On 17-9-2024, the Competition Commission of India notified the Competition Commission of India (General) Regulations, 2024<\/span> outlining the procedures for filing documents. The provisions came into force on 17-9-2024.<\/p>\n

Key Points:<\/h3>\n
    \n
  1. \n

    The official language<\/span> of the commission will be English, but the parties can file the documents in Hindi, if they desire so.<\/p>\n

    Although, the Commission will only accept the English translation of the documents, hence the document in Hindi has to be accompanied by a true translation in English.<\/p>\n<\/li>\n

  2. \n

    Commission will accept if any document is true translation<\/span> if:<\/p>\n

      \n
    • \n

      counsel for the party certifies the translation to be a true translation; or<\/p>\n<\/li>\n

    • \n

      translation is done by an official translator of any Court; or<\/p>\n<\/li>\n

    • \n

      translation is done by an official translator of any authority\/ body, central\/ state government, which is also accepted by the Courts as true translation.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

    • \n

      The reply to an information\/ reference\/ notice\/ direction issued by the Commission will be signed by:<\/p>\n

        \n
      • \n

        Proprietorship Firm-<\/span> individual himself or herself, including a sole proprietor<\/p>\n<\/li>\n

      • \n

        Hindu Undivided Family-<\/span> Karta<\/p>\n<\/li>\n

      • \n

        Company-<\/span> Managing Director\/ any other Director<\/p>\n<\/li>\n

      • \n

        Association or Society-<\/span> President\/ Secretary<\/p>\n<\/li>\n

      • \n

        Partnership Firm-<\/span> a partner<\/p>\n<\/li>\n

      • \n

        Co-operative Society\/ Local Authority-<\/span> chief executive officer<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

      • \n

        Procedure for filing of information\/ reference:<\/p>\n

          \n
        • \n

          Information\/ reference\/ responses will be presented to the Secretary in person\/ sent by registered post\/ courier service\/ facsimile transmission addressed to Secretary.<\/p>\n<\/li>\n

        • \n

          Any additional\/ separate document which the information provides wishes to provide will be in the form of a “Paper Book”.<\/p>\n

          This information should be sent within 14 days of filing the information\/ reference.<\/p>\n

          This information should be serially numbered, prefaced by index and supported by affidavit.<\/p>\n<\/li>\n

        • \n

          Information\/ reference sent by post\/courier\/ facsimile transmission must be presented to the Secretary on the day it is received at the office.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

        • \n

          Information\/ reference received in Commission will be scrutinized by the Secretary.<\/p>\n<\/li>\n

        • \n

          Every notice\/ other document required to be served on\/ delivered to any person will be served personally or sent by electronic mail\/ registered post\/ speed post\/ courier service.<\/p>\n<\/li>\n

        • \n

          Any information\/ references\/ responses\/ other documents which are required to be filed before the Commission should be typed in Arial 12 fonts on both of A4 size white bond paper in double space with 2” margin on the left and 1” margin on all other side.<\/p>\n<\/li>\n

        • \n

          The Commission can combine any number of persons\/ enterprises if an application is made in writing.<\/p>\n<\/li>\n

        • \n

          Every order of the Commission will be signed and dated by the Members including a dissenting note by the dissenting Member, if that be the case.<\/p>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
