{"id":324470,"date":"2024-06-15T14:00:59","date_gmt":"2024-06-15T08:30:59","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=324470"},"modified":"2024-06-20T15:58:02","modified_gmt":"2024-06-20T10:28:02","slug":"delhi-hc-orders-evacuation-of-hazrat-nizamuddin-masjid-and-madarsa-within-a-month-for-demolition-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/06\/15\/delhi-hc-orders-evacuation-of-hazrat-nizamuddin-masjid-and-madarsa-within-a-month-for-demolition-legal-news\/","title":{"rendered":"Delhi High Court grants one month to Faizyab Masjid and Madarsa in Hazrat Nizamuddin to vacate the premises for demolition"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> In a writ petition filed by Faizyab Masjid and Madarsa , seeking an order to declare the actions of Delhi Police and Delhi Development Authority of threatening demolition of the Masjid situated at Sarai Kale Khan, Hazrat Nizamuddin, New Delhi on 13-06-2024, to be illegal, arbitrary, and unconstitutional, Amit Sharma, J. directed the respondents to grant a period of one month to the Faizyab Masjid and Madarsa to vacate the premises and made it clear that no further extension of time will be granted.<\/p>\n<p style=\"margin-bottom: 3%;\">Along with the above-mentioned prayer, the petitioner also sought a writ of certiorari against the circulars passed by the Deputy Secretary, Delhi Administration, and for declaring the constitution and formation of Religious Committee as unconstitutional, arbitrary, and illegal.<\/p>\n<p style=\"margin-bottom: 3%;\">The caretaker and authorized representative of the Masjid submitted that the premises would be vacated within a month and that they willnot make any further endeavors to stall the drive by the respondents.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted the undertaking given by the Masjid&#8217;s caretaker of Faizyab Masjid and Madarsa and directed the respondents to grant a period of one month to Faizyab Masjid and Madarsa or any other person claiming through it to vacate the premises of the Masjid and Madarsa.<\/p>\n<p style=\"margin-bottom: 3%;\">While dismissing the petition, the Court also made it clear that no further time would be granted to Faizyab Masjid and Madarsa since the property was required for public purposes and directed them to abide by the undertaking given by their caretaker and authorized representative.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Faizyab Masjid and Madarsa v.
