The Court considered that in the absence of any inculpatory role ascribed to the accused persons, their arrest on the spot where riots outbroke, was not conclusive that they were a part of the unlawful assembly, particularly when neither instrument of destruction nor any inflammatory material was seized from them. Besides that, the police resorted to firing causing people to run helter skelter. In that melee, even an innocent person may be mistaken for a miscreant. Hence, the mere presence of the accused persons at the spot, or their arrest therefrom, was not sufficient to prove that they were a part of the unlawful assembly comprising of more than a thousand people.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Lifeforce Cryobank Sciences Inc.<\/span> v. <span style=\"font-style: italic;\">Cryoviva Biotech (P) Ltd.<\/span>,<a id=\"fnref6\" title=\"6. 2024 SCC OnLine SC 3215\" href=\"#fn6\"><sup>6<\/sup><\/a><\/span> an arbitration petition, the division bench of Dr. D.Y. Chandrachud, CJI and <span style=\"font-weight: bold;\">Manoj Misra*, J.<\/span> said that since at the stage of consideration of a prayer under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544910\" target=\"_blank\" rel=\"noopener\">11(6)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Arbitration and Conciliation Act, 1996<\/a> (\u2018Act, 1996\u2019) , the Court has to confine itself to the examination of the existence of an arbitration agreement, it would not be appropriate for it to delve deep into the issue as it could well be considered by the arbitrator on the basis of evidence led by the parties. More so, when existence of arbitration agreement in the license agreement and share subscription agreement is not in dispute. Therefore, the Court referred the matter to the Delhi International Arbitration Centre for the appointment of a sole arbitrator to adjudicate upon the dispute between the parties.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cWe have not expressed any opinion on the merits of the claim of either party including regarding the arbitrability of the dispute. All contentions and pleas are kept open for the parties to raise before the arbitral tribunal.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Rajive Raturi<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>,<a id=\"fnref7\" title=\"7. 2024 SCC OnLine SC 3217\" href=\"#fn7\"><sup>7<\/sup><\/a><\/span> a writ petition to make public buildings accessible for persons with disabilities, the three-Judge Bench of then CJI Dr. DY Chandrachud, J.B. Pardiwala and Manoj Misra, JJ. ruled that several guidelines prescribed in Rule 15 of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002852204\" target=\"_blank\" rel=\"noopener\">Right of Persons with Disabilities Rules, 2017<\/a>, appear to be recommendatory guidelines, under the garb of mandatory rules. Hence, the Court held <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/11\/12\/union-mandate-rules-under-rpwd-act-ensure-accessibility-of-public-places-supreme-court\/\" target=\"_blank\" rel=\"noopener\">Rule 15(1) to be ultra vires the scheme and legislative intent of the RPWD Act which creates a mechanism for mandatory compliance<\/a>. Therefore, the Court directed the Union to form mandatory rules, as required by Section 40, within a period of three months from the date of the Judgment.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">In Re: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/10\/17\/rgkar-rape-murder-wb-govt-recruitment-civic-volunteers-direction-sc-legal-news\/\" target=\"_blank\" rel=\"noopener\">Alleged Rape and Murder Incident of a Trainee Doctor in R.G. Kar Medical College and Hospital, Kolkata and Related Issues<\/a><\/span>,<span style=\"font-weight: bold;\"><a id=\"fnref8\" title=\"8. 2024 SCC OnLine SC 2939\" href=\"#fn8\"><sup>8<\/sup><\/a>the 3-Judge Bench of Dr DY Chandrachud, CJ, J.B Pardiwala and Manoj Misra, JJ., took note of the 5th Status Report filed by the CBI wherein it was stated that a chargesheet has been submitted against the primary accused on 7-10-2024 for alleged offences punishable under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803752\" target=\"_blank\" rel=\"noopener\">64<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803754\" target=\"_blank\" rel=\"noopener\">66<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803438\" target=\"_blank\" rel=\"noopener\">103(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">Nyaya Sanhita, 2023<\/a> (BNS) and that the ACJM, Sealdah, Kolkata has taken cognizance and committed the case to the Court of the Additional Sessions Judge, 1st Court, Sealdah.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">While considering the instant appeal filed by the original complainant (appellant), against the decision of Jharkhand High Court whereby the Court had quashed the order of cognizance and all further proceedings for offences punishable under Ss. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561742\" target=\"_blank\" rel=\"noopener\">406<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561758\" target=\"_blank\" rel=\"noopener\">420<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Somjeet Mallick<\/span> v. <span style=\"font-style: italic;\">State of Jharkhand<\/span>,<a id=\"fnref9\" title=\"9. 2024 SCC OnLine SC 2820\" href=\"#fn9\"><sup>9<\/sup><\/a><\/span> the Division Bench of J.B Pardiwala and <span style=\"font-weight: bold;\">Manoj Misra*<\/span>, JJ., held that Court must apply its mind to the materials submitted in support of the police report before taking a call <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/10\/16\/fir-quashment-investigation-dishonest-conduct-allegation-sc-legal-news\/\" target=\"_blank\" rel=\"noopener\">whether the FIR and consequential proceedings should be quashed or not; more so, when the FIR alleges an act which is reflective of dishonest conduct of the accused.<\/a> Thus, when the FIR alleges dishonest conduct on the part of the accused which, if supported by materials, would disclose commission of a cognizable offence, investigation should not be thwarted by quashing the FIR.<\/p>\n<p style=\"margin-bottom: 3%;\">While deliberating over the instant appeal revolving around the interpretation of Rule 50 of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002789180\" target=\"_blank\" rel=\"noopener\">National Company Law Tribunal Rules, 2016<\/a> (NCLT Rules) and Rule 22 of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002789175\" target=\"_blank\" rel=\"noopener\">National Company Law Appellate Tribunal Rules, 2016<\/a> (NCLAT Rules) in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">SBI<\/span> v. <span style=\"font-style: italic;\">India Power Corporation Ltd.<\/span>;<a id=\"fnref10\" title=\"10. 2024 SCC OnLine SC 2731\" href=\"#fn10\"><sup>10<\/sup><\/a><\/span> the Division Bench of D.Y. Patel<\/span>,<a id=\"fnref12\" title=\"12. 2024 SCC OnLine SC 2597\" href=\"#fn12\"><sup>12<\/sup><\/a><\/span> the 3-judge bench of Dr. DY Chandrachud, CJI and JB Pardiwala and Manoj Misra, JJ held that the conduct of the non-signatory party along with the other attending circumstances may lead the referral court to draw a legitimate inference that it is a veritable party to the arbitration agreement.<\/p>\n<p style=\"margin-bottom: 3%;\">While considering the instant appeal revolving around specific performance of contract in<span style=\"font-weight: bold;\"> <span style=\"font-style: italic;\">Ishwar<\/span> v. <span style=\"font-style: italic;\">Bhim Singh<\/span>,<a id=\"fnref13\" title=\"13. 2024 SCC OnLine SC 2338\" href=\"#fn13\"><sup>13<\/sup><\/a><\/span> the Division Bench of J.B. Nirmala<\/span> v. <span style=\"font-style: italic;\">Canara Bank<\/span>,<a id=\"fnref14\" title=\"14. 2024 SCC OnLine SC 2273\" href=\"#fn14\"><sup>14<\/sup><\/a><\/span> the Division Bench of J.B Pardiwala and <span style=\"font-weight: bold;\">Manoj Misra*<\/span>, JJ., stated that \u2018<a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/09\/06\/motor-accident-compensation-ownership-definition-not-limited-context-control-of-vehicle-important-supreme-court-legal-news\/\" target=\"_blank\" rel=\"noopener\">owner\u2019 of a vehicle is not limited to the categories specified in Section 2(30) of the Motor Vehicles Act, 1988.<\/a> If the context so requires, even a person at whose command or control the vehicle is could be treated as its owner to fix tortious liability for compensation payment.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Kalanithi Maran<\/span> v. <span style=\"font-style: italic;\">Ajay Singh<\/span>,<a id=\"fnref15\" title=\"15. 2024 SCC OnLine SC 1876\" href=\"#fn15\"><sup>15<\/sup><\/a><\/span> a special leave petition filed against the judgment and order of the division bench of the Delhi High Court, wherein the Court remand the proceedings to the Single Judge for reconsidering the petition under Section 34 of the Arbitration and Conciliation Act 1996, observing that the validity of the award of refund and the grant of interest appears in the context of examining the correctness of the judgment rendered by the Single Judge alone, the Three Judge Bench of Dr. DY Chandrachud, CJI, J.B. Pardiwala and Manoj Misra, JJ. while agreeing with the reasoning which led the Division Bench of the Delhi High Court to remand the proceedings to the Single Judge, said that <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/08\/03\/judge-hearing-s-34-application-must-apply-mind-to-grounds-of-challenge-deduce-whether-interference-required-sc\/\" target=\"_blank\" rel=\"noopener\">interference with an arbitral award under Section 34 must be confined to the grounds which are permissible under the statute<\/a>. But equally, the Judge hearing an application under Section 34 must apply their mind to the grounds of challenge and then deduce as to whether a case for interference within the parameters of Section 34 has been made out.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #171617;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Property Owners Assn.<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span>,<a id=\"fnref16\" title=\"16. 2024 SCC OnLine SC 3122.\" href=\"#fn16\"><sup>16<\/sup><\/a><\/span> the Nine-Judge Constitution Bench comprising of CJI Dr. DY Chandrachud, Hrishikesh Roy, B.V. Nagarathna, Sudhanshu Dhulia, J.B. Pardiwala, Manoj Misra, Rajesh Bindal, Satish Chandra Sharma and Augustine George Masih, JJ., delivered its judgment on the issue of whether private resources form part of the \u2018material resource of the community\u2019 under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001575241\" target=\"_blank\" rel=\"noopener\">39(b)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>. Such power has to be conferred on a Magistrate by a process of judicial interpretation and in exercise of jurisdiction vested in this Court under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574873\" target=\"_blank\" rel=\"noopener\">142<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution of India<\/a>.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">While setting aside the conviction of the accused and acquittal of the co-accused in a 23 year old Murder case, a 3-judge bench consisting of Sanjay Kishan Kaul, <span style=\"font-weight: bold;\">Manoj Misra*<\/span> and Aravind Kumar, JJ., in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Santosh<\/span> v. <span style=\"font-style: italic;\">State (NCT of Delhi)<\/span><\/span>,<span style=\"font-weight: bold;\"><a id=\"fnref44\" title=\"44. 2023 SCC OnLine SC 538\" href=\"#fn44\"><sup>44<\/sup><\/a><\/span> held that the prosecution has failed to prove the chain of incriminating circumstances as to conclusively prove the guilt of the accused persons. The Court remarked that<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201c\u2026it is a case where the prosecution failed to elevate its case from the realm of \u201cmay be true\u201d to the plane of \u201cmust be true\u201d as is indispensably required for conviction on a criminal charge.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">State of M.P.<\/span> v. <span style=\"font-style: italic;\">Phoolchand Rathore<\/span>,<a id=\"fnref45\" title=\"45. 2023 SCC OnLine SC 537\" href=\"#fn45\"><sup>45<\/sup><\/a><\/span> a 3-judge bench consisting of Sanjay Kishan Kaul, <span style=\"font-weight: bold;\">Manoj Misra*<\/span> and Aravind Kumar, JJ., upheld the Madhya Pradesh High Court\u2019s order of acquittal of the death row convict for the alleged murder of his wife on the grounds that the prosecution has failed to prove the circumstances beyond reasonable doubt in terms of (a) Motive; (b) Disclosure Statement and Recovery; (c) Extra Judicial Confession; and (d) Accused taking the deceased with him and soon thereafter the deceased was found in an injured state.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Kunnel Engineers &amp; Contractors (P) Ltd.<\/span> v. <span style=\"font-style: italic;\">New India Assurance Co. Ltd.<\/span>,<a id=\"fnref46\" title=\"46. 2023 SCC OnLine SC 674\" href=\"#fn46\"><sup>46<\/sup><\/a><\/span> a matter related to payment of interest on compensation where there is a contractual exception for the insurer on payment of interest, the Court observed that <span style=\"font-weight: bold;\">\u201cWhen parties have agreed upon the terms of the insurance contract, the Court cannot interpret the clauses in the contract, by adverting to equity principles.\u201d<\/span> The Court opined that the liability of the insurance company does not fall under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002768474\" target=\"_blank\" rel=\"noopener\">Employees Compensation Act, 1923<\/a> and the same is governed only by the terms of the contract.<\/p>\n<p style=\"margin-bottom: 3%;\">While setting aside the decree of eviction in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Shanti Prasad<\/span> v. <span style=\"font-style: italic;\">Thakur Dass<\/span><\/span>,<a id=\"fnref47\" title=\"47. (2023) 6 SCC 612\" href=\"#fn47\"><sup>47<\/sup><\/a> a Division Bench comprising of Manoj Misra and Aravind Kumar, JJ., held that the appellant\/tenant is entitled to the benefit of S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001676324\" target=\"_blank\" rel=\"noopener\">20(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002881525\" target=\"_blank\" rel=\"noopener\">Uttar Pradesh Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972<\/a> and cannot be denied the same only on the ground that the plea taken by him with regard to the rate of rent was found incorrect.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Allahabad High Court<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Kishan Kumar<\/span> v. <span style=\"font-style: italic;\">State of U.P.<\/span>,<a id=\"fnref48\" title=\"48. 2019 SCC OnLine All 4337\" href=\"#fn48\"><sup>48<\/sup><\/a><\/span> a Division Bench comprising of Manoj Misra and Virendra Kumar Srivastava, JJ., held that the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2019\/12\/04\/all-hc-date-of-birth-in-an-aadhaar-card-not-conclusive\/\" target=\"_blank\" rel=\"noopener\">date of birth in Aadhaar Card is not conclusive evidence<\/a>. The Court clarified that no protection shall be given, and the investigating agency shall be free to take all steps to bring the investigation to its logical conclusion if the victim is not produced by the date fixed.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Prabhunath Tiwari<\/span> v. <span style=\"font-style: italic;\">State of U.P.<\/span>,<a id=\"fnref49\" title=\"49. 2012 SCC Online All 317\" href=\"#fn49\"><sup>49<\/sup><\/a><\/span> Manoj Misra, J. held that the Revisional power of the High Court against the order passed under S. 29 of the Domestic Violence Act is <span style=\"font-weight: bold;\">\u201cintact and unaffected\u201d<\/span>. The Court remarked that the supervisory power of the High Court <span style=\"font-weight: bold;\">\u201chas not been excluded expressly or impliedly\u201d<\/span> by the Act, therefore, the Sessions Court was subject to the revisionary power of the High Court.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Ram Pratap<\/span> v. <span style=\"font-style: italic;\">State of U.P.<\/span><\/span>,<a id=\"fnref50\" title=\"50. 2022 SCC OnLine All 460\" href=\"#fn50\"><sup>50<\/sup><\/a> the Division bench of Manoj Misra and Sameer Jain, JJ., held that an accused cannot be held guilty merely on account of motive and abscondence even though it may give rise to strong suspicion.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cMerely on the basis of motive and abscondence, though it may give rise to strong suspicion, the accused cannot be held guilty.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Bhanu Pratap Singh<\/span> v. <span style=\"font-style: italic;\">State of U.P.<\/span><\/span>,<a id=\"fnref51\" title=\"51. 2021 SCC OnLine All 220\" href=\"#fn51\"><sup>51<\/sup><\/a> a Division Bench comprising of Manoj Misra and Rohit Ranjan Agarwal, JJ., opined that the court cannot presume the consent of wife simply because she was present at the time of adoption. The wife&#8217;s silence or lack of protest on her part also cannot give rise to an inference that she had consented to the adoption.<\/p>\n<p style=\"margin-bottom: 3%;\">While expressing its dissatisfaction over the manner in which the officers of the State are progressing on serious issues pertaining to infrastructure and functioning of courts in the State of Uttar Pradesh, a full bench of Munishwar Nath Bhandari, ACJ., Naheed Ara Moonis, Manoj Misra, Sunita Agarwal, Surya Prakash Kesarwani, Manoj Kumar Gupta and Anjani Kumar Mishra, JJ., in <span style=\"font-weight: bold; font-style: italic;\">Zila Adhivakta Sangh Allahabad, In re<\/span><a id=\"fnref52\" title=\"52. 2021 SCC OnLine All 1102\" href=\"#fn52\"><sup>52<\/sup><\/a> directed the District Judges to co-ordinate with the District Magistrates to identify land that can be made available for the construction of the Courts and residential buildings for the Subordinate Courts. The Court also stressed the issue of the unavailability of adequate infrastructure to the POCSO courts in the state.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cThe District Magistrates being the Custodian of the records of the districts are required to identify the lands at the local level for their allotment to the Subordinate Courts both for the Court complexes and residential accommodations for the judicial officers.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Ram Kishore<\/span> v<span style=\"font-style: italic;\">. State of U.P.<\/span>,<a id=\"fnref53\" title=\"53.
