Corresponding Section 61 of the Nyaya Sanhita, 2023 (&#8216;BNS, 2023&#8217;)\"><sup>1<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561462\" target=\"_blank\" rel=\"noopener\">182<\/a><a id=\"fnref2\" href=\"#fn2\" title=\"2. Section 217 of BNS, 2023\"><sup>2<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561474\" target=\"_blank\" rel=\"noopener\">193<\/a><a id=\"fnref3\" href=\"#fn3\" title=\"3. Section 229 of BNS, 2023\"><sup>3<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561756\" target=\"_blank\" rel=\"noopener\">419<\/a><a id=\"fnref4\" href=\"#fn4\" title=\"4. Section 319(2) of BNS, 2023\"><sup>4<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561758\" target=\"_blank\" rel=\"noopener\">420<\/a><a id=\"fnref5\" href=\"#fn5\" title=\"5. Section 318(4) of BNS, 2023\"><sup>5<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561810\" target=\"_blank\" rel=\"noopener\">468<\/a><a id=\"fnref6\" href=\"#fn6\" title=\"6. Section 336(3) of BNS, 2023\"><sup>6<\/sup><\/a>, read with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561652\" target=\"_blank\" rel=\"noopener\">34<\/a><a id=\"fnref7\" href=\"#fn7\" title=\"7. Section 3(5) of BNS, 2023\"><sup>7<\/sup><\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a>. A Single Judge Bench of S.G. Mehare, J., opined that even if the trial was not concluded within 60 days as prescribed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437(6)<\/a><a id=\"fnref8\" href=\"#fn8\" title=\"8. Corresponding Section 480 of the Nagarik Suraksha Sanhita, 2023 (&#8216;BNSS, 2023&#8217;)\"><sup>8<\/sup><\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> (&#8216;CrPC&#8217;), that did not give a right to bail for default and the term &#8220;shall&#8221; used in Section 437(6) was discretionary. The Court opined that as applicant had no good past, thus, apprehension of her absconding was also justifiable. Therefore, the Court dismissed the bail application.<\/p>\n<p style=\"margin-bottom: 3%;\">Counsel for applicant submitted that the trial was not concluded within 60 days from the first date fixed for taking evidence, thus, applicant deserved bail under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437(6)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>. It was submitted that the Trial Court rejected the bail application on the incorrect ground that two witnesses remained to be examined. It was further submitted that the word &#8220;shall&#8221; was used in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437<\/a><a id=\"fnref9\" href=\"#fn9\" title=\"9. Section 480 of BNSS, 2023\"><sup>9<\/sup><\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and so the Court should exercise the powers to give justice to the accused. Whereas counsel for respondent submitted that the word &#8220;shall&#8221; used in Section 437(6) was not mandatory.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court relied on <span style=\"font-style: italic;\">U.T. Worldwide India Pvt. Ltd.<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span>, 2007 All M.R. (Cri.) 300, wherein the Bombay High Court interpreted Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437(6)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and held that the power to grant bail under various sub-sections of Section 437 was discretionary and had to be exercised on sound judicial principles.<\/p>\n<p style=\"margin-bottom: 3%;\">This Court opined that the same principle would apply to bail under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437(6)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and thus, it could not be said that bail must be granted to the accused if the trial was not concluded within 60 days from the first date fixed for evidence. The Court opined that merely because the word &#8216;shall&#8217; was used in section, it did not mean that it was a mandate to do so and the word &#8216;unless.&#8230;..otherwise&#8217; in Section 437(6) could not be ignored. Even if 60 days were over, the Court had discretion to refuse the bail under Section 437(6), but for that reasons must be recorded.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court opined that where the trial was not concluded within 60 days as prescribed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437(6)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> that did not give a right to bail for default and the term &#8220;shall&#8221; used in Section 437(6) was discretionary. The Court stated that the courts should exercise such powers judiciously and should consider other circumstances as provided under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court opined that as applicant had no good past, thus, apprehension of her absconding was also justifiable.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the Trial Court was trying its best to conclude the trial at the earliest, but, many times, many things were not under the control of the presiding officer and all parties concerned should support the Court in concluding the trial within a reasonable period.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court stated that courts below recorded the reasons for declining to exercise the powers under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437(6)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and though the trial had been little bit delayed, and the Trial Court was expecting a speedy trial, the reasons for not exercising the discretion recorded by both the courts were correct, legal, proper and free from perversity.
