{"id":340110,"date":"2025-01-30T18:00:30","date_gmt":"2025-01-30T12:30:30","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=340110"},"modified":"2025-01-30T18:04:31","modified_gmt":"2025-01-30T12:34:31","slug":"art-224-a-supreme-court-relaxes-conditions-for-ad-hoc-judges-appointment-in-high-courts","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/01\/30\/art-224-a-supreme-court-relaxes-conditions-for-ad-hoc-judges-appointment-in-high-courts\/","title":{"rendered":"Art. 224-A | Supreme Court allows appointment of Judges to High Courts on ad-hoc basis; Relaxes conditions considering high pendency of cases"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Supreme Court:<\/span> The three-Judge Bench comprising Sanjiv Khanna, CJI and BR Gavai, and Surya Kant, JJ. relaxed the conditions for appointments of ad-hoc Judges in High Courts and directed that the High Courts can recommend the appointment of retired Judges on an ad-hoc basis to tackle pendency and clear the backlog of pending cases, which is mostly high in criminal matters.<\/p>\n<p style=\"margin-bottom: 3%;\">Further, the Bench also laid down that each High Court can appoint two to five Judges and in any case, the number should not exceed 10 percent of the sanctioned strength.<\/p>\n<p style=\"margin-bottom: 3%;\">Earlier in 2021, the Court in <span style=\"font-style: italic;\">Lok Prahari<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/SmVJ95qb\" target=\"_blank\">(2021) 15 SCC 80<\/a>, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/04\/22\/ad-hoc-judges-to-be-appointed-to-deal-with-unprecedented-pendency-of-cases-in-high-courts-supreme-court-issues-guidelines-and-trigger-points-for-activation-of-dormant-article-224a\/\" target=\"_blank\">activated the &#8220;dormant&#8221; Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574967\" target=\"_blank\">224-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution of India<\/a> and issued some general guidelines for the appointment of ad- hoc Judges to deal with the unprecedented situation arising from the backlog of cases pending in the High Courts<\/a>. The Court stated that certain checks and balances must be provided so that Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574967\" target=\"_blank\">224-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution of India<\/a> can be resorted to only on the process having being initiated for filling up of the regular vacancies and awaiting their appointments.<\/p>\n<p>The Court therein, held that though the discretion of the Chief Justice of the High Court under Article 224-A was not constrained, it can be exercised under following circumstances:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>If the vacancies are more than 20% of the sanctioned strength.<\/p>\n<\/li>\n<li>\n<p>The cases in a particular category are pending for over five years.<\/p>\n<\/li>\n<li>\n<p>More than 10% of the backlog of pending cases are over five years old.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">The percentage of the rate of disposal is lower than the institution of the cases either in a particular subject matter or generally in the Court.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Lok Prahari v.
