Allahabad High Court clarifies"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Allahabad High Court:<\/span> In an application filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Code of Criminal Procedure<\/a> (CrPC)&#8217; by the applicant challenging the order passed by the Family Court, recalling an <span style=\"font-style: italic;\">ex-parte<\/span> order which had dismissed a maintenance application filed by the applicant&#8217;s wife and daughter under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> for want of prosecution, <span style=\"font-weight: bold;\">Arun Kumar Singh Deshwal, J.<\/span>, while dismissing the application, noted that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> is a social justice legislation and upon fulfilling certain conditions, order passed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> can be recalled or modified.&nbsp;<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The applicant challenged the order passed by the Principal Judge, Family Court, Azamgarh, which reinstated a maintenance application filed by his wife and daughter under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>. The original application for maintenance was dismissed due to the non-prosecution by the applicant&#8217;s wife and daughter. Subsequently, a recall application was filed, and the Family Court recalled the dismissal order and restored the maintenance application to its original position. The applicant filed the present application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, seeking to quash the order that restored the maintenance application.<\/p>\n<p style=\"font-weight: bold;\">Contention of the Applicant &nbsp;<\/p>\n<p style=\"margin-bottom: 3%;\">The main contention of the applicant was that the Family Court erred in recalling the dismissal order under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> The applicant argued that once an order is passed in criminal proceedings, dismissing an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> for want of prosecution, it cannot be recalled or modified due to the bar imposed by Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519647\" target=\"_blank\" rel=\"noopener\">362<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>.<\/p>\n<p style=\"font-weight: bold;\">&nbsp;Contention of the State<\/p>\n<p style=\"margin-bottom: 3%;\">The counsel for State argued that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519647\" target=\"_blank\" rel=\"noopener\">362<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> allows for exceptions as provided by the CrPC or any other law. They pointed out that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519357\" target=\"_blank\" rel=\"noopener\">127<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> permits the Court to alter or modify orders passed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, thus making an exception to the bar imposed by Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519647\" target=\"_blank\" rel=\"noopener\">362<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>.<\/p>\n<p style=\"font-weight: bold;\">&nbsp;Decision and Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">After hearing the arguments from both sides and reviewing the records, the Court found that the application for maintenance under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> was dismissed for want of prosecution on, and subsequently recalled and restored to its original number by the Family Court&#8217;s order. The Court noted that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519356\" target=\"_blank\" rel=\"noopener\">126(3)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> gives the Court power to make just and proper orders in proceedings under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, including recalling a dismissal for want of prosecution.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further examined the applicability of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519647\" target=\"_blank\" rel=\"noopener\">362<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and observed that the bar imposed by this section does not apply if there are provisions within the CrPC that permit the recall or alteration of a judgment or final order, specifically, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519357\" target=\"_blank\" rel=\"noopener\">127<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> allows for the alteration of maintenance orders, indicating that the legislature intended for the Magistrate to retain jurisdiction to make necessary changes to orders under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> as circumstances require. The Court emphasized that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> is a piece of social justice legislation aimed at ensuring maintenance for wives, children, and parents, and should be interpreted in a manner that advances the cause of social justice.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"Times New Roman&quot;; font-size: 13.0pt;\">The Court cited the Supreme Court&#8217;s judgment in<\/span> <span style=\"Times New Roman&quot;; font-size: 13.0pt;\"><span style=\"font-style: italic;\">Badshah<\/span> v. <span style=\"font-style: italic;\">Urmila Badshah Godse<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/7618O14W\" target=\"_blank\" rel=\"noopener\">(2014) 1 SCC 188<\/a> , which emphasized the need for a purposive interpretation of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> to achieve social justice, and the legislative intent that the Magistrate should have continuing jurisdiction over maintenance orders to address changing circumstances. The Court also referred to the Supreme Court&#8217;s judgment in <span style=\"font-style: italic;\">Sanjeev Kapoor<\/span> v. <span style=\"font-style: italic;\">Chandana Kapoor<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/TardO66o\" target=\"_blank\" rel=\"noopener\">(2020) 13 SCC 172<\/a> to affirm that the embargo of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519647\" target=\"_blank\" rel=\"noopener\">362<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> does not apply to proceedings under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>&nbsp;<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">The Court, therefore, rejected the applicant&#8217;s contentions and upheld the Family Court&#8217;s order to recall and restore the maintenance application. The Court further directed the Principal Judge, Family Court, to conclude the proceedings under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> expeditiously, preferably within one year, without granting unnecessary adjournments to any party.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Rajkumar v.
