Succession Act, 1925, S. 2(h).\"><sup>1<\/sup><\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002835343\" target=\"_blank\">Succession Act, 1925<\/a><a id=\"fnref2\" href=\"#fn2\" title=\"2. Succession Act, 1925.\"><sup>2<\/sup><\/a> (ISA) as &#8220;the legal declaration of the intention of a testator with respect to his property which he desires to be carried into effect after his death&#8221;.<\/p>\n<p style=\"\">Section 69<a id=\"fnref3\" href=\"#fn3\" title=\"3. Succession Act, 1925, S. 69.\"><sup>3<\/sup><\/a> of the ISA is an interesting provision. It reads:<\/p>\n<p style=\"margin-bottom: 3%; margin-left: 36pt;\"><span style=\"font-style: italic;\">Revocation of will by testator&#8217;s marriage.&mdash;<\/span> Every will shall be <span style=\"font-style: italic;\">revoked by the marriage of the maker<\/span>, except a will made in exercise of a power of appointment, when the property over which the power of appointment is exercised would not, in default of such appointment, pass to his or her executor or administrator, or to the person entitled in case of intestacy&#8230;.<\/p>\n<p style=\"\">Section 70<a id=\"fnref4\" href=\"#fn4\" title=\"4. Succession Act, 1925, S. 70.\"><sup>4<\/sup><\/a> of the ISA further states,<\/p>\n<p style=\"margin-bottom: 3%; margin-left: 36pt;\"> No unprivileged will or codicil, nor any part thereof, shall be revoked <span style=\"font-style: italic;\">otherwise than by marriage<\/span>, or by another will or codicil, or by some writing declaring an intention to revoke the same and executed in the manner in which an unprivileged will is herein before required to be executed, or by the burning, tearing, or otherwise destroying the same by the testator or by some person in his presence and by his direction with the intention of revoking the same.<\/p>\n<p style=\"margin-bottom: 3%;\">Since this is a pre-independence statute there are no records of any parliamentary debates on the Act or the specific sections. It is also interesting to note that the provisions have never really been tested in the courts of law barring a couple of occasions.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-style: italic;\">Kalyan Kumar Nag<\/span> v. <span style=\"font-style: italic;\">Dina Guha<\/span><a id=\"fnref5\" href=\"#fn5\" title=\"5. 1973 SCC OnLine Bom 127.\"><sup>5<\/sup><\/a>, the Bombay High Court after discussing the provisions of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558880\" target=\"_blank\">21<\/a><a id=\"fnref6\" href=\"#fn6\" title=\"6. Special Marriage Act, 1954, S. 21.\"><sup>6<\/sup><\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002835344\" target=\"_blank\">Special Marriage Act, 1954<\/a><a id=\"fnref7\" href=\"#fn7\" title=\"7. Special Marriage Act, 1954.\"><sup>7<\/sup><\/a> (SMA) vis-&agrave;-vis Sections 57<a id=\"fnref8\" href=\"#fn8\" title=\"8. Succession Act, 1925, S. 57.\"><sup>8<\/sup><\/a>, 69 and 70 of the ISA came to a conclusion that in case of Hindus who marry under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002835344\" target=\"_blank\">Special Marriage Act, 1954<\/a> the marriage would result in revocation of the will.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-style: italic;\">Suraj Lamp &amp; Industries (P) Ltd. (2)<\/span> v. <span style=\"font-style: italic;\">State of Haryana<\/span><a id=\"fnref9\" href=\"#fn9\" title=\"9. (2012) 1 SCC 656.\"><sup>9<\/sup><\/a> only makes a fleeting reference to Sections 69 and 70 of the ISA while discussing on the scope of a will in that a will would stand revoked on marriage.<a id=\"fnref10\" href=\"#fn10\" title=\"10. Suraj Lamp &amp; Industries case, (2012) 1 SCC 656, para 22.\"><sup>10<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-style: italic;\">Rupinder Singh<\/span> v. <span style=\"font-style: italic;\">Sita Devi<\/span><a id=\"fnref11\" href=\"#fn11\" title=\"11. 2023 SCC OnLine P&amp;H 6939.\"><sup>11<\/sup><\/a> while quoting <span style=\"font-style: italic;\">Kalyan Kumar Nag<\/span> judgment<a id=\"fnref12\" href=\"#fn12\" title=\"12. 1973 SCC OnLine Bom 127.\"><sup>12<\/sup><\/a> came to a conclusion that Section 70 has no application in the case of wills executed by a Hindu, Buddhist, Sikh or Jain.<\/p>\n<p style=\"margin-bottom: 3%;\">In order to understand the meaning and scope of Sections 69 and 70 of the ISA, one would necessarily have to resort to also understanding Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558880\" target=\"_blank\">21<\/a><a id=\"fnref13\" href=\"#fn13\" title=\"13. Special Marriage Act, 1954, S. 21.\"><sup>13<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558881\" target=\"_blank\">21-A<\/a><a id=\"fnref14\" href=\"#fn14\" title=\"14. Special Marriage Act, 1954, S. 21-A.\"><sup>14<\/sup><\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002835344\" target=\"_blank\">Special Marriage Act, 1954<\/a>, Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001555643\" target=\"_blank\">57<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001555644\" target=\"_blank\">58<\/a><a id=\"fnref15\" href=\"#fn15\" title=\"15. Succession Act, 1925, S. 58.\"><sup>15<\/sup><\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002835343\" target=\"_blank\">Succession Act, 1925<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558880\" target=\"_blank\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002835344\" target=\"_blank\">Special Marriage Act, 1954<\/a> provides that notwithstanding any restrictions contained in the ISA with respect to its application to certain communities, succession of any person whose marriage is solemnised under the SMA shall be regulated by the provisions of the ISA.<\/p>\n<p style=\"margin-bottom: 3%;\">Section 21-A of the SMA provides that where the marriage is solemnised under the SMA of any person who professes Hindu, Sikh, Buddhist or Jain religion with a person who professes Hindu, Sikh, Buddhist or Jain religion, Sections 19<a id=\"fnref16\" href=\"#fn16\" title=\"16. Special Marriage Act, 1954, S. 19.\"><sup>16<\/sup><\/a>, 21 and a part of Section 20<a id=\"fnref17\" href=\"#fn17\" title=\"17. Special Marriage Act, 1954, S. 20.\"><sup>17<\/sup><\/a> of the SMA shall not apply.<a id=\"fnref18\" href=\"#fn18\" title=\"18. Special Marriage Act, 1954, S. 21-A.\"><sup>18<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Section 57 of the ISA provides for the section to be read with Schedule 3 of the ISA<a id=\"fnref19\" href=\"#fn19\" title=\"19. Succession Act, 1925, Sch. 3.\"><sup>19<\/sup><\/a> including the restrictions and modifications provided therein and states that the provisions under testamentary succession<a id=\"fnref20\" href=\"#fn20\" title=\"20. Succession Act, 1925, Sch. 3, Part VI.\"><sup>20<\/sup><\/a> shall apply to all wills and codicils made by Hindu, Buddhist, Sikh or Jains within the territories subject to the Lieutenant-Governor of Bengal and within the local limits of the ordinary original civil jurisdiction of the High Courts of Madras and Bombay.<a id=\"fnref21\" href=\"#fn21\" title=\"21. Succession Act, 1925, S. 57(a).\"><sup>21<\/sup><\/a> This also includes wills and codicils made outside these territories provided that it included immovable property situated in these territories.<a id=\"fnref22\" href=\"#fn22\" title=\"22. Succession Act, 1925, S. 57(b).\"><sup>22<\/sup><\/a> Further, it also extended to Hindu, Buddhist, Sikh and Jain to which those provisions are not applied by the first two clauses.<a id=\"fnref23\" href=\"#fn23\" title=\"23. Succession Act, 1925, S. 57(c).\"><sup>23<\/sup><\/a> The rider for all provisions of Section 57 however being that marriage shall not revoke the will or codicil.<\/p>\n<p style=\"margin-bottom: 3%;\">Section 58 of the ISA provides that provisions of Part VI shall not apply to testamentary succession to property of any Muhammadan nor to property of any Hindu, Sikh, Buddhist or Jain except those that fall under Section 57 of the ISA.<\/p>\n<p style=\"margin-bottom: 3%;\">Schedule 3 to the ISA provides the list of sections of Part VI that would be applicable to wills and codicils described in Section 57 wherein Section 70 is mentioned with a rider that in applying the said section the words &#8220;than by marriage or&#8221; shall be omitted.<\/p>\n<h2>Analysis<\/h2>\n<p style=\"\">A conjoint reading of all the aforesaid provisions would establish the following propositions:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">1. That the judgment of the Bombay High Court<a id=\"fnref24\" href=\"#fn24\" title=\"24. Kalyan Kumar Nag case, 1973 SCC OnLine Bom 127.\"><sup>24<\/sup><\/a> is of the year 1974 therefore the reliance upon the same by the Punjab &amp; Haryana High Court<a id=\"fnref25\" href=\"#fn25\" title=\"25. Rupinder Singh case, 2023 SCC OnLine P&amp;H 6939\"><sup>25<\/sup><\/a> is erroneous since the Court lost sight of the insertion of Section 21-A in the SMA vide Amendment in 1976.<a id=\"fnref26\" href=\"#fn26\" title=\"26. Special Marriage Act, 1954, S. 21-A).\"><sup>26<\/sup><\/a><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">2. That though the general rule per Sections 69 and 70 is that a will stands revoked on marriage of the testator, the same is subject to the religion\/faith of the testator and restrictions contained in Sections 57 and 58 of the ISA.<\/p>\n<h2>Conclusion<\/h2>\n<p style=\"margin-bottom: 3%;\">The conundrum, in my opinion, is the paradox of the concept of the will when juxtaposed with the restriction imposed on it due to marriage. A will by definition is a statement of the intention of the testator concerning bequeathing his property. The fact that the same stands revoked automatically by marriage of the testator indicates that the makers of the statute necessarily wanted the testator to rethink on his bequest due to change of his\/her status. Whether this is warranted or not is certainly debatable since there appears to be an implied assertion that a rethink is mandated on change of status. This, I feel goes against the very element of free and independent will which stands compromised due to an automatic revocation of the will. No doubt, the testator can always make another will containing the same bequest as before however this very exercise if needs to be undertaken goes against the essence of what a will stands for.<\/p>\n<\/div>\n<hr\/>\n<p style=\"margin-left: 18pt; text-indent: -18pt;\"><strong><span style=\"color: #000080;\">*Advocate-on-Record, Supreme Court of India.<\/span><\/strong><\/p>\n<p
