{"id":335890,"date":"2024-11-25T10:00:32","date_gmt":"2024-11-25T04:30:32","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=335890"},"modified":"2024-11-30T15:42:24","modified_gmt":"2024-11-30T10:12:24","slug":"custodial-statements-under-section-50-of-pmla-inadmissible-mp-high-court-grants-bail-scc-times","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/11\/25\/custodial-statements-under-section-50-of-pmla-inadmissible-mp-high-court-grants-bail-scc-times\/","title":{"rendered":"Custodial statements under Section 50 PMLA are inadmissible; MP High Court grants bail"},"content":{"rendered":"<style>\n.animate-charcter{background-image: linear-gradient(-225deg, #231557 0%, #44107a 29%, #ff1361 67%, #fff800 100%); background-size: 200% auto; -webkit-background-clip: text; -webkit-text-fill-color: transparent; animation: textclip 5s linear infinite;}\n@keyframes textclip {to {background-position: 200% center;}}\n<\/style>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Madhya Pradesh High Court:<\/span> In a bail application filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519740\" target=\"_blank\" rel=\"noopener\">439<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> (Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804220\" target=\"_blank\" rel=\"noopener\">483<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\" rel=\"noopener\">Bharatiya Nagarik Suraksha Sanhita, 2023<\/a>) and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534467\" target=\"_blank\" rel=\"noopener\">45<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">Prevention of Money Laundering Act, 2002<\/a> (PMLA), a single-judge bench of Prakash Chandra Gupta, J., held that the applicant&#8217;s arrest violated Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534438\" target=\"_blank\" rel=\"noopener\">19<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a>, and the twin conditions under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534467\" target=\"_blank\" rel=\"noopener\">45<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a> were not satisfied and granted bail on the grounds of procedural non-compliance and lack of substantive evidence.<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, a FIR registered on 16-06-2023 against the applicant and others for alleged offenses under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561754\" target=\"_blank\" rel=\"noopener\">417<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561758\" target=\"_blank\" rel=\"noopener\">420<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561375\" target=\"_blank\" rel=\"noopener\">120-B<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (IPC). The applicant is accused of fraudulently obtaining import authorizations for poppy seeds through benami entities, thereby violating guidelines of the Department of Revenue, Ministry of Finance.<\/p>\n<p style=\"margin-bottom: 3%;\">The Enforcement Directorate alleged that the proceeds of crime amount to &#8377;141.8\/- crores connected to money laundering under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534450\" target=\"_blank\" rel=\"noopener\">3<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534461\" target=\"_blank\" rel=\"noopener\">4<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a>. The applicant was arrested on 03-10-2024, but the Enforcement Directorate admitted to not summoning him or recording his statements before arrest.<\/p>\n<p style=\"margin-bottom: 3%;\">The applicant contended that his arrest violated Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534438\" target=\"_blank\" rel=\"noopener\">19<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a> due to non-recording of written reasons for arrest. It was argued that the Enforcement Directorate relied primarily on statements of co-accused, which are inadmissible as substantive evidence. It was contended that no material evidence or records were gathered from the licensing authority to support the allegations of fraud. The applicant cited <span style=\"font-style: italic;\">Prem Prakash<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Ox45jDdN\" target=\"_blank\" rel=\"noopener\">2024 SCC Online SC 2270<\/a> and <span style=\"font-style: italic;\">Pankaj Bansal<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/4wdg8fRG\" target=\"_blank\" rel=\"noopener\">2023 SCC Online SC 1244<\/a>, which emphasised on the compliance with procedural safeguards under PMLA before arrest and admissibility of evidence.<\/p>\n<p style=\"margin-bottom: 3%;\">On the other hand, the Enforcement Directorate contended that conditions under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534467\" target=\"_blank\" rel=\"noopener\">45<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a> must be satisfied before granting bail. It was contended that the Enforcement Directorate collected evidence linking the applicant to money laundering activities. However, the Enforcement Directorate admitted procedural lapses, including no custodial interrogation or prior summons.<\/p>\n<p style=\"margin-bottom: 2%;\">The Court noted that the Enforcement Directorate neither summoned nor recorded the applicant&#8217;s statement prior to arrest. The Court stated that statements of co-accused under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534473\" target=\"_blank\" rel=\"noopener\">50<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a>, made while in custody, are inadmissible against the applicant. The Court noted that the Enforcement Directorate&#8217;s findings of guilt was based on inadmissible statements of co-accused, with no independent corroboration from licensing authorities or other substantive evidence. The Court stated that non-compliance with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534438\" target=\"_blank\" rel=\"noopener\">19<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a> undermines the legitimacy of the arrest.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">&#8220;When an accused is in custody under PMLA irrespective of the case for which he is under custody, any statement under section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001534473\" target=\"_blank\" rel=\"noopener\">50<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801311\" target=\"_blank\" rel=\"noopener\">PMLA<\/a> to the same investigating agency is inadmissible against the maker. Furthermore, the arrest should be rational, fair and as per law and shall not be merely based upon guilt of accused established from inadmissible evidence.&#8221;<\/p>\n<p>The Court stated that no evidence indicated a likelihood of the applicant tampering with evidence or committing further offenses.
