{"id":329630,"date":"2024-08-30T11:00:19","date_gmt":"2024-08-30T05:30:19","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=329630"},"modified":"2024-09-03T16:56:39","modified_gmt":"2024-09-03T11:26:39","slug":"delhi-hc-directs-union-to-expeditiously-decide-plea-restoring-legal-protection-against-non-consensual-sexual-acts-in-bns-2023","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/08\/30\/delhi-hc-directs-union-to-expeditiously-decide-plea-restoring-legal-protection-against-non-consensual-sexual-acts-in-bns-2023\/","title":{"rendered":"Delhi HC directs Union to expeditiously decide on plea for restoring legal protection against non-consensual sexual acts in Bharatiya Nyaya Sanhita, 2023"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> In a Public Interest Litigation (&#8216;PIL&#8217;) filed to seek issuance of directions to the Union of India (respondent) to restore legal protection against non-consensual sexual acts as was provided under the now-repealed Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561707\" target=\"_blank\" rel=\"noopener\">377<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (&#8216;IPC&#8217;) to ensure the safety and dignity of individuals, especially those from the LGBTQIA+ community, a Division Bench of Manmohan, ACJ. and Tushar Rao Gedela, J. directed the Union of India to treat the present petition as a representation and to decide the same as expeditiously as possible.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">In the present matter, the petitioner stated that before it was repealed, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561707\" target=\"_blank\" rel=\"noopener\">377<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> criminalized non-consensual sexual acts with any man, woman, or animal, and provided a critical legal recourse for victims of such acts regardless of gender or sexual orientation.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner stated that the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804326\" target=\"_blank\" rel=\"noopener\">Bharatiya Nyaya Sanhita, 2023<\/a> (&#8216;BNS&#8217;) does not have any such provision to provide protection against non-consensual sexual acts. It was also stated that such a legislative gap poses a significant threat to the safety and dignity of individuals particularly those from the LGBTQIA+ community who are left without adequate protection against such acts.<\/p>\n<p style=\"margin-bottom: 3%;\">The Union of India (respondent) prayed for a direction to treat the petition as a representation to the respondent as the Government is presently in the process of receiving inputs on the new criminal laws from various stakeholders and would take a holistic view of all such observations that are received.<\/p>\n<p style=\"font-weight: bold;\">Analysis and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court considered a letter dated 27-08-2024 written by the counsel of the Union of India to the Joint Secretary, Government of India which mentioned that it was the petitioner&#8217;s plea to seek directions for the Union of India to restore legal protections against non-consensual sexual acts.<\/p>\n<p style=\"margin-bottom: 3%;\">Keeping the submissions in view, the Court disposed of the present petition and directed the Union of India to treat the same as a representation and provide a decision as soon as possible.<\/p>\n<p style=\"margin-bottom: 3%;\">Lastly, the Court said that the petitioner would be at liberty to seek revival of the present petition, in case there was an inordinate delay in consideration of the representation.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Gantavya Gulati v.
