{"id":325091,"date":"2024-06-25T18:15:42","date_gmt":"2024-06-25T12:45:42","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=325091"},"modified":"2024-06-25T18:08:10","modified_gmt":"2024-06-25T12:38:10","slug":"bombay-hc-releases-pune-porsche-accident-minor-from-observation-home","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/06\/25\/bombay-hc-releases-pune-porsche-accident-minor-from-observation-home\/","title":{"rendered":"[Pune Porsche Accident Case] Bombay HC directs release of the accused minor; Directs continuation of Juvenile Justice Board-ordered psychological counselling"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Bombay High Court<\/span>: In a significant development in the Pune Porsche Accident case, the Division Bench of Bharati Dangre and Manjusha Deshpande, JJ., on 25-06-2024 allowed a habeas corpus petition filed by the paternal aunt of the minor accused against the order of the Juvenile Justice Board (&#8220;JJB&#8221;), remanding the minor to an observation home, and cancelling his earlier bail order.<\/p>\n<p>The JJB had <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/05\/22\/pune-porsche-hit-and-run-juvenile-justice-board-cancels-bail-for-minor-remands-minor-to-children-observation-centre\/\" target=\"_blank\" rel=\"noopener\">earlier granted bail<\/a> to the minor on the following conditions:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>A bail bond of Rs. 7500;<\/p>\n<\/li>\n<li>\n<p>A 300-worded essay on &#8216;Effect of Road Accident and their Solutions&#8217;;<\/p>\n<\/li>\n<li>\n<p>Assistance to an RTO Officer;<\/p>\n<\/li>\n<li>\n<p>Undergo de-addiction counselling;<\/p>\n<\/li>\n<li>\n<p>Consult psychologist and psychiatrist;<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Direction to parents to take care of the minor and keep him away from bad company.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">The 17-year-old accused minor is the son of a Pune-based builder, who was driving a Porsche car at high speed, allegedly under the influence of alcohol, and having lost control over the vehicle, crashed into two persons riding on a motorcycle, resulting in their death. The minor was charged under various provisions of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (&#8220;IPC&#8221;), including Sections 279, 304-A, 337 and provisions of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726964\" target=\"_blank\" rel=\"noopener\">Motor Vehicles Act, 1988<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court questioned the remand to observation home once bail had been granted to the minor and declared the impugned JJB order illegal.
