Rajasthan High Court:<\/span> The Rajasthan High Court Bar Association (RHCBA), Jaipur, through its President and General Secretary submitted a formal representation to the Chief Justice of the Rajasthan High Court, with regards to the mounting pendency of matters, particularly bail applications, at the Jaipur Bench of the High Court.<\/p>\n

The RHCBA pointed out that the “huge pile of pending Bail Applications are against the spirit of speedy and natural justice,”<\/span> which has been consistently upheld by the Supreme Court and the High Courts. The RHCBA emphasised that continued inaction during summer vacations impedes the delivery of timely justice and affects the constitutional mandate of access to justice.<\/p>\n

The RHCBA referenced that the Supreme Court itself had constituted extra benches during its summer vacation and disposed of around 1,170 cases during the summer break of 2024. The RHCBA cited the amendment of Supreme Court rules in 2024 to reclassify summer vacations as “Partial Court Working Days.”<\/p>\n

The RHCBA highlighted the recent observation of the Chief Justice of India, who reportedly stated that “vacations are partial working days now. It is not a vacation now. We are having three benches working every week.”<\/span><\/p>\n

The RHCBA criticised the existing practice during vacations, where only fresh bail applications filed during the summer break are taken up by benches and contended that this practice violates the principle of equality as “Bail Applications, which are pending and have been filed before the Summer Vacations, also deserve to be heard.”<\/span><\/p>\n

The RHCBA respectfully urged the Chief Justice of Rajasthan High to—<\/p>\n

    Constitute extra benches during the summer vacation;<\/p>\n<\/li>\n

  2. \n

    Amend Court protocols to designate summer vacations as partial working days;<\/p>\n<\/li>\n

  3. \n

    Ensure that vacation benches hear not only newly filed bail applications but also pending bail applications and other matters of urgency.<\/p>\n<\/li>\n<\/ol>\n
