Supreme Court:<\/span> In an appeal by chef Kunal Kapur’s wife against the judgment passed by the Delhi High Court, wherein the Court has granted divorce to the Kunal Kapur on grounds of alleged cruelty by his wife, the division bench of Hrishikesh Roy and SVN Bhatti, JJ. has stayed the impugned judgment of the High Court and has sought response of Kunal Kapur in the matter.<\/p>\n

Background:<\/p>\n

The Family Court had refused to grant them divorce while stating that Kunal Kapur was exaggerating old issues in their marriage to highlight purported cruelty, when none existed, to have the marriage dissolved.<\/p>\n

The High Court had said that the wife’s conduct fell under the ambit of Section 13(1)(ia)<\/a> of the Hindu Marriage Act, 1955<\/a> and the Family Court had done a mistake in not allowing Kunal Kapur’s plea for divorce.<\/p>\n

The wife stated that the judgment was delivered by the High Court after six months from the date it was reserved, and the same amounted to violation of Supreme Court’s directions.<\/p>\n

Kunal Kapur stated that during the marriage, his wife was in the habit of making calls to the police to threaten him and his family.<\/p>\n

The Court, while staying the High Court order granting divorce to Kunal Kapur, has referred the case to the Supreme Court Mediation Centre to explore the possibility of any out-of-court settlement.<\/p>\n
