Bombay HC restrains exhibition, circulation of film “Hamare Baarah” till 14-06-2024 allegedly being derogatory to Islamic faith and married Muslim women in India<\/p>\n

The present petition was filed under Article 226<\/a> of the Constitution<\/a> seeking a Writ of Mandamus against the Chairperson of Central Board of Film Certification (‘CBFC’) to revoke the certification granted to the film “Hamare Baarah” (‘the film’) and thereby injunct it from being released in public domain in any manner or form as it was in complete contravention of the provisions of the Cinematograph Act, 1952<\/a> and violates Articles 19(2)<\/a> and 25<\/a> of the Constitution<\/a>. The Division Bench of N.R. Borkar and Kamal Khata, JJ., restrained the respondents from exhibition, circulation, or making available for viewership the film “Hamare Baarah” on any public platform till 14-06-2024. Delhi High Court restrains ‘Baap Ki Adalat’ for infringing Rajat Sharma’s popular show ‘Aap Ki Adalat’ marks<\/p>\n

An application was filed by Independent News Service Private Limited (plaintiff), a company incorporated in 1997, and its Chairman and Editor-in-Chief, Shri Rajat Sharma, seeking permanent injunction restraining defendants and all those acting for and, on their behalf from using the mark\/logo or ‘Baap Ki Adalat’ or any other trademark\/logo deceptively like the trademark\/logo of the plaintiff ‘Aap Ki Adalat‘. Anish Dayal, J., restrained the defendants from using\/dealing in any manner with the impugned trademark\/logo and ‘Baap ki Adalat or any other trademark\/logo deceptively similar to the trademark\/logo of the plaintiff ‘Aap Ki Adalat‘, either as trademark\/trade mark\/logo\/trading style, domain name, social media posts, audio video content, or in relation to any services so as to result in violation of statutory and common law rights of plaintiff 1. ‘Violative of Rule 3(vi) of Delhi High Court Video Conference Rules, 2021’; Delhi HC directs X, Meta, YouTube to remove audio\/video recording of Arvind Kejriwal’s Court proceedings<\/p>\n

In a Public Interest litigation filed under Articles 226<\/a> and 227<\/a> of the Constitution<\/a> seeking to direct the respondents to remove the alleged audio\/video recording of the Court proceedings dated 28-03-2024, which took place in the Court of Special Judge, CBI, Rouse Avenue Court, New Delhi, the Division Bench of Neena Bansal Krishna, and Amit Sharma, JJ., held that the Court proceeding recording was violative of Rule 3(vi) of Delhi High Court Video Conference Rules, 2021 and it cannot be permitted to remain in public domain. The Court directed the Social Media platforms namely X (formerly “Twitter”), Meta (formerly “Facebook”), Instagram and YouTube to remove forthwith the audio\/video recording from their respective platforms. In a suit for defamation filed by journalist Rajat Sharma (plaintiff) against members of the All India Congress Committee (‘AICC’) for circulating tweets and doctored videos of him accusing him of using abusive language, Neena Bansal Krishna, J., granted ad interim injunction and ordered the videos and tweets be removed from the social media that was tarnishing the reputation of Rajat Sharma, while remarking that individual dignity and honour of a person cannot be allowed to be defamed or disrepute brought to him on the ground of Right of Free Speech and Expression. Calcutta High Court approves settlement between Dabur and Dhruv Rathee to remove all references to ‘Real’ juices in YouTube video<\/p>\n

In a suit filed by Dabur India Limited (‘Dabur’) to seek protection of its intellectual property rights against a YouTube video by Dhruv Rathee (Defendant) wherein references were made to ‘Real’, a product of Dabur, a Single Judge Bench of Krishna Rao, J., disposed of the suit in terms of the settlement agreed between both parties wherein it was agreed to remove all references of or use of ‘Real’ trade marks, copyright content, labels, packaging, and advertisements from the impugned video. In an application by the Investigating Officer (‘IO’) to seek 3 days police custody remand of the accused, who was arrested due to a complaint that he had allegedly posted fake, morphed, and misleading information and photos of Prime Minister Narendra Modi to malign his reputation, Akanksha Garg, J. dismissed the application and held the arrest to be illegal since no proper notice was served under Section 41-A<\/a> of the Code of Criminal Procedure, 1973<\/a> (‘CrPC’), as the accused was not given sufficient time to join the investigation. High Court was approached due to absence of Vacation Bench in TDSAT; Delhi High Court directs uninterrupted transmission of ‘TV9 Telugu Channel’<\/p>\n

The writ petitions were filed by the petitioner, who broadcasts the TV9 Telugu channel, against respondent 2, a Multi System Operator (MSO) and service provider under the Telecom Regulatory Authority of India (TRAI) Act, 1997<\/a> alleging that respondent 2 disconnected its channel without issuing the required disconnection notice, violating both the Interconnection and Quality of Service Regulations of 2017 and a mutually agreed-upon contract dated 08-05-24.
