Allahabad High Court:<\/span> A Division Bench of Attau Rahman Masoodi and Subhash Vidyarthi, JJ, dismissed a Public Interest Litigation (PIL) challenging the removal motion moved against sitting judge Justice Shekhar Kumar Yadav for his controversial remarks against Muslims.<\/p>\n

Justice Yadav came under scrutiny after making controversial remarks during a speech at an event organized by the legal cell of the right-wing organization, Vishwa Hindu Parishad (VHP). In his speech, the judge reportedly stated that India would operate according to the wishes of the majority community and used derogatory language, including the term “kathmullah”, which is a slur against Muslims. Following this speech, there was widespread demand for his judicial work to be reassigned and calls for removal grew louder. In response to these demands, the Allahabad High Court implemented a roster change, limiting Justice Yadav to hearing first appeals, specifically those arising from district court orders, and only those filed up to 2010.<\/p>\n

The controversy escalated further when Member of Parliament (MP) Kapil Sibal, along with 54 other MPs, moved a removal motion against Justice Yadav.<\/p>\n

In the PIL filed in connection with the motion, Advocate Asok Pande sought a directive to the Chairman of the Rajya Sabha, urging him not to act on the removal motion.<\/p>\n
