The provisions will come into force on 1-4-2025.<\/p>\n<h3>Key Points:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p style=\"font-weight: bold;\">Rules apply to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>the producer, registered owner of vehicles, bulk consumers, Registered Vehicle Scrapping Facility, collection centres, automated testing stations and entities involved in testing of vehicles, handling, processing and scrapping of End-of-Life vehicles, but will not apply to:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>\n<p>waste batteries covered under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001235166\" target=\"_blank\">Battery Waste Management Rules, 2022<\/a>;<\/p>\n<\/li>\n<li>\n<p>plastic packaging as covered under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000131671\" target=\"_blank\">Plastic Waste Management Rules, 2016<\/a>;<\/p>\n<\/li>\n<li>\n<p>waste tyres and used oil as covered under <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000053865\" target=\"_blank\">Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016<\/a>;<\/p>\n<\/li>\n<li>\n<p>E-waste as covered under <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001302857\" target=\"_blank\">E-Waste (Management) Rules, 2022<\/a>.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>all types of vehicles including an electric vehicle, battery operated vehicle, e-rikshaw or e-cart, but will not apply to:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>\n<p>agricultural tractor;<\/p>\n<\/li>\n<li>\n<p>agricultural trailer;<\/p>\n<\/li>\n<li>\n<p>combine harvester; and<\/p>\n<\/li>\n<li>\n<p>power tiller.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Responsibilities of producer:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>fulfil the obligation of <span style=\"font-weight: bold;\">Extended Producer Responsibility (&#8216;EPR&#8217;)<\/span> for the vehicles that the producer has introduced or introduces in the domestic market;<\/p>\n<\/li>\n<li>\n<p>meet the scrapping targets of End-of-Life vehicles;<\/p>\n<\/li>\n<li>\n<p>take necessary measures to encourage End-of-Life vehicles are deposited at the <span style=\"font-weight: bold;\">Registered Vehicle Scrapping Facility (&#8216;RVSF&#8217;)<\/span> or designated Collection Centres;<\/p>\n<\/li>\n<li>\n<p>declare its EPR obligations for the current year by 30th April of the same year to the Central Board;<\/p>\n<\/li>\n<li>\n<p>take measures for sustainable production of vehicles including in accordance with the guidelines issued by the Central Board;<\/p>\n<\/li>\n<li>\n<p>take measures to comply with the provisions of AIS-129, as published by the Central Government under <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000083892\" target=\"_blank\">Central Motor Vehicles Rules, 1989<\/a>.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Responsibilities of registered owner and bulk consumer:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>ensure that the vehicle is tested in accordance with the Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001569667\" target=\"_blank\">56<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726964\" target=\"_blank\">Motor Vehicles Act, 1988<\/a> and Rule 52 of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000083892\" target=\"_blank\">Central Motor Vehicles Rules, 1989<\/a>;<\/p>\n<\/li>\n<li>\n<p>deposit the End-of-Life vehicle at any of the producer&#8217;s designated sales outlet or designated Collection Centre or RVSF within a period of 180 days from the date the vehicle becomes the End-of-Life vehicle.<\/p>\n<\/li>\n<li>\n<p>The End-of-Life vehicle cannot be kept beyond 180 days from the date it becomes End-of-Life vehicle.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Responsibilities of Collection Centre:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>It has to collect and store End-to-Life vehicles and send them to RVSF.<\/p>\n<\/li>\n<li>\n<p>maintain the records of the End-of-Life vehicle;<\/p>\n<\/li>\n<li>\n<p>handle the End-of-Life Vehicles in an environmentally sound manner.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Responsibilities of RVSF:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Safe storage of various categories of wastes in separate bins;<\/p>\n<\/li>\n<li>\n<p>Recycling and refurbishment of materials;<\/p>\n<\/li>\n<li>\n<p>Send End-of-Life vehicles for scrapping and carry out treatment\/ depolluting\/ dismantling\/ segregation;<\/p>\n<\/li>\n<li>\n<p>Send recovered and segregated materials to registered recyclers for reuse of components\/ materials;<\/p>\n<\/li>\n<li>\n<p>Send all non-recyclable material to Common Hazard Waste Treatment, Storage and Disposable Facility;<\/p>\n<\/li>\n<li>\n<p>Exchange the EPR certificates upon processing of every End-of Life vehicle based on the quantity of steel;<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">EPR certificate:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Central Board will issue the certificate through centralized online portal in Favour of RVSF.<\/p>\n<\/li>\n<li>\n<p>A Producer can purchase EPR certificate limited to its EPR obligation of current year plus any leftover obligation of preceding years.<\/p>\n<\/li>\n<li>\n<p>An EPR certificate purchased by the producer is not transferrable to any other producer. An EPR certificate generated by the RVSF shall be valid for a period of 5 years for meeting the obligations of producer under these rules.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The registration applications will be made in:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Producer will make an application in <span style=\"font-weight: bold;\">Form 4<\/span> to the Central Board.<\/p>\n<\/li>\n<li>\n<p>Registered Vehicle Scrapping Facility and bulk consumer will make an application in <span style=\"font-weight: bold;\">Form 5<\/span> and <span style=\"font-weight: bold;\">Form 6<\/span> to the State Board.<\/p>\n<\/li>\n<li>\n<p>Central Board\/ State Board will issue a certificate of registration in <span style=\"font-weight: bold;\">Form 7<\/span> and <span style=\"font-weight: bold;\">Form 8<\/span> within 15 from the receipt of application.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p style=\"font-style: italic;\">Any vehicle which becomes an End-of-Life vehicle cannot be kept for more than 180
