{"id":346210,"date":"2025-04-21T13:00:44","date_gmt":"2025-04-21T07:30:44","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=346210"},"modified":"2025-05-01T18:31:13","modified_gmt":"2025-05-01T13:01:13","slug":"liking-post-does-not-attract-penalty-section-67-it-act-allahabad-hc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/04\/21\/liking-post-does-not-attract-penalty-section-67-it-act-allahabad-hc\/","title":{"rendered":"Mere liking of a post does not attract penalty under S. 67 of IT Act or constitute a criminal offence: Allahabad High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Allahabad High Court:<\/span> In an application filed to quash the chargesheet, the cognizance order, as well as the entire proceedings of the criminal case under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561407\" target=\"_blank\" rel=\"noopener\">147<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561408\" target=\"_blank\" rel=\"noopener\">148<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561409\" target=\"_blank\" rel=\"noopener\">149<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (\u2018IPC\u2019), Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">Information Technology Act, 2000<\/a> (\u2018IT Act\u2019), and Section 7 of the Criminal Law (Amendment) Act, the Single Judge Bench of Saurabh Srivastava, J. held that merely liking a post did not amount to publishing or transmitting the post. Consequently, such an act would not attract the provisions of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a>. The Court further concluded that no material was available to connect the accused with any objectionable post, as no offensive content was found on the accused&#8217;s Facebook or WhatsApp accounts. Accordingly, it was held that no case was made out against the accused.<\/p>\n<p style=\"margin-bottom: 3%;\">The allegation against the accused was that he posted certain provocative messages on social media, which resulted in the assembly of about 600-700 persons belonging to the Muslim community for arranging procession without permission, which caused a serious threat to breach of peace.<\/p>\n<p style=\"margin-bottom: 3%;\">Upon examining Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a>, the Court noted that the provision was attracted only when a person had published, transmitted, or caused to be published or transmitted, in electronic form, any material that tended to deprave or corrupt individuals who read, saw, or heard the content contained or embodied in such material or message.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court said that publishing or transmitting obscene material constitutes an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a>. A post or message was considered to be published when it was posted and transmitted, when it was shared or retweeted. In the present case, it was alleged that the case diary contained material indicating that the accused had liked a post by one person related to unlawful assembly.<\/p>\n<p style=\"margin-bottom: 3%;\">However, the Court held that merely liking a post did not amount to publishing or transmitting the post. Therefore, such an act would not attract Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a>. Furthermore, based on the material available on record, there appeared to be no message of a provocative nature, and thus, merely liking a message published by some other person would not attract any penalty under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a> or constitute any other criminal offence.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court took note of <span style=\"font-style: italic;\">Kaushal Kishor<\/span> v. <span style=\"font-style: italic;\">State of U.P<\/span>., <a href=\"http:\/\/www.scconline.com\/DocumentLink\/hs3cb5GO\" target=\"_blank\" rel=\"noopener\">(2023) 4 SCC 1<\/a>, wherein it was observed that every citizen of India must consciously be restrained in speech, and exercise the right to freedom of speech and expression under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574926\" target=\"_blank\" rel=\"noopener\">19(1)(a)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a> only in the sense that it was intended by the framers of the Constitution, to be exercised.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further clarified that, in any case, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a> pertains specifically to obscene material and not to provocative content. It observed that the terms &#8220;lascivious&#8221; or &#8220;appeals to the prurient interest&#8221; refer to material that relates to sexual interest or desire. Therefore, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a> does not prescribe any punishment for content that is merely provocative in nature but not obscene.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court concluded that there was no material available to connect the accused with any objectionable post, as no offensive content was found on the accused&#8217;s Facebook or WhatsApp accounts. Therefore, no case was made out against the accused.<\/p>\n<p style=\"margin-bottom: 3%;\">In view of the above, so far as the accused is concerned, the Court quashed the proceedings in criminal case under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561407\" target=\"_blank\" rel=\"noopener\">147<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561408\" target=\"_blank\" rel=\"noopener\">148<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561409\" target=\"_blank\" rel=\"noopener\">149<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001540657\" target=\"_blank\" rel=\"noopener\">67<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796572\" target=\"_blank\" rel=\"noopener\">IT Act<\/a>, and Section 7 of the Criminal Law Amendment Act. However, the Court clarified that the present order would not preclude the Trial Court from proceeding against the other co-accused persons, provided there was no legal impediment to such proceedings.<\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, the application was allowed.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Imran Khan v.
