according to the expertise that is required for that particular case.\u201d He adds that \u201c<strong>nationality is a key consideration because when we are appointing sole arbitrators and presiding arbitrators you always want to appoint someone of a nationality that is neutral to that arbitration<\/strong>.\u201d<\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p>&nbsp;<\/p>\n<p style=\"margin-bottom: 3%;\">Conclusively, the session offers a deep dive into the evolving landscape of international arbitration, with a strong focus on emerging trends, institutional practices, and legislative reforms.
