Bombay High Court:<\/span> The applicant filed the present appeal against the judgment and order dated 23-12-2021 passed by the Court of Sessions, Dindoshi (‘the Trial Court’), whereby the Trial Court convicted the applicant for the offence punishable under Section 302<\/a> of the Penal Code, 1860<\/a> and sentenced him to imprisonment for life. The Division Bench of N.R. Borkar and Somasekhar Sundaresan, JJ., granted one-week temporary bail to the applicant upto 31-05-2024 to appear for the LLB-CET examination, scheduled to be held on 30-05-2024.<\/p>\n

The Court permitted the Counsel for the applicant to circulate the present application under Section 389<\/a> of the Criminal Procedure Code, 1973<\/a>, as the applicant wanted to appear for the said examination. Counsel for the applicant submitted that the applicant should be released on a temporary bail for a period of one week to enable him to appear for the examination.<\/p>\n

The Court noted that the applicant was in jail for the last nine years and during the trial he was on bail for some period, and he did not misuse the liberty granted to him.<\/p>\n

The Court, after considering these facts, opined that it was inclined to release the applicant on temporary bail. Thus, the applicant was released on a cash bail of Rs 15,000 for one week, i.e., upto 31-05-2024.<\/p>\n
