The Centre Government appointed Special Public Prosecutors team led by Tushar Mehta, Solicitor General of India with S.V. Raju, Additional Solicitor General, Dayan Krishnan, Senior Advocate and Narender Mann, Advocate for conducting trial and other matters related to NIA case in 26\/11 Mumbai Terror Attack case.<\/p>\n

The Team would be representing National Investigation Agency before the NIA Special Courts at Delhi, Delhi High Court of Delhi and Supreme Court of India for a period of 3 years from the date of publication of the notification or till the completion of trial of the said case, whichever is earlier.<\/p>\n

The said appointment was carried out in exercise of the powers conferred by Section 15(1)<\/a> of the National Investigation Agency Act, 2008<\/a>, read with Section 18(8)<\/a> of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023<\/a>.<\/p>\n

In the said matter, the NIA registered a case on 11-11-2009 at NIA Police Station, New Delhi as Case RC-04\/2009\/NIA\/DLI under Section 121-A<\/a> of the Penal Code, 1860<\/a> (‘IPC’), Section 18<\/a> of Unlawful Activities (Prevention) Act, 1967<\/a> and Section 6(2) SAARC Convention (Suppression of Terrorism) Act against David Coleman Headley (USA Citizen) and Tahawwur Hussain Rana (Canadian citizen) and others.<\/p>\n

According to the NIA, the accused persons entered into a criminal conspiracy with members of Lashkar-E-Taiba (LeT) and Harkat-ul Jihadi Islami (HUJI), both terrorist organizations based in Pakistan, to commit terrorist acts in New Delhi and other places in India.<\/p>\n

The Special Court, NIA, Patiala House, New Delhi issued Non Bailable Warrants against all the 9 accused persons. The two main accused were arrested by law enforcement agencies in USA in their case. Consequent upon the request of NIA, the Interpol, Central Bureau of Investigation (CBI), New Delhi issued Red Notices (RNs) against the remaining 7 absconding accused persons. On 09-04-2025, the United States extradited Tahawwur Hussain Rana to India to face justice for his role in planning the horrific 2008 Mumbai terrorist attacks<\/a>.<\/p>\n
