Vaidyanathan was born on 17-08-1962 at Coimbatore to V. Subramanian. Justice Vaidyanathan&#8217;s father started his life as a shoe polish seller and later grew to be a committed trade unionist.<\/p>\n<p style=\"margin-bottom: 3%;\">Justice S. Vaidyanathan did his schooling in Singaram Pillai High School in Villivakkam, Chennai and B.A. (Economics) from D.G. Vaishnav College, Arumbakkam during 1979-82. He obtained his law degree from Madras Law College (now known as Dr. Ambedkar Government Law College) during 1982-85 and Post Graduate Diploma in Personal Management, Labour Welfare and Industrial Relations in 1986.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><span style=\"font-weight: bold; color: #ff0000;\">Did you Know?<\/span> <span style=\"font-weight: bold; font-style: italic;\">Justice Vaidyanathan&#8217;s father, V. Subramanian was the founder member of the first white-collared Employees&#8217; Union in 1946, i.e., Madras Commercial Employees Union.<\/span><\/p>\n<p style=\"text-align: center; font-weight: bold;\">Career as an Advocate<a id=\"fnref2\" href=\"#fn2\"><sup>2<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Justice Vaidyanathan got enrolled as an advocate on 27-08-1986 and started his practise in the Madras High Court and various Tribunals. His area of practice was mainly focused on labour, service, criminal and company matters.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><span style=\"font-weight: bold; color: #ff0000;\">Did you Know?<\/span> <span style=\"font-weight: bold; font-style: italic;\">Justice Vaidyanathan&#8217;s paternal grandfather L. S. Vaidyanathan served as a Superintendent, Copyist Section in the Madras High Court and retired in the year 1952.<\/span><\/p>\n<p style=\"text-align: center; font-weight: bold;\">Judgeship<a id=\"fnref3\" href=\"#fn3\"><sup>3<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Justice Vaidyanathan&#8217;s skills and humility were suitably rewarded when he was elevated on 25-10-2013 as an Additional Judge of the High Court of Judicature at Madras and subsequently on 14-04-2015 he was elevated as a Permanent Judge of the High Court.<\/p>\n<p style=\"margin-bottom: 3%;\">Justice S. Vaidyanathan also performed the duties of Acting Chief Justice of Madras High Court with effect from 25-05-2023 after the retirement of Justice T. Raja, former Acting Chief Justice<a id=\"fnref4\" href=\"#fn4\"><sup>4<\/sup><\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">Justice Vaidyanathan&#8217;s competency, judicial acumen and <span style=\"background-color: #ffffff; color: #171617;\">considerable experience in dispensing justice in one of the largest High Courts in the country<\/span> was recognised by the Supreme Court Collegium when they <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/11\/03\/sc-collegium-appointment-chief-justice-highcourt-meghalaya-orissa-uttaranchal-legal-news\/\" target=\"_blank\" rel=\"noopener\">recommended<\/a> his name as the 12<span style=\"vertical-align: super;\">th<\/span> Chief Justice of Meghalaya High Court.<\/p>\n<p style=\"margin-bottom: 3%;\">The Collegium&#8217;s recommendation was accepted by the Ministry of Law and Justice and the President of India on 02-02-2024 <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/02\/03\/centre-appoints-chief-justice-acting-chief-justice-sc-collegium-legal-news\/\" target=\"_blank\" rel=\"noopener\">appointed<\/a> Justice S. Vaidyanathan as Chief Justice of the High Court of Meghalaya. Diengdoh, J., noting the depositions of the minor girl, her parents, house help and medical evidence, held that it was duly established that the convict intoxicated the girl and taking advantage of the same had physical relationship with the minor girl. State of Meghalaya<\/span>, 2024 SCC OnLine Megh 596, the <span style=\"color: #171617;\">Division Bench of <span style=\"font-weight: bold;\">S. Vaidyanathan, CJ.<\/span> and W. Diengdoh, J., noted that the minor girl was aged about four years only at the time of incident. The Court on perusal of the minor girl&#8217;s statement, said that the accused had deceivably called the minor girl to his house and raped her by sealing her mouth.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Further, the Court remarked that why Police had not booked a case against the family members of the accused, more particularly, father of the convict, who, disbelieving the words of the mother of the minor girl, concealed the convict in his house and informed her that he was not present in the house, which amounts to harbouring the offender, punishable under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561497\" target=\"_blank\" rel=\"noopener\">212<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. The Court directed for the fine amount to be paid to the minor girl, if already not paid, in addition to the payment of compensation of Rs. 700000\/- by the State to the victim child.<\/p>\n<p style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/07\/08\/meghalaya-hc-dismisses-assam-rifleman-reinstatement-plea\/\" target=\"_blank\" rel=\"noopener\">Reinstating employee of unsound mind | Meghalaya HC dismisses Assam rifleman&#8217;s reinstatement plea who shot co-employee<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-style: italic;\">Sashikant Pandey v. Union of India<\/span>, 2024 SCC OnLine Megh 575, the Division Bench of <span style=\"font-weight: bold;\">S. Vaidyanathan, CJ.<\/span> and W. Diengdoh, J., deliberated over the case against the appellant wherein he was missing from his service with his weapon 5.56mm INSAS Rifle and went to his barrack and fired three rounds on co-employee and caused injury in his right knee, right side of neck and lower abdomen.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the appellant had indulged in such type of misconducts earlier, on three occasions and was awarded different punishments. The Court added that even if it is taken that the appellant is a lunatic, reinstating an employee with unsound mind in a disciplined force is dangerous not only to the Force, but also to the society at large. Thus, the Court held that the Single Judge&#8217;s order was valid and warranted no interference by the Court.<\/p>\n<p style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/06\/04\/meghalaya-hc-modifies-husband-conviction-302-killing-wife-ex-husband\/\" target=\"_blank\" rel=\"noopener\">&#8216;Every possibility for prudent man to lose temper on seeing wife with another man&#8217;: Meghalaya HC modifies husband&#8217;s conviction u\/s 302 for killing wife&#8217;s ex-husband<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-style: italic;\">Phot Khaii v. State of Meghalaya<\/span>, 2024 SCC OnLine Megh 441, the Division Bench of <span style=\"color: #171617;\"><span style=\"font-weight: bold;\">S. Vaidyanathan, CJ.<\/span> and W. Diengdoh, J., partly allowed the appeal and modified the offence to fall within the ambit of the Exception 2 of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561605\" target=\"_blank\" rel=\"noopener\">300<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. The convict was sentenced to three years imprisonment.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">The Court compared marriage to a bicycle with two wheels representing husband and wife, emphasizing the impact of marital issues on the family. The Court on referring to <span style=\"font-style: italic;\">Bhanwar Singh v. State of Madhya Pradesh<\/span>, (2008) 16 SCC 657, wherein, it was held that in order to bring the case within this ambit, there is every necessity to establish that the accused, in the garb of self-defence against the accused caused the death of the person, said that the convict, on noticing the presence of the deceased in his house caused the death of the deceased in order to safeguard his right over person (wife) without any premeditation or intention. Thus, the Court held that the matter at hand fell within the ambit of Exception 2 to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561605\" target=\"_blank\" rel=\"noopener\">300<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> on the ground of it being unintentional and consequently, it is culpable homicide not amounting to murder.<\/p>\n<p style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/05\/06\/meghalaya-high-court-modifies-sentence-pocso-case\/\" target=\"_blank\" rel=\"noopener\">&#8216;Male member made scapegoat for mistake of both&#8217;; Meghalaya HC upholds conviction under POCSO, mitigates life sentence to 10 yrs imprisonment<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-style: italic;\">Rinku Kumar Tyagi v. State of Meghalaya<\/span>, 2024 SCC OnLine Megh 308, filed against the judgment and order of sentence, passed by the Special Judge (POCSO), District and Sessions Court, Shillong, imposing life imprisonment sentence on the present convict for offence under Section <doclink docname=\"Protection of Children from Sexual Offenders Act, 2012\" actblocktype=\"Section\" sectionno=\"4\" doi=\"\" match=\"no\">4<\/doclink> of <doclink docname=\"Protection of Children from Sexual Offenders Act, 2012\" actblocktype=\"\" sectionno=\"\" doi=\"\" match=\"no\">Protection of Children from Sexual Offenders Act, 2012<\/doclink> (POCSO), the Division Bench of <span style=\"font-weight: bold;\">S. Vaidyanathan CJ<\/span>, and W. Diengdoh, J. modified the convict&#8217;s sentence to ten years of imprisonment and imposed a fine of Rs 10,000. &#8220;<span style=\"font-style: italic;\">A case involving love affair and unfortunately, the male member was made as a scapegoat to undergo imprisonment for the mistakes committed by the two. It is no doubt true that the offence under POCSO Act, 2012 has been made out to impose punishment on the accused, while the so-called victim girl is leading a happy life.<\/span>&#8221;<\/p>\n<p style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/03\/28\/aai-to-ensure-hopping-flights-to-bhopal-from-major-cities-meghalaya-hc-legal-news\/\" target=\"_blank\" rel=\"noopener\">&#8216;AAI to ensure hopping flights to Bhopal from major cities in National Interest&#8217;; Meghalaya HC urges for flights to Bhopal on Friday and Sunday since Judges attend NJA<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">In a public interest litigation pertaining to the development and possible expansion of the facilities at the Shillong Airport, located in Umroi, S. Vaidyanathan, Chief Justice and W. Diengdoh, J. in <span style=\"font-style: italic;\">Registrar General v. State of Meghalaya<\/span>, 2024 SCC OnLine Megh 207, said that the length of the runway should be widened to 2210 metres (approx) to operate larger flights, which can carry around 220 passengers. B. Rajeswari<\/span>, 2023 SCC OnLine Mad 143, <span style=\"background-color: #ffffff;\">filed against the order of the Single Judge directing the Tamil Nadu State Transport Corporation to treat the respondent&#8217;s maternity leave period as duty period for all purposes, the division bench of <span style=\"font-weight: bold;\">S. State<\/span><a id=\"fnref6\" href=\"#fn6\"><sup>6<\/sup><\/a>, held that the recommendation of the Human Rights Commission made under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001529104\" target=\"_blank\" rel=\"noopener\">18<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002828502\" target=\"_blank\" rel=\"noopener\">Protection of Human Rights Act, 1993<\/a> (&#8220;Human Rights Act&#8221;) is binding on the Government or the Authority concerned. The Government is under a legal obligation to forward its comments on the Report including the action taken or proposed to be taken to the Commission in terms of sub-clause (e) of Section 18. Vaidyanathan, J., in <span style=\"font-style: italic;\">M. Munusamy v. Union of India<\/span>,&nbsp;<\/span><a href=\"http:\/\/www.scconline.com\/DocumentLink\/0678CWb6\" target=\"_blank\" rel=\"noopener\">2020 SCC OnLine Mad 915<\/a>, dismissed a petition filed for a direction to both the Union and T.N. Governments to increase a number of private hospitals to provide medical aid to the Corona infected patients instead of confining them in carriages for treatment, on the ground of lack of sanitation and infrastructure. The petitioner contended that both the Central and State Governments, instead of adding infrastructure facilities in private hospitals, have chosen to provide treatment to Corona affected persons in carriages for the reasons best known to them and those carriages would not have been maintained with proper sanitation, thereby leading to a health hazard to patients, who are going to be confined therein.<\/p>\n<p style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2016\/01\/06\/repossession-of-goods-by-the-financial-institution-in-case-of-default-in-repayment-of-loan-does-not-amount-to-theft\/\" target=\"_blank\" rel=\"noopener\">Repossession of goods by the financial institution in case of default in repayment of loan does not amount to theft<\/a><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #171617;\">While setting aside the FIR registered against the officials of the Bank for an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561709\" target=\"_blank\" rel=\"noopener\">379<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code<\/a>, a bench of S. Vaidyanathan J., in <span style=\"font-style: italic;\">HDFC Bank Limited v. State<\/span><\/span>, <a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/2015_SCC_OnLine_Mad_10573\" target=\"_blank\" rel=\"noopener\">2015 SCC Online Mad 10573<\/a>, ruled that no criminal action could be taken against the financier\/ financial institution for repossessing the goods hypothecated with them in case of default in repayment of loan. In the instant case, a loan agreement was signed between the petitioner and the 2nd respondent for a sum of Rs.9,00,000\/- for purchase of a car. The petitioner seized the car on default in the repayment of loan and kept it in their custody. The 2nd respondent filed a case against the officials of the Bank for an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561709\" target=\"_blank\" rel=\"noopener\">379<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. After registering the case, the 1st respondent Police sent a communication to the bank, asking them to surrender the vehicle, as the same is required for investigation as well as for production before the Court. Aggrieved by the same, the petitioner filed the present petition under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> to quash the FIR pending on the file of the 1st respondent Police.<\/p>\n<p style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2015\/04\/01\/distinction-drawn-between-expiry-date-and-best-before-date\/\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">Madras High Court draws distinction between &#8220;expiry date&#8221; and &#8220;best before date&#8221;<\/span><\/a><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #171617;\">While discussing the issue that whether &#8220;expiry date&#8221; and &#8220;best before date&#8221; are similar as contended by the petitioner in the present case, the bench of S. Vaidyanathan, J., in <span style=\"font-style: italic;\">Amrut Distilleries Limited v. Authorized Officer<\/span><\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/zl4x5ipy\" target=\"_blank\" rel=\"noopener\">2015 SCC OnLine Mad 321<\/a>, observed that there is a clear distinction between the two terms. While &#8220;expiry date&#8221; means the end of estimated period under any stated storage conditions, after which product probably will not have the quality and safety attributes normally expected by the consumers; whereas &#8220;best before date&#8221; means the period during which the product shall remain fully marketable and shall retain specific qualities for which tacit or express claims have been made.
