{"id":338737,"date":"2025-01-09T16:00:23","date_gmt":"2025-01-09T10:30:23","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=338737"},"modified":"2025-01-15T10:56:28","modified_gmt":"2025-01-15T05:26:28","slug":"bombay-hc-refuses-exercise-of-jurisdiction-section-482-crpc-ends-of-justice-will-not-be-met","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/01\/09\/bombay-hc-refuses-exercise-of-jurisdiction-section-482-crpc-ends-of-justice-will-not-be-met\/","title":{"rendered":"\u2018Ends of justice would not be met by quashing FIRs\u2019; Bombay HC refuses to exercise jurisdiction under S. 482, CrPC"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Bombay High Court:<\/span> In a batch of writ petitions wherein the petitioners in the first petition had approached the Court to quash\/de-register the criminal proceedings based on a First Information Report (&#8216;FIR&#8217;) under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803451\" target=\"_blank\">115(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803714\" target=\"_blank\">352<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803768\" target=\"_blank\">79<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803655\" target=\"_blank\">3(5)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\">Bharatiya Nyaya Sanhita, 2023<\/a> (&#8216;BNS&#8217;), a Division Bench of <span style=\"font-weight: bold;\">Ravindra V. Ghuge*<\/span> and Rajesh S. Patil, JJ., held that specific contentions of offences were made out in the FIRs and ends of justice would not be met by quashing the same.<\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">The complainant, a Muslim lady, and her family were preparing to visit the market on the day of the incident for her brother&#8217;s marriage. The accused was sitting with his mother in the pandal for a religious event being organised by a community of people belonging to Hindu religion .The complainant approached the accused&#8217;s mother and said that this was all wrong. Hearing this, the accused along with three others abused the complainant in foul and filthy language. The dispute eventually resulted in a physical altercation wherein the accused assaulted the male relatives of the complainant, her mother, and her friend. Aggrieved by this, the complainant lodged the above-mentioned FIR. Consequently, the accused filed a counter FIR.<\/p>\n<p style=\"margin-bottom: 3%;\">Now, both parties desired to live peacefully and had decided to settle the issue. Thus, they sought quashing of the FIRs and the proceedings therein.<\/p>\n<p style=\"margin-bottom: 3%;\">However, the State contended that the present case was not a criminal case arising out of a commercial transaction or having overwhelmingly and pre-dominantly civil character or arising out of matrimonial relationship or family disputes, which could be quashed when the parties came together. Thus, it was contended that the scope of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">Code of Criminal Procedure, 1973<\/a> (&#8216;CrPC&#8217;) should not be enlarged to include the present case.<\/p>\n<h3>Analysis<\/h3>\n<p style=\"margin-bottom: 3%;\">By placing reliance on <span style=\"font-style: italic;\">Narinder Singh (supra)<\/span>, <span style=\"font-style: italic;\">Rajeev Kourav<\/span> v. <span style=\"font-style: italic;\">Baisahab<\/span> <a href=\"http:\/\/www.scconline.com\/DocumentLink\/9YXiZyso\" target=\"_blank\">(2020) 3 SCC 317<\/a>, <span style=\"font-style: italic;\">Kaptan Singh<\/span> v. <span style=\"font-style: italic;\">State of U.P.<\/span> <a href=\"http:\/\/www.scconline.com\/DocumentLink\/vdS3IUI4\" target=\"_blank\">(2021) 9 SCC 35<\/a> and <span style=\"font-style: italic;\">State of Odisha<\/span> v. <span style=\"font-style: italic;\">Pratima Mohanty<\/span> <a href=\"http:\/\/www.scconline.com\/DocumentLink\/3dZo24HD\" target=\"_blank\">(2022) 16 SCC 703<\/a>, the Court held that the present case needed to be tried before the competent Court and stated that the process of law would take its course through the trial.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further held that it was not convinced to exercise its jurisdiction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\">482<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a> and that the ends of justice would not be met by quashing the FIRs.<\/p>\n<p style=\"margin-bottom: 3%;\">Holding this, the Court dismissed the petitions.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Vijay Rambabu Sonkar v.
