{"id":328560,"date":"2024-08-13T11:00:18","date_gmt":"2024-08-13T05:30:18","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=328560"},"modified":"2024-10-16T14:51:57","modified_gmt":"2024-10-16T09:21:57","slug":"supreme-court-issues-notice-plea-by-tenant-concerning-right-to-receive-demolition-notice-after-regularisation-continued-stay-on-demolition","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/08\/13\/supreme-court-issues-notice-plea-by-tenant-concerning-right-to-receive-demolition-notice-after-regularisation-continued-stay-on-demolition\/","title":{"rendered":"SC issues notice on tenant\u2019s plea concerning his right to receive notice of demolition u\/S. 400 of KMC Act after regularisation; Stay on demolition continues"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Supreme Court:<\/span> In a special leave petition filed against the judgment and order passed by the Calcutta High Court, wherein the Court has observed that the petitioner being a tenant has no right to participate in the demolition proceeding nor is there any requirement to serve him any notice or communication of the demolition of the disputed building under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001689679\" target=\"_blank\" rel=\"noopener\">400(3)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000736783\" target=\"_blank\" rel=\"noopener\">Kolkata Municipal Corporation Act, 1980<\/a> (\u2018KMC Act , 1980\u2019) as the Petitioner being the tenant\/occupier has never contributed in the construction of the subject premises, the division bench of Abhay S. Oka and Augustine George Masih, JJ. before permitting the petitioner to apply for regularization, directed the petitioner and all adult members of his family occupying the premises to file an undertaking on oath in this Court stating that in the event, their application for regularization is rejected, within one week from the date on which the order of rejection is communicated to them, they shall unconditionally vacate the premises subject matter of this special leave petition.<\/p>\n<p style=\"margin-bottom: 3%;\">The issue in this matter was that whether a tenant is entitled to a notice of demolition under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001689679\" target=\"_blank\" rel=\"noopener\">400<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000736783\" target=\"_blank\" rel=\"noopener\">KMC Act, 1980<\/a> and whether he has a chance to apply for regularization or file an appeal against demolition before Statutory Appellate Tribunal.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner contended that the High Court has failed to take into consideration that the petitioner is a tenant\/occupier of the subject premises and has been residing at the subject premises since 1975-1977 ( around 50 years). The High Court erred in its interpretation of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001689679\" target=\"_blank\" rel=\"noopener\">400<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000736783\" target=\"_blank\" rel=\"noopener\">KMC Act, 1980<\/a> by giving a narrow connotation to the words \u2018any person aggrieved\u2019.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court initially took up this matter on 6-08-2024, and stayed the demolition of the subject premises of petitioner till 9-08-2024.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner has tendered across the Bar the Kolkata Municipal Corporation (Regularization of Building) Regulation, 2015.
