Thus, there held a strong presumption regarding the paternity of a child. This presumption, held, can be overcome only by evidence precluding any procreative role of the husband, such as by showing that the husband and wife had no access to each other at the relevant time of possible conception. Therefore, in the absence of proof of non-access, the law, held, considers the husband&#8217;s paternity to be conclusively established if they cohabited when the child was likely to have been conceived, [<i>Aparna Ajinkya Firodia<\/i> v. <i>Ajinkya Arun Firodia<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/g5nFCe6f\" target=\"_blank\" rel=\"noopener\">(2024) 7 SCC 773<\/a>]<\/p>\n<\/div>\n<div style=\"background-color: #e6eeff; border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002955939\" target=\"_blank\" rel=\"noopener\">Income Tax Act, 1961<\/a> &#8212; S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559402\" target=\"_blank\" rel=\"noopener\">153-C<\/a> (as amended by the Finance Act, 2015) &#8212; Applicability:<\/span> Law clarified on applicability of S. 153-C, IT Act (as amended by the Finance Act, 2015), to searches conducted under S. 132 before the date of amendment, [<i>CIT<\/i> v. <i>Vikram Sujitkumar Bhatia<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/sM4KMj2x\" target=\"_blank\" rel=\"noopener\">(2024) 7 SCC 741<\/a>]<\/p>\n<\/div>\n<div style=\"border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> &#8212; S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561607\" target=\"_blank\" rel=\"noopener\">302<\/a> &#8212; Extra-judicial confession:<\/span> Presence of a police official while making of confession before witness, not admissible, [<i>Lal Mohammad Manjur Ansari<\/i> v. <i>State of Gujarat<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/509972c1\" target=\"_blank\" rel=\"noopener\">(2024) 7 SCC 733<\/a>]<\/p>\n<\/div>\n<div style=\"background-color: #e6eeff; border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002831277\" target=\"_blank\" rel=\"noopener\">Stamp Act, 1899<\/a> &#8212; S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001518743\" target=\"_blank\" rel=\"noopener\">36<\/a> and Ss. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001518740\" target=\"_blank\" rel=\"noopener\">33<\/a> &amp; <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001518742\" target=\"_blank\" rel=\"noopener\">35<\/a> &#8212; Bar under S. 36 that once an instrument has been admitted in evidence, then its admissibility cannot be contested at any stage of the proceedings on ground of it not being duly stamped:<\/span> For bar under S. 36 to operate, there must be judicial application of mind\/determination as to whether the instrument concerned is adequately\/insufficiently stamped. In absence of a &#8220;decision&#8221; on question of admissibility i.e. whether the instrument concerned was sufficiently stamped, S. 36 cannot be called in aid. For S. 36 to come into operation, instrument must have been &#8220;admitted in evidence&#8221; upon a judicial determination, [<i>G.M. Shahul Hameed<\/i> v. <i>Jayanthi R.
