{"id":336245,"date":"2024-11-29T17:30:55","date_gmt":"2024-11-29T12:00:55","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=336245"},"modified":"2024-11-29T17:21:11","modified_gmt":"2024-11-29T11:51:11","slug":"no-further-proceedings-in-sambhal-masjid-case-sc-defers-hearing","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/11\/29\/no-further-proceedings-in-sambhal-masjid-case-sc-defers-hearing\/","title":{"rendered":"SC asks Trial Court to defer hearing till Sambhal Mosque Survey Order is challenged before HC"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Supreme Court:<\/span> In a plea by the Sambhal Jama Masjid Committee against the survey of the Sambhal Jama Masjid, ordered by the Trial Court, the Division Bench of Chief Justice of India Sanjiv Khanna and Sanjay Kumar, J. &nbsp;directed the Trial Court not to proceed in the suit against the Mosque till any petition filed by the Masjid Committee against the survey order is listed before the Allahabad High Court.<\/p>\n<p style=\"margin-bottom: 3%;\">The Trial Court, in the impugned order directed for the survey of the Mosque by an Advocate Commissioner in a suit which claimed that the mosque was built after destroying a pre-existing temple.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also directed that the report of the Advocate Commissioner, who surveyed the Mosque, should be kept in a sealed cover.<\/p>\n<p style=\"margin-bottom: 3%;\">The Bench also pressed the need to maintain peace amongst the communities in the Sambhal District.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court directed that if any petition is filed by the Mosque Committee before the High Court, the same should be listed within three working days.<\/p>\n<p style=\"margin-bottom: 3%;\">Source: Press<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Committee of Management, Shahi Jama Masjid, Sambhal v.
