The draft released for <span style=\"font-weight: bold;\">public consultation<\/span> aims to bring the Indian legal profession in line with contemporary global standards, enhance transparency, and introduce stricter regulatory mechanisms.<\/p>\n<h2>Public comments are invited until February 28, 2025.<\/h2>\n<h3>Key Highlights of the Proposed Amendments:<\/h3>\n<p style=\"font-weight: bold; font-size: 12pt;\">1. Expansion of Legal Practitioner Definition<\/p>\n<p style=\"margin-bottom: 3%;\">The Bill proposes to <span style=\"font-weight: bold;\">broaden the definition of &#8220;legal practitioner&#8221;<\/span> (Section 2) to include not just advocates practicing in courts but also corporate lawyers, in-house counsels, and those engaged in legal work in <span style=\"font-weight: bold;\">private and public organizations, statutory bodies, and foreign law firms<\/span>.<\/p>\n<p style=\"font-weight: bold; font-size: 12pt;\">2. Mandatory Bar Association Registration<\/p>\n<p style=\"margin-bottom: 3%;\">A new <span style=\"font-weight: bold;\">Section 33A<\/span> mandates that all advocates practicing before courts, tribunals, or authorities must register with a <span style=\"font-weight: bold;\">Bar Association<\/span> where they primarily practice. In case of a change in location or field of law, the advocate must notify the previous Bar Association within 30 days. Advocates will be allowed to vote in only <span style=\"font-weight: bold;\">one Bar Association<\/span>.<\/p>\n<p style=\"font-weight: bold; font-size: 12pt;\">3. Ban on Court Boycotts and Strikes<\/p>\n<p style=\"margin-bottom: 3%;\">A significant inclusion is <span style=\"font-weight: bold;\">Section 35A<\/span>, which <span style=\"font-weight: bold;\">prohibits advocates and Bar Associations from calling for or participating in strikes or boycotts<\/span> of court proceedings. Any violation will be deemed professional misconduct, attracting disciplinary action. However, <span style=\"font-weight: bold;\">symbolic or one-day protests<\/span> on professional or administrative issues are permitted, provided they do not disrupt court work.<\/p>\n<p style=\"font-weight: bold; font-size: 12pt;\">4. Government Oversight and Regulation<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Government-Nominated Members in BCI:<\/span> Section 4 of the Act is proposed to be amended to allow the <span style=\"font-weight: bold;\">Central Government to nominate up to three members<\/span> to the Bar Council of India (BCI), in addition to the existing elected members.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Power to Issue Directions:<\/span> The Bill introduces <span style=\"font-weight: bold;\">Section 49B<\/span>, granting the <span style=\"font-weight: bold;\">Central Government the authority to direct the BCI<\/span> in implementing provisions of the Act and its regulations.<\/p>\n<\/li>\n<\/ul>\n<p style=\"font-weight: bold; font-size: 12pt;\">5. Stricter Disciplinary Measures &amp; Misconduct Liabilities<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Enhanced Penalty for Unauthorized Practice:<\/span> Under <span style=\"font-weight: bold;\">Section 45<\/span>, those practicing law without proper authorization could face <span style=\"font-weight: bold;\">imprisonment up to one year<\/span> (earlier six months) and\/or a fine up to <span style=\"font-weight: bold;\">&#8377;2 lakh<\/span>.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Liability for Advocate Misconduct (Section 45B):<\/span> If a person suffers a loss due to an advocate&#8217;s misconduct, they can <span style=\"font-weight: bold;\">file a complaint under the regulations prescribed by the BCI<\/span> to determine liability.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Removal from State Roll (Section 24B):<\/span> Advocates convicted of offences with imprisonment of <span style=\"font-weight: bold;\">three years or more<\/span> will be removed from the <span style=\"font-weight: bold;\">State Bar Council&#8217;s roll<\/span>. Re-enrollment may be considered two years after release, subject to BCI approval.<\/p>\n<\/li>\n<\/ul>\n<p style=\"font-weight: bold; font-size: 12pt;\">6. Verification and Professional Oversight<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Mandatory Certificate &amp; Place of Practice Verification:<\/span> The Bill proposes periodic verification of advocates&#8217; credentials, including <span style=\"font-weight: bold;\">degrees, addresses, and workplaces<\/span>.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Foreign Law Firms &amp; Practitioners:<\/span> The <span style=\"font-weight: bold;\">entry of foreign law firms<\/span> and lawyers into India will be regulated through rules framed by the <span style=\"font-weight: bold;\">Central Government<\/span>.<\/p>\n<\/li>\n<\/ul>\n<p style=\"font-weight: bold; font-size: 12pt;\">7. Legal Education &amp; Professional Training<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>The BCI will oversee the <span style=\"font-weight: bold;\">recognition and regulation of law firms<\/span> and introduce <span style=\"font-weight: bold;\">mandatory pre- and post-enrollment training<\/span> for law graduates.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Bar Examination (Section 2)<\/span>: The Bill reinforces the requirement for clearing the <span style=\"font-weight: bold;\">All-India Bar Examination<\/span> or other prescribed tests before full practice rights are granted.<\/p>\n<\/li>\n<\/ul>\n<p style=\"font-weight: bold; font-size: 12pt;\">9. Verification of Advocates&#8217; Credentials (New Section 19A &amp; 7(da))<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Advocates must undergo <span style=\"font-weight: bold;\">periodic verification<\/span> of their degrees, credentials, and place of practice every <span style=\"font-weight: bold;\">five years<\/span>.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Fake or forged degrees<\/span> will lead to <span style=\"font-weight: bold;\">disqualification<\/span>.<\/p>\n<\/li>\n<\/ul>\n<p style=\"font-weight: bold; font-size: 12pt;\">10. Women Representation in Bar Council of India<\/p>\n<p style=\"margin-bottom: 3%;\">To promote diversity, the bill mandates <span style=\"font-weight: bold;\">at least two women members in the BCI<\/span>, co-opted from eminent female advocates.
