{"id":331776,"date":"2024-09-25T12:30:13","date_gmt":"2024-09-25T07:00:13","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=331776"},"modified":"2024-09-25T12:39:41","modified_gmt":"2024-09-25T07:09:41","slug":"bci-issues-directions-for-centers-of-legal-education-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/09\/25\/bci-issues-directions-for-centers-of-legal-education-legal-news\/","title":{"rendered":"BCI mandates criminal background check of the students before issuance of final marksheets and degrees"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 24-9-2024, the <span style=\"font-weight: bold;\">Bar Council of India<\/span> (&#8216;BCI&#8217;) mandated implementation of criminal background checks, declaration regarding simultaneous degree or regular academic programs, disclosure of employment status, attendance compliance and biometric attendance and installation of CCTV cameras in all <span style=\"font-weight: bold;\">centers of legal education<\/span> (&#8216;CLE&#8217;).<\/p>\n<h3>Key Points:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p style=\"font-weight: bold;\">Need:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>To monitor the antecedents and backgrounds of law students;<\/p>\n<\/li>\n<li>\n<p>To ensure transparency and accountability in attendance.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Criminal Background Check:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Law students should have clean criminal records to uphold the ethical standards of the legal profession.<\/p>\n<\/li>\n<li>\n<p>Such information has to be reported to BCI via email at <a href=\"mailto:bciinfo21@gmail.com\" target=\"_blank\" rel=\"noopener\">bciinfo21@gmail.com<\/a> with subject line- Criminal Background Check Report at (Name of CLE).<\/p>\n<\/li>\n<li>\n<p>CLE will have to wait for the BCI&#8217;s decision before issuing the final marksheet and degree.<\/p>\n<\/li>\n<li>\n<p>Law students need to disclose the following before the issuance of their final marksheets and degrees:<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>\n<p>Ongoing FIR;<\/p>\n<\/li>\n<li>\n<p>Criminal case;<\/p>\n<\/li>\n<li>\n<p>Conviction;<\/p>\n<\/li>\n<li>\n<p>Acquittal.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Simultaneous Degree and\/or regular academic programs:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Students are prohibited from pursuing more than 1 regular degree program simultaneously as per Rules of Legal Education;<\/p>\n<\/li>\n<li>\n<p>Any student who violates this rule will not be issued the final marksheet and degree;<\/p>\n<\/li>\n<li>\n<p>Exceptions- students can pursue short-term, part-time certificate courses in areas such language\/ computer applications\/ programs offered through distance learning.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Employment Status and Attendance Compliance:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Students cannot get engaged in any job unless they had obtained a valid <span style=\"font-weight: bold;\">No Objection Certificate<\/span> (&#8216;NOC&#8217;);<\/p>\n<\/li>\n<li>\n<p>Such information has to be reported to BCI via email at <a href=\"mailto:bciinfo21@gmail.com\" target=\"_blank\" rel=\"noopener\">bciinfo21@gmail.com<\/a> with subject line- Student of (CLE) Employment\/ Vocation Status During LL.B. Degree Course.<\/p>\n<\/li>\n<li>\n<p>In case, the law student fails to get NOC and fails to inform BCI, he will be not enrolled in BCI.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Biometric Attendance and CCTV Surveillance:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>It will ensure accurate monitoring of student attendance.<\/p>\n<\/li>\n<li>\n<p>The recordings from these cameras must be preserved for 1 year.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Duties of CLEs:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>To conduct a thorough criminal background check before issuing the final marksheets and degrees.<\/p>\n<\/li>\n<li>\n<p>Every CLE is expected to comply with these directions immediately.<\/p>\n<\/li>\n<li>\n<p>In case of failure of enforcing these mandates, institutions will face disciplinary actions, including derecognition or disapproval of affiliation by BCI.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Students who fail to disclose\/ comply with the above-mentioned directions will experience academic and legal consequences.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">An undertaking must be submitted by the students, before issuance of final marksheets and degrees, that confirms compliance with criminal background disclosure, simultaneous degree rules, employment status and attendance norms.<\/p>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p style=\"font-style: italic;\">BCI should be informed of any ongoing FIR, criminal case, conviction or
