{"id":327482,"date":"2024-07-29T12:30:04","date_gmt":"2024-07-29T07:00:04","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=327482"},"modified":"2024-08-02T11:41:48","modified_gmt":"2024-08-02T06:11:48","slug":"kerala-hc-quashes-rape-proceedings-against-husband-considering-settled-married-life-wellbeing-of-children","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/07\/29\/kerala-hc-quashes-rape-proceedings-against-husband-considering-settled-married-life-wellbeing-of-children\/","title":{"rendered":"Kerala HC quashes proceedings against husband after considering settled married life and wellbeing of children"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Kerala High Court:<\/span> In a petition filed by the accused under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Code of Criminal Procedure, 1973<\/a> (\u2018CrPC\u2019)<a id=\"fnref1\" title=\"1. Section 528 of Bharatiya Nagrik Suraksha Sanhita, 2023 (\u2018BNSS\u2019)\" href=\"#fn1\"><sup>1<\/sup><\/a> for the quashing of proceedings, wherein the accused had been alleged to have committed the offence of rape. However, he eventually married the victim, and they lived together as husband and wife with children of their own. <span style=\"font-weight: bold;\">A. Badharudeen, J<\/span>., allowed the petition and quashed all proceedings against the accused and observed that although the settlement of cases stemming from the offences of rape and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\" rel=\"noopener\">Protection of Children from Sexual Offences Act, 2012<\/a> (\u2018POCSO Act\u2019) was not permissible under law, an exception was made considering that the accused and the victim had children together and were living a peaceful family life. The Court remarked that there was no necessity to continue criminal proceedings to retain them in the hazards of litigation and to collapse their married life and the wellbeing of the children.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">On 21-02-2021, accused 1 kidnapped the victim, who was aged about 17 years, from the lawful custody of her guardians and subjected her to sexual intercourse after illegally detaining her. As a result of the sexual assault, the victim became pregnant. It was further averred by the State that the mother of the victim, accused 2 herein, failed to inform the incident to the police. Based on this, the State alleged that offences punishable under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561687\" target=\"_blank\" rel=\"noopener\">366<\/a><a id=\"fnref2\" title=\"2. Section 87 of Bharatiya Nyaya Sanhita, 2023 (\u2018BNS\u2019)\" href=\"#fn2\"><sup>2<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561655\" target=\"_blank\" rel=\"noopener\">342<\/a><a id=\"fnref3\" title=\"3. Section 127(2) of BNS\" href=\"#fn3\"><sup>3<\/sup><\/a><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561603\" target=\"_blank\" rel=\"noopener\">3<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561694\" target=\"_blank\" rel=\"noopener\">370<\/a><a id=\"fnref4\" title=\"4. Section 143 of BNS\" href=\"#fn4\"><sup>4<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561695\" target=\"_blank\" rel=\"noopener\">370-A<\/a><a id=\"fnref5\" title=\"5. Section 144 of BNS\" href=\"#fn5\"><sup>5<\/sup><\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561701\" target=\"_blank\" rel=\"noopener\">376(2)(n)<\/a><a id=\"fnref6\" title=\"6. Section 64 of BNS\" href=\"#fn6\"><sup>6<\/sup><\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (\u2018IPC\u2019) and Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550527\" target=\"_blank\" rel=\"noopener\">5(l)(j)(ii)<\/a> read with Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550528\" target=\"_blank\" rel=\"noopener\">6<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550519\" target=\"_blank\" rel=\"noopener\">4<\/a> read with <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550508\" target=\"_blank\" rel=\"noopener\">3(a)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\" rel=\"noopener\">POCSO Act<\/a>, were committed by accused 1 and offence punishable under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550499\" target=\"_blank\" rel=\"noopener\">21(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\" rel=\"noopener\">POCSO Act<\/a> was committed by the victim\u2019s mother.<\/p>\n<p style=\"margin-bottom: 3%;\">It was submitted by the accused that the matter had been settled and the victim had also filed an affidavit supporting such settlement. It was submitted that accused 1 and the victim got married on 25-08-2021 and were happily living as husband and wife, and prayed that in view of such settlement, the case was liable to be quashed. The settlement was also supported by the victim before the Court.<\/p>\n<p style=\"margin-bottom: 3%;\">The State contended that accused 1 and the victim also had two children and were all living happily.<\/p>\n<p style=\"font-weight: bold;\">Decision and Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">The Court stated that power vested with the Court under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> to quash criminal proceedings in respect of serious offences like murder, rape, dacoity, etc., settlement between an offender and the victim would be bereft of any legal sanction.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court remarked, \u201c<span style=\"font-style: italic;\">when a human frame is defiled, the &#8220;purest treasure&#8221;, is lost. Dignity of a woman is a part of her non-perishable and immortal self, and no one should ever think of painting it in clay. There cannot be a compromise or settlement as it would be against her honour, which matters the most.\u201d<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">The Court said that although the High Court could invoke its jurisdiction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> to quash the proceedings on basis of the settlement reached between the parties even for non-compoundable offences, such jurisdiction must be invoked upon consideration of the fact that whether the proceedings related to any serious and heinous offences, and whether the crime in question had any impact over the society.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that in the instant case accused 1 and victim were married and had children, and it was of utmost importance to ensure the well-being of children, even though settlement of cases stemming from offence of rape and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\" rel=\"noopener\">POCSO Act<\/a> was not permissible under law.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court, therefore, allowed the petition and quashed the proceedings against accused 1 and 2.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">X v.
