ABOUT THE SEMINAR<\/h3>\n

The Faculty of Law, University of Lucknow is organising a National Seminar “Parental Incarceration And The Hidden Toll On The Well Being Of The Child: Issues, Challenges And Way Forward<\/span>” on 1st March 2025.<\/p>\n

The seminar is conducted under the Centre of Excellence scheme sponsored by the Uttar Pradesh Government to study the impact of parental incarceration on the well-being of children. Family members of incarcerated individuals are often referred to as “hidden victims” — victims of the criminal justice system who are neither acknowledged nor given a platform to be heard.<\/p>\n

These hidden victims receive little personal support and do not benefit from the systemic societal mechanisms generally available to direct crime victims, despite their prevalence and their similarities to direct crime victims.<\/p>\n

Children whose parents are involved in the criminal justice system, in particular, face a host of challenges and difficulties: psychological strain, antisocial behaviour, suspension or expulsion from school, economic hardship, and criminal activity. It is difficult to predict how a child will fare when a parent is intermittently or continually incarcerated.<\/p>\n

Parent’s incarceration poses several threats to a child’s emotional, physical, educational, and financial well-being. There is particular concern that a parent’s imprisonment will lead to a cycle of intergenerational criminal behavior. Having a parent in prison can have an impact on a child’s mental health, social behavior, and educational prospects. The emotional trauma that may occur and the practical difficulties of a disrupted family life can be compounded by the social stigma that children may face as a result of having a parent in prison or jail.<\/p>\n

Children who have an incarcerated parent may experience financial hardship that results from the loss of that parent’s income. Further, some incarcerated parents face termination of parental rights because their children have been in the foster care system beyond the time allowed by law or have questions about child support. These children require support from local, state, and federal systems to serve their needs<\/p>\n
