Gavai, Sanjay Kumar, Augustine George Masih, and K.V. Viswanathan, JJ. held that appellate courts have limited powers to modify arbitral awards while exercising jurisdiction under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544939\" target=\"_blank\">34<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544942\" target=\"_blank\">37<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\">Arbitration and Conciliation Act, 1996<\/a>. Justice K.V. Viswanathan delivered the dissenting opinion.<\/p>\n<p>The Court held that appellate courts may exercise limited powers to modify arbitral awards under certain specific circumstances:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p><span style=\"font-weight: bold;\">Severability<\/span> &mdash; When the invalid portion of the award can be separated from the valid part.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Apparent Errors<\/span> &mdash; To correct clerical, computational, or typographical errors evident on the face of the record.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Post-Award Interest<\/span> &mdash; To modify post-award interest where appropriate.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Article 142 Powers<\/span> &mdash; The Supreme Court may exercise its special powers under Article 142 of the Constitution to modify awards, but such powers must be used sparingly and with great caution, in accordance with constitutional limits.<\/p>\n<\/li>\n<\/ol>\n<p>Justice Viswanathan dissented from the majority view on key issues, holding that:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>The Supreme Court cannot invoke Article 142 of the Constitution to modify arbitral awards.<\/p>\n<\/li>\n<li>\n<p>Courts have no authority to modify post-award interest; such matters should be referred back to the arbitrator.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Judicial interference with arbitral awards is impermissible,
