{"id":329493,"date":"2024-08-28T17:00:55","date_gmt":"2024-08-28T11:30:55","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=329493"},"modified":"2024-09-03T17:50:28","modified_gmt":"2024-09-03T12:20:28","slug":"appeal-cannot-be-transferred-to-commercial-court-u-s-245-of-cpc-term-proceeding-does-not-include-appeals-ap-hc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/08\/28\/appeal-cannot-be-transferred-to-commercial-court-u-s-245-of-cpc-term-proceeding-does-not-include-appeals-ap-hc\/","title":{"rendered":"Appeal cannot be transferred to Commercial Court u\/s 24(5) of CPC; term \u2018proceeding\u2019 under the provision does not include appeals: Andhra Pradesh High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Andhra Pradesh High Court:<\/span> In an application filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523763\" target=\"_blank\" rel=\"noopener\">24<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\" rel=\"noopener\">Civil Procedure Code, 1908<\/a> (&#8216;CPC&#8217;) and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523743\" target=\"_blank\" rel=\"noopener\">151<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\" rel=\"noopener\">CPC<\/a> for transferring the present appeal to the Special Court for Trial and disposal of Commercial Disputes at Visakhapatnam, the Division Bench of <span style=\"font-weight: bold;\">R. Raghunandan Rao<\/span> and Harinath N., JJ., stated that the term &#8216;proceeding&#8217; mentioned under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523763\" target=\"_blank\" rel=\"noopener\">24(5)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\" rel=\"noopener\">CPC<\/a> would not include appeals. Consequently, the Court stated that the present appeal could not be transferred under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523763\" target=\"_blank\" rel=\"noopener\">24(5)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\" rel=\"noopener\">CPC<\/a>, to the Commercial Court at Vishakhapatnam. However, this would not mean that the appellant could not prefer a fresh appeal to the Commercial Court, Visakhapatnam or such Court which had the jurisdiction, as such course of action was available. Thus, the Court dismissed the present appeal, leaving it open for the appellant to avail remedies as were available to them.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">In the present case, being aggrieved by certain directions of the Arbitral Tribunal dated 04-07-2024, the appellant filed an appeal. The respondent raised an objection regarding the maintainability of the appeal, under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544942\" target=\"_blank\" rel=\"noopener\">37<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Arbitration and Conciliation Act, 1996<\/a> (&#8216;A&amp;C Act&#8217;) read the provisions of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726943\" target=\"_blank\" rel=\"noopener\">Commercial Courts Act, 2015<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">Subsequently, vide order dated 30-07-2024, the Court held that it did not have the jurisdiction to entertain the present appeal. Thus, the appellant filed the present application and there was no dispute that the said Commercial Court has the jurisdiction to hear and decide the subject matter of the present appeal. Appellant stated that if the present appeal was not maintainable before this Court, it would be appropriate to transfer this appeal to the Commercial Court at Visakhapatnam. If the Court rejected the application, the appellant would have to file a fresh appeal before the Commercial Court and seek condonation of delay, as the period stipulated under the provisions of the A&amp;C Act had expired.<\/p>\n<p style=\"margin-bottom: 3%;\">The question that arose for consideration before the Court was whether, the terms suit or proceeding, mentioned in section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523763\" target=\"_blank\" rel=\"noopener\">24(5)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\" rel=\"noopener\">CPC<\/a>, could be understood to include the word &#8216;appeal&#8217;.<\/p>\n<p style=\"font-weight: bold;\">Analysis, Law, and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court referred to <span style=\"font-style: italic;\">Ram Chandra Aggarwal<\/span> v. <span style=\"font-style: italic;\">State of U.P.<\/span>, <a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=MTk2NiBTQ0MgT25MaW5lIFNDIDIzMiYmJiYmNDAmJiYmJlNlYXJjaFBhZ2U=\" target=\"_blank\" rel=\"noopener\">1966 SCC OnLine SC 232<\/a>, and held that the term &#8216;proceeding&#8217; mentioned under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523763\" target=\"_blank\" rel=\"noopener\">24(5)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\" rel=\"noopener\">CPC<\/a> would not include appeals. Consequently, the Court stated that the present appeal could not be transferred under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523763\" target=\"_blank\" rel=\"noopener\">24(5)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\" rel=\"noopener\">CPC<\/a>, to the Commercial Court at Vishakhapatnam. However, this would not mean that the appellant could not prefer a fresh appeal to the commercial court, Visakhapatnam or such Court which had the jurisdiction.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court referred to <span style=\"font-style: italic;\">Consolidated Engineering Enterprises<\/span> v. <span style=\"font-style: italic;\">Principal Secretary, Irrigation Department<\/span>, <a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=KDIwMDgpIDcgU0NDIDE2OSYmJiYmNDAmJiYmJlNlYXJjaFBhZ2U=\" target=\"_blank\" rel=\"noopener\">(2008) 7 SCC 169<\/a>, wherein the applicability of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001553197\" target=\"_blank\" rel=\"noopener\">5<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726959\" target=\"_blank\" rel=\"noopener\">Limitation Act, 1963<\/a> (&#8216;the Limitation Act&#8217;) was excluded and it was held that the language of Section 34 of the A&amp;C Act by implication, excluded the applicability of Section 5 of the Limitation Act. However, the said language could not be extended to exclude the provisions of Section 14 of the Limitation Act. The Court stated that similar considerations would also apply to an appeal under Section 37 of the A&amp;C Act and accordingly, dismissed the present appeal, leaving it open for the appellant to avail remedies as were available to them.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Rashtriya Ispat Nigam Ltd. v.
