{"id":348075,"date":"2025-05-16T18:00:39","date_gmt":"2025-05-16T12:30:39","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=348075"},"modified":"2025-05-22T10:17:40","modified_gmt":"2025-05-22T04:47:40","slug":"rajasthan-high-court-takes-suo-moto-action-over-non-functioning-of-16-permanent-lok-adalats-scc-times","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/05\/16\/rajasthan-high-court-takes-suo-moto-action-over-non-functioning-of-16-permanent-lok-adalats-scc-times\/","title":{"rendered":"Rajasthan High Court takes suo moto action over non-functioning of 16 Permanent Lok Adalats"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Rajasthan High Court:<\/span> While taking suo motu cognizance based on a news report published in the Hindi daily newspaper <span style=\"font-style: italic;\">Dainik Bhaskar<\/span> dated 13-05-2025, regarding a grave issue related to &#8220;Access to Justice,&#8221; i.e., State Government, vide an order dated 09-04-2025, rendered 16 permanent Lok Adalats non-functional, a Division Bench of Shree Chandrashekhar and Sandeep Shah, JJ., impleaded the respondents and directed them to file their replies.<\/p>\n<p style=\"margin-bottom: 3%;\">The report pointed out that the impact of the shutdown was visibly severe in Jodhpur, where approximately 972 cases remained pending. It was further stated that around 10,000 cases across Rajasthan are likely affected due to the cessation of functioning of these Lok Adalats.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted the serious ramifications of shutting down the functioning of Lok Adalats, which are an essential part of the legal services delivery mechanism aimed at ensuring <span style=\"font-style: italic;\">&#8220;access to justice&#8221;<\/span>. The Court reiterated the importance of ensuring that <span style=\"font-weight: bold;\">&#8220;the public at large has the right to demand speedy justice&#8221;<\/span> and the same cannot be denied<span style=\"font-weight: bold;\"> &#8220;solely on the ground that it was a policy decision.&#8221;<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">The Court emphasised on the principle laid down in <span style=\"font-style: italic;\">Brij Mohan Lal<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/L1Zzt7WL\" target=\"_blank\">(2012) 6 SCC 502<\/a>, where it was held that &#8220;<span style=\"font-style: italic;\">matters relating to framing and implementation of policy primarily fall in the domain of the Government&#8230; But this general rule is not free from exceptions. The courts have repeatedly taken the view that they would not refuse to adjudicate upon policy matters if the policy decisions are arbitrary, capricious or mala fide.&#8221;<\/span> The Court stressed that the jurisdiction of Constitutional Courts extends to scrutinizing policy decisions that infringe upon fundamental rights, especially those affecting access to justice.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court formally impleaded Chief Secretary, Government of Rajasthan; Additional Chief Secretary-cum-Finance Secretary; Secretary, Department of Personnel; Principal Secretary, Law &amp; Legal Affairs Department and Member Secretary, Rajasthan State Legal Services Authority, as respondents and directed them to file their response.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span style=\"font-style: italic;\">Suo Moto<\/span> v. <span style=\"font-style: italic;\">State of Rajasthan<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/98UKCwKd\" target=\"_blank\" rel=\"noopener\">2025 SCC OnLine Raj 2170<\/a>, Decided on 13-05-2025<\/span>]<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p style=\"font-style: italic;\">The Court noted that although courts generally refrain from interfering in government policy, they are constitutionally obligated to intervene when such decisions infringe upon rights like access to justice or fair
