On 28-2-2025, the Government of the National Capital Territory of Delhi<\/span> notified the Delhi BNSS (Identification of Case Property) Rules, 2025<\/span> to establish clear guidelines for identification and documentation of case properties to prevent misidentification and loss. The provisions came into force on 28-2-2025.<\/p>\n

Applicability:<\/span> whole of NCT of Delhi<\/p>\n

Key Points:<\/h3>\n
    \n
  1. \n

    Production of property before the competent Court:<\/span> The person producing the property before the Court will have to produce the seizure memo \/ any document that contains the description of the property<\/p>\n<\/li>\n

  2. \n

    The competent Court, within 14 days from the production of property before it, will have to prepare a statement of such property<\/span> containing its description.<\/p>\n

    In case any test identification proceedings are required then the preparation of statement should be completed before the preparation of the statement of identification of case property.<\/p>\n<\/li>\n

  3. \n

    If required, photographs<\/span> from all the angles\/ videography<\/span> on mobile phones or any other electronic media, of the property can be taken by the Court.<\/p>\n<\/li>\n

  4. \n

    In some cases, where the property produced is such of which samples are required to be taken (liquor bottles\/ pouches etc.) the competent Court will take samples of the property as well as photographs of the entire lot of the seized property and if necessary, videography on mobile phone or any electronic media.<\/p>\n<\/li>\n

  5. \n

    Samples and statements of identification of case property will be used as evidence under Bhartiya Nagarik Suraksha Sanhita, 2023<\/a>.<\/p>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
