Supreme Court:<\/span> A three Judge Bench comprising of CJI Dr. DY Chandrachud, JB Pardiwala and PS Narasimha, JJ. held that the Delhi’s Lieutenant Governor is not bound by the aid and advice of the Delhi Government’s cabinet for appointment of aldermen.<\/p>\n

Hence, LG’s unilateral appointment of the alderman to the Municipal Corporation of Delhi, is valid. The Court held that the said power of appointment is a statutory power flowing the Delhi Municipal Corporation Act, 1957<\/a> and hence, the LG need not act as per the aid and advice of the Delhi Government.<\/p>\n

In the matter at hand, the Aam Aadmi Party, the ruling party in Delhi had filed a plea against the appointment of ten aldermen by the LG to the MCD for appointing on the said position without the aid and advice of the State cabinet.<\/p>\n

The Court affirmed the appointment of these ten aldermen.<\/p>\n
