Have you come across products branded as &#8220;sustainable&#8221;, &#8220;carbon clean&#8221;, &#8220;net zero&#8221;, &#8220;renewable&#8221;, &#8220;recyclable&#8221;, &#8220;plastic-free&#8221;, &#8220;100% natural&#8221;, &#8220;climate positive&#8221;, etc.? Have you ever questioned the legality of making such &#8220;green&#8221; claims or pondered over how or what can be said, when making any environment-friendly claims?<\/p>\n<p style=\"margin-bottom: 3%;\">The Consumer Ministry has the answers.<\/p>\n<p style=\"margin-bottom: 3%;\">The Central Consumer Protection Authority (CCPA) issued the Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (Guidelines)<a id=\"fnref1\" href=\"#fn1\" title=\"1. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024).\"><sup>1<\/sup><\/a> on 15-10-2024.<\/p>\n<p style=\"margin-bottom: 3%;\">The Guidelines were issued to ensure that environmental claims made in advertisements are kosher and do not mislead consumers or amount to greenwashing.<a id=\"fnref2\" href=\"#fn2\" title=\"2. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 4.\"><sup>2<\/sup><\/a> Advertisements, as per the CCPA, are broad enough to include any publicity, representation, endorsement, or pronouncement made in audio, and\/or visual form across any medium.<a id=\"fnref3\" href=\"#fn3\" title=\"3. Consumer Protection Act, 2019, S. 2(1) (CPA) defines &#8220;advertisement&#8221; to mean any publicity, representation, endorsement or pronouncement, whether audio or visual that is made through light, sound, smoke, gas, print, electronic media, internet or website. This includes any notice, circular, label, wrapper, invoice or such other documents.\"><sup>3<\/sup><\/a> Hence, the Guidelines would cover any content, including marketing material, press releases, etc., released by a company with respect to a product or service. For this, the CCPA has placed liability and accountability on the manufacturers, service providers, traders, advertisers, and endorsers of goods, products, and services who make such environmental claims.<\/p>\n<p style=\"margin-bottom: 3%;\">In this article, we will examine some key provisions of the Guidelines and lay out the dos and don&#8217;ts for making environmental claims in advertising.<\/p>\n<h4 style=\"background-image: linear-gradient(to left, #FFFFFF, rgb(121, 164, 210));\">What are environmental claims?<\/h4>\n<p style=\"\">The Guidelines define &#8220;environmental claims&#8221; as representation in any form that:<a id=\"fnref4\" href=\"#fn4\" title=\"4. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 2(e).\"><sup>4<\/sup><\/a><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">a<\/span>) suggests environmentally friendly attributes;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">b<\/span>) which are aimed to convey a sense of environmental responsibility; and<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(<span style=\"font-style: italic;\">c<\/span>) regarding goods (in entirety or as a component), manufacturing processes, packaging, manner of use or disposal of goods, services (or any part of the service), or the process involved in providing the service.<\/p>\n<h4 style=\"background-image: linear-gradient(to left, #FFFFFF, rgb(121, 164, 210));\">What is greenwashing?<\/h4>\n<p style=\"\">&#8220;Greenwashing&#8221; has been defined as<a id=\"fnref5\" href=\"#fn5\" title=\"5. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 2(f).\"><sup>5<\/sup><\/a>:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">i<\/span>) any deceptive or misleading practice by exaggerating, making vague, false or unsubstantiated environmental claims (<span style=\"font-style: italic;\">example<\/span>: Stating that the carbon footprint of a product is 80% lower than that of chemical equivalents without providing any data to back such a claim<a id=\"fnref6\" href=\"#fn6\" title=\"6. Refer to case of Proklean Technologies Private Limited - Profab Fabric Detergent at: &lt;https:\/\/www.ascionline.in\/complaint-outcomes-details\/?case_id=2024-3-6-6-C.27515&gt;\"><sup>6<\/sup><\/a>); or<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(ii) the use of misleading or deceptive words, symbols, imagery, etc. highlighting positive environmental aspects while downplaying\/concealing the harmful attributes (<span style=\"font-style: italic;\">example<\/span>: Highlighting the battery is eco-friendly without stating that the process to prepare the battery is not).<\/p>\n<p style=\"\">However, the following practices are not greenwashing:<a id=\"fnref7\" href=\"#fn7\" title=\"7. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 2(f).\"><sup>7<\/sup><\/a><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">i<\/span>) use of obvious hyperboles or puffery (<span style=\"font-style: italic;\">example<\/span>: &#8220;Experience the ultimate driving experience with our electric vehicle (EV) cars&#8221;); or<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">ii<\/span>) use of generic colour schemes or pictures that are not misleading or deceptive (<span style=\"font-style: italic;\">example:<\/span> Merely using a green colour scheme in the branding or advertisements for goods\/services in a manner that does not reflect on the environmental attributes of such goods\/services may not constitute greenwashing); or<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(<span style=\"font-style: italic;\">iii<\/span>) company mission statement that is not specific to a product or service (<span style=\"font-style: italic;\">example<\/span>: <span style=\"font-style: italic;\">XYZ<\/span> entity in its mission statement highlights that &#8220;its growth will be based on sustainable principles&#8221;. However, if the entity further states that &#8220;its products are manufactured in a sustainable manner&#8221;, it will need to provide data to substantiate the environmental claim about the product).<\/p>\n<h4 style=\"background-image: linear-gradient(to left, #FFFFFF, rgb(121, 164, 210));\">Applicability:<\/h4>\n<p style=\"\">The Guidelines apply to:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">i<\/span>) all Environmental Claims;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\"><span style=\"font-style: italic;\">(ii)<\/span> any manufacturer, service provider, or trader whose goods, products, or services are the subject of an advertisement; or<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(<span style=\"font-style: italic;\">iii<\/span>) advertising agencies<a id=\"fnref8\" href=\"#fn8\" title=\"8. Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022, Cl. 2(c) (Misleading Advertisement Guidelines) defines &#8220;advertising agency&#8221; to mean person or an establishment providing services in designing and production of advertisements or other related services for a commission or fee.\"><sup>8<\/sup><\/a> (e.g. any person or entity who designs or produces advertisements) or endorsers (e.g. actors or influencers or specialists in a specific field) whose services are availed for the advertisement of such goods, products and\/or services.<a id=\"fnref9\" href=\"#fn9\" title=\"9. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 3(b).\"><sup>9<\/sup><\/a><\/p>\n<h4 style=\"background-image: linear-gradient(to left, #FFFFFF, rgb(121, 164, 210));\">The do&#8217;s and don&#8217;ts:<\/h4>\n<p style=\"font-style: italic; background-image: linear-gradient(to left, #FFFFFF, rgb(236, 198, 198));\">Don&#8217;ts:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">i<\/span>) Engage in greenwashing and misleading environmental claims.<a id=\"fnref10\" href=\"#fn10\" title=\"10. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 4.\"><sup>10<\/sup><\/a><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">ii<\/span>) Selectively present research to highlight favourable findings and conceal unfavourable ones<a id=\"fnref11\" href=\"#fn11\" title=\"11. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 6(2).\"><sup>11<\/sup><\/a> (example: A &#8220;biodegradable&#8221; claim highlighting that research concluded that the product is made of biodegradable material while concealing the finding that such material may take up to 10 years to decompose.).<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(<span style=\"font-style: italic;\">iii<\/span>) Make disclosures that are contradictory to the environmental claim.<a id=\"fnref12\" href=\"#fn12\" title=\"12.15-10-2024), Cl. 6(6)(ii).\"><sup>12<\/sup><\/a> (Example: Research reports\/certificates disclosed to substantiate a claim that a product is energy efficient shall not contain observations that are contradictory to such claim.)<\/p>\n<p style=\"font-style: italic; background-image: linear-gradient(to left, #FFFFFF, rgb(236, 198, 198));\">Do&#8217;s:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">i<\/span>) Provide substantiation of environmental claims:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">a<\/span>) Advertisements using generic terms like &#8220;clean&#8221;, &#8220;green&#8221;, &#8220;eco-friendly&#8221;, &#8220;cruelty free&#8221;, &#8220;organic&#8221;, etc., should have adequate, accurate and accessible qualifiers and substantiation.<a id=\"fnref13\" href=\"#fn13\" title=\"13. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 5(a).\"><sup>13<\/sup><\/a> (Example: &#8220;Go green with our product!&#8221;. This claim is unclear as it does not clarify what the word &#8220;green&#8221; conveys. Thus, adequate qualifiers in the form of what is green and substantiation in the form of certificates from labs, etc. would need to be provided.)<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">b<\/span>) All environmental claims should be supported by &#8220;accessible verifiable evidence&#8221; based on independent studies or third-party certifications.<a id=\"fnref14\" href=\"#fn14\" title=\"14. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 5(c).\"><sup>14<\/sup><\/a> (Example: A product labelled as &#8220;certified organic&#8221; should be supported by a certificate from a recognised organic certifying body.)<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">c<\/span>) Aspirational claims must be backed by clear and actionable plans to achieve them.<a id=\"fnref15\" href=\"#fn15\" title=\"15. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 7.\"><sup>15<\/sup><\/a> (Example: A forward-looking claim stating &#8220;we will use at least 50% recycled material in our packaging by 2030&#8221; should be backed by actionable plans explaining how the company proposes to achieve them.<a id=\"fnref16\" href=\"#fn16\" title=\"16. Gonzalo E. Mon and Katie Rogers, DC Court of Appeals Revives Greenwashing Suit Over Aspirational Claims, available at &lt;DC Court of Appeals Revives Greenwashing Suit over Aspirational Claims| Kelley Drye &amp; Warren LLP&gt;.\"><sup>16<\/sup><\/a>)<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">ii<\/span>) Provide adequate disclosures: The Guidelines also require advertisements to carry adequate disclosures regarding any environmental claims made in the advertisement. What amounts to &#8220;adequate disclosure&#8221; has not been defined or crystallised, however, the Guidelines require:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">a<\/span>) Advertisements to provide all material information relating to any environmental claim in the advertisement itself or by inserting a quick response (QR) code or uniform resource locator (URL) (or similar technology)<a id=\"fnref17\" href=\"#fn17\" title=\"17. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 6(5).\"><sup>17<\/sup><\/a> (example: An advertisement stating the product is &#8220;recommended by leading environmental experts!&#8221;, should provide a QR code or link in the advertisement itself which can direct the consumer to an affidavit or such document proving that leading environmental experts have recommended the product.)<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">b<\/span>) Specific claims, like &#8220;non-toxic&#8221;, &#8220;100% natural&#8221;, &#8220;recyclable&#8221;, etc., to be supported by credible certification, reliable scientific evidence, statutory or independent third-party verification, etc.<a id=\"fnref18\" href=\"#fn18\" title=\"18. Refer to the case of Biodegradable Sanitary Napkins at: Complaint Outcomes Details - ASCI (Niine Private Limited case)\"><sup>18<\/sup><\/a> (Example: A claim that a sanitary napkin is &#8220;compostable and biodegradable&#8221;, will need to be backed by appropriate certificates issued by relevant Government or certification bodies.<a id=\"fnref19\" href=\"#fn19\" title=\"19. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 6(3).\"><sup>19<\/sup><\/a>)<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">iii<\/span>) Disclosures to be absolute, accessible and relevant:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">a<\/span>) Advertisements should specify which aspects the environmental claim refers to i.e. the service or the goods (or any part of it) or the process or packaging, etc.<a id=\"fnref20\" href=\"#fn20\" title=\"20. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 6(6)(i). net-zero emissions\"><sup>20<\/sup><\/a> (Example: A plastic package containing a shower curtain is labelled &#8220;recyclable&#8221;. This claim will need to clarify whether the package or the curtain or both are recyclable.)<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">b<\/span>) Advertisements should make disclosures in an accessible manner.<a id=\"fnref21\" href=\"#fn21\" title=\"21. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 5(b).\"><sup>21<\/sup><\/a> (Example: Disclosures should also be made accessible through audio for people with visual impairment.)<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">(<span style=\"font-style: italic;\">c<\/span>) Technical terms should be explained using consumer-friendly language.<a id=\"fnref22\" href=\"#fn22\" title=\"22. Guidelines for Prevention and Regulation of Greenwashing or Misleading Environmental Claims, 2024 (15-10-2024), Cl. 6(4).\"><sup>22<\/sup><\/a> (Example: An advertisement making a &#8220;net-zero emissions&#8221; claim should explain that emissions released through the activities of manufacturing its products are counterbalanced by its carbon-removal activities.)<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(<span style=\"font-style: italic;\">iv<\/span>) Fair and meaningful comparisons: For comparative claims, the advertisements should specify which aspects are being compared and support the same with verifiable and relevant data.<a id=\"fnref23\" href=\"#fn23\" title=\"23. Consumer Protection Act, 2019, Ss. 39 and 89.\"><sup>23<\/sup><\/a> (Example: &#8220;Our product is greener than the competition&#8221;. In such an environmental claim, the advertisement should specify the details about the environmental attributes being compared.)<\/p>\n<h4 style=\"background-image: linear-gradient(to left, #FFFFFF, rgb(121, 164, 210));\">Consequences of non-compliance:<\/h4>\n<p style=\"margin-bottom: 3%;\">The consequences of misleading advertisements under the CPA can be varied. These can range from a direction to issue a corrective advertisement or cease and desist from issuing misleading advertisements to hefty penalties or imprisonment in some cases.<a id=\"fnref24\" href=\"#fn24\" title=\"24. Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022, Cl. 12(a).\"><sup>24<\/sup><\/a><\/p>\n<h4 style=\"background-image: linear-gradient(to left, #FFFFFF, rgb(121, 164, 210));\">A step too far?<\/h4>\n<p style=\"\">While the Guidelines prescribe a robust framework to address greenwashing, the vastness of the obligations may be a cause of concern to advertisers. The Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022 (Misleading Advertisement Guidelines) already prescribe various obligations that may address concerns and compliances required to be fulfilled in the Guidelines. The Guidelines, however, take a step forward and impose certain additional positive obligations on advertisers.
