{"id":331240,"date":"2024-09-20T15:30:06","date_gmt":"2024-09-20T10:00:06","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=331240"},"modified":"2024-09-20T15:13:47","modified_gmt":"2024-09-20T09:43:47","slug":"interim-order-passed-final-year-student-appearing-aibe-sc-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/09\/20\/interim-order-passed-final-year-student-appearing-aibe-sc-legal-news\/","title":{"rendered":"Supreme Court passes interim order allowing final-year law students to appear in the All-India Bar Exam, 2024"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Supreme Court:<\/span> In a significant development, the 3-Judge Bench of Dr DY Chandrachud, CJI, JB Pardiwala and Manoj Misra, JJ., on 20-9-2024 passed an interim order allowing final-year law students to appear in the upcoming All India Bar Examination (AIBE) scheduled on November 24, 2024.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court passed the afore-stated order while hearing a challenge to the decision of Bar Council of India to exclude final year law students from registering for AIBE.<\/p>\n<p style=\"margin-bottom: 3%;\">It is to be noted that 5-Judge Bench of the Supreme Court in <span style=\"font-style: italic;\">Bar Council of India v. Bonnie Foi Law College<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/06i1H3A3\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine SC 130<\/a>, had suggested that final-year law students could be allowed to take AIBE.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court had said that, in India, the various recognised institutions providing law degrees often declare results at different times and a person on account of non-declaration of result may lose out on the opportunity to appear in the All India Bar Examination leading to a fairly long hiatus period of time without having the opportunity to work in court proceedings. Hence, the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/02\/11\/aibe-all-india-bar-exam-bar-council-india-pre-enrolment-advocates-act-supremec-ourt-constitution-bench-legal-updates-knowledge-research-news\/\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"color: #000000;\">students who have cleared all examinations to be eligible to pursue the final semester of the final year course of law<\/span>,<\/a> on production of proof of the same, could be allowed to take the All-India Bar Examination. The result of the All-India Bar Examination would be subject to the person passing all the components required under the course of study of the University\/College.
